Minutes of an adjourned regular meeting of the Common Council of tIV City
of Rochester, Minnesota, held in the Council Clambers, in the City Hall, in said City,
on August 15•t h, 1921, at 8 o'clock, P.M.
Meeting called to order by President Weeks.
Roll Call: Present: Weeks, Case, Erickson, Frank, Olson, Witzke. Absent:
Miner.
Motion by Olson second by Case carried that the minutes of t le meetings held;
on July 25t h, 1921) and August lst, 1921, be each approved.
A petition signed by many residents of the port fern part of the City of
Roc rester, Minnesota, remonstrating against the J. C. Thompson Company rendering plant
located in that part of the City, was read, and Alderman Frank wbo submitted it asked
that it be returned to him in order that be could present it to the locai Health Offic-
er for his consideration also, and it was returned accordingly.
Clarence Thompson said that this plant has been operated only six days dur-
ing this season and that he t hnught this objection originated through conditions on
August 12t %

IL- explained that only tallow is rendered at their plant and as they know of
t le feeling t ley take every precaution to keep their establishment in the best of con-
dition t hat suc h a plant can be kept, and said .further t hat the feeling is suc h that
whenever an odor is noticed it is tagged as belonging to Thompson's rendering plant.
Alderman Frank said that he was called on thv above mentioned date and in-
vestigated t he complaint by following t he steno h t hrough t hat section of t le City
until it lead Ira to the rendering plant, so consequelitly declared that there can be
no question as to were t-he blame lies.
0. R. Sprout contradicted Vire Tbomps9n's claim as to where the stench came
frcml on that particular date, and said be has noted that these smells are only in
evidence at such times as the rendering plant is being operated.
Motion by Case second by Olson carried. that this matter be referred to the

Health Officer for investigation and report. '
James H. Goodenough asked that consideration be given to a settlement with
him for damages on account of his having broken a leg while riding a motorcycle over
what by claimed was defective paving at the intersection of the alley running north 1
and south through' Block 20, in Moa and Oldh) Addition with Second Street Southeast.
Motion by Witzke second by Erickson carried that tip, matter be referred to
the City Attorney and the . City Engineer for investigation and report.
This being the time and place fixed for the opening of bids for the furnish-
ing of one motorcycle, the following bid was opened and read:

the, following equipments:__

rier, one Heel Brake, one Flat Front Fender with Skirt Guardq one pair
foot rest, one cushion for Luggage Farrier and one Electric Light on Speed-
ometer laid down here at Rochester ready to run for $450.00

Dr. Cr. H.._ NewbDuse cautioned the Common Council of the danger
caused by the power flusher and sprinkler being allowed to stand in the
intersection of Eleventh Avenue and Center Street East while being filled
and this shutting off the view of drivers approaching the intersection
from the north or west and besides making it necessary for those who co: --le
off Eleventh Avenue Northeast in making the turn west to go over onto the
left-hand side of Center Street East and thereby make a liability of col-
lision wit h ve Moles going east.
Motion by Wit�ka second by Erickson carried that the matter be
referred to the Water and Sprinkling Committee and t, he City Engineer for

The report of the Public Utility Board, ";'titer Department, for
the month of July, 1921, showing receipts in the amount of M,943.58 and
disbursements in the amount of $5,171.58, and the report of the Public
Utility Board, Electric Department for the month of July, 1921, slowing
receipts in the amount of $21, 512:01 and disbursements in the , amount of
$139370.64� were eac h separately read, and motion by Olson second by Frank
carried that -the said reports be each placed on file
The report of the Milk Inspector for the week ending August 6,
1y21, was read, and ,notion by Witzke second by Case carried that the same
be accepted and placed on file.
The warranty deed given by Theron J. Dansingburg and Carrie A.
Dansingburg, his wife, to the Uity of Rochester, Minnesota, covering lands
described as follows, for use as a public street, was read, and motion by
Case second by Erickson carried that the saiddbi�d be accepted and placed
on record: Commencing at the Northwest corner of Lot 108 in Auditor's
Plat "A" of the City of Rochester, for a place of beginning; running
t ionce east two hundred sixty four (264) feet, thence north sixty-six (66) ft_
'thence west two hundred sixty four (264) feet, thence south sixty-six (66)
feet to the place of beginning, less the west thirty-three (33) feet

.Alderman Witzke introduced the following resolution wUc h was .read:

That the bid of Leo N. Herrick for the furnishing of one motorcycle under
the following specifications:
-four cubic inches, to be electrically equipped,
A displacement of seventy
and to have one speedometer with Ube maximum hand, one spot light, one lup;page
carrier, one heel brake, one flat front f.'enier and skirt guard, one pair of foot
Pests and cushion and one light on speedometer, at. the following price: i
1 - 74 dubie inch Harley Davidson Motor Cycle with the above mentioned
equipment F.O.Ba Roc heater, ready to run - - - - 450.00

TIP, Mayor and City Clerk of said City are hereby authorized and directed
to execute in behalf of the City of Rochester, a contract with said contractor
for the furnishing of the above named'motorcyclei
The amountof the bond to be given by said contractor is hereby fixed at the'
sum of $500.00 dollars:

