Rochester, Minnesota, held in the Council Chambers, in the City Hall, in said

Meeting -called to order by President Weeks.
Roll Call: Present: Weeks, Adler, Bach, Book, Postier, Wright.
II Absent: Kitzman.
Motion by Wright second by Postier carried that the minutes of the
meeting held on September 28th, 1925, be approved.
President Weeks, announced that this was the time and place fixed for
a hearing on the levying of special assessments for the following public im-
provements and asked if there was any person present who wished .to be heard
relative to either or any of them:
Concrete curb and gutter on and the grading of First Place Southeast

from the South line of Fourth Street Southeast to the North line of Fifth
Street Southeast;
Concrete curb and gutter on and the grading of Fourth Avenue South-
west from the North line of Sixth Street Southwest to the South line of Fifth
Street Southwest;

The construction of a sanitary sewer in parts of Second Street South-
west and Fifteenth Avenue Sduthwest;
The construction of a sanitary sewer in part of Second Avenue North-
west along the East side of Cascade Park.

President Weeks announced that this was the time and place fixed for
a hearing on the grading of Ninth Avenue Northeast from Third Street Northeast

to Fifth Street Northeast and asked if there was any person present who wished
to be heard concerning the said grading:

President Weeks announced that this was the time and place fixed for
a hearing on the construction of a sanitary sewer in Sixth Avenue Southeast
from the center of Eighth Street Southeast to a point 200 feet South, and asked
if there was any person present who wished to be heard . -relative to the Sgid
sanitary sewer:
There was no person present who wished to be heard.
Alderman Kit zman came in at this time and took his Chair.

W. R. Liddl e, J. A. Pierce, S. B. Hall, Leo Herrick* W. F. Klee and F. D.
Remmel, talked against the abolishment of center parking and asked for repeal
of the ordinance providing for diagonal curb parking.
Motion by Kitzman second by Bach carried that the City Attorney be
instructed to draft an ordinance providing for center parking with a limit of

three hours and for` parallel curb parking with a limit of one hour.
Motion by Postier second by Upright carried that the Chair appoint a Com-

mittee to represent the City of Rochester, Minnesota, at the Eonvention of Officials
from cities having Municipally owned public utilities, which is to be held at St.
Paul,, Minnesota, on October 16th and 17th; 1925.
The City Clerk reported that no bids were received for the grading of Ninth
Avenue Northeast from Third Street Northeast to Fifth Street Northeaste

Motion by Cook second by Upright carried that the City Engineer be instruct-
ed to segure the necessary labor and materials and grade .Ninth Avenue Northeast to
an established grade line between Third Street ,Northeast and Fifth Street Northeast,
in accordance with the•plans and specifications for -the said grading which are on fil

struction of a sanitary sewer in part of Sixth Avenue Southeast as above described, t

one hid of Vpm. C. Fraser and, Son was opened and read, the said bid being - e" vitrifi
pipe sewer $1.10 per ft., 6" on 8" Y connections $1.00 each, manholes $55.00 each,
loose rock excavation $2.50 per cu. yd., solid rock excavation 87.Oo per cu. yd.
This being the time and place fixed for the opening of bids for the furnish
ing of 25 tons of Genasco