Alderman Olson. introduced the following resolution which was read:
Be it resolved by the Common Council of the City of Rochester:
That the City Engineer of said City be and he is hereby directed to open
the streets on Eighth Street Northvestand Eleventh Avenue Southeast and cause all'
obstructions thereon to be removed and the streets opened for traffic.
Motion by Case second by Witzke t Yat said resolution be adopted as read:

Alderman Erickson introduced t he following resolution whit h was read:

That the -action of the City Engineer in removing all obstructions from and open-:
ing for traffic the alley in Block 52 of Morse & Sargent's Addition to the City
of Rochester and in Haggerty's Subdivision of Lots 5 & 6 in State Subdivision of
Section 36, Township 107, . Range 14 and the street in Sixth Avenue Southeast;
be and the seine is hereby approved and confirmed.

The City of Rochester has an Ordinance to prevent the
4obstruction and improper use of streets, sidewalks,lanes and alleys in
the City of Rochester and there is Ao necessity for an ordinance to pre-
17 vent the obstruction of streets with trees:

The following report of the License Committee was read, and
motion by Olson second by Frank carried that the same be accepted and
placed on file and that Howard Paul Campbell be granted a driver's license.

The License Committee recommends that a driver's license be
granted to Howard Paul Campbell in accordance with his application.

The obsolete provisions of certain present ordinances were
discussed, and motion by Witzke second by Frank carried that the City
Attorney be instructed to draft an ordinance providing for a license fee,
etc., to cover every phase of ,peddlingw
Alderman Witzke stated that an application had been made to
him asking for t he licensing of a stock company who give their plays
under canvas, and after a discussion of the application, motion by Frank
second by Erickson carried that such a license be not granted.
The following copy of a communication addressed to the Public
Utility Board and their reply were each read, and motion by Witzke second
by Olson carried that the claim mentioned therein be referred to the City
Attorney:

In regard to the claim of the Westingbouse Electric and Manufacturing
Company in t he amount of $1554.45, whtc h is for time and expense of Engineer R. M.
Beville investigating and correcting trouble with operation of turbine No. 2993,
and 1000 square foot condenser No: 916; time and expense on turbine No. 2993 being
141 days, $261.00,,and expense $69.75, and on condenser #916, 29- days, 5$531.00,
expense $133.26, miscellaneous expense, $1*45, during the period, March 1, 1920 to
April 30, 1920; a total of 44 days; and time and expense of Engineer R.M. Beville
inspecting and overhauling turbine No. 3040 and 1250. sq. ft. condenser No. 863; time
and expense on turbine No0040 being 18 days, $324.00 and expense $75.00, and on con-
denser #863, 6 days $108.00, expense 050000 during the period May 1, to May 29, 19209

Claim of Westinghouse Electric Mfg. Co., of 1554145 for Engineer ser-
vices on turbines and condensors was again submitted to the Public Utility Board at
meeting held on this date after payment on some had been upheld at City Clerks office.
Following action was taken; Mtion passed that the following cummunication be sub-
mitted for your information,, relative to the gbcve claim; t h9 Board begs to advise
that H. E . Swanson was aut Ynrized to have the said work on turbines and condensors
done and the consequent expense incurred, at a meeting of this Board in the month of
February, some authorization having been verbal and not appearing in the, minutes.

Motion by Olson second by Witzke carried that the claim of the Gamewell
Fire Alarm. Telegraph Company, in the amount of tw57.35 for the repairing of
a fire alarm box and rheostat; said repairs having been made necessary
through contact with wires of the local. electric light system, be_ referred
to the City Attorney for ruling as to which Department Funds shall be used
in making payment for t Its bill:

Evidence of seeming irregularities in the sales of material and
use of labor in the Water Department of the Public Utility Board of said

City, previously placed in the hs♦nds of eachmember of the Common Council,
was, discussed.
Alderman Case said that,, at the meeting of the Public Utility
Board held that morning, he introduced a resolution requesting the Common
Council to call on the Public Examiner to make a special examination of
those phases of that Department but 0. W. Sc hrdeder, the only other member
of the Board wID was present, would not second the motion to adopt the said
resolution, so if there is any further investigation to be ;-lia,de it will
have to be promoted by the Common Council:
Alderman Frank introduced the following resolution which was read.,
Be it resolved by the Common Council of the City of Rochester,
Minnesota:
That the Public Examiner of t lie State of Minnesota, be requested
to make a special examination of the books and records of the Water
Department of the Pub1Yc Utility Board of said City in -so -far as the
receipts and sales and use of materials are concerned, and an audit
of the resmlt of the labor expended other: than the regular operation
of the plant for the period from April 1st, 1921, to t ha. date of the
completion of said special examination.
Be it further resolved:
That the Cit.y Clerk of said City be instructed to notify the
Public Examiner of the said request by filing a copy of this resolu-
tion with himr
Motion by Witzke second by Frank that said resolution be adopted

various mounts:

On motion by Olson second by Erickson Council adjourned to August 29t h, 192.1,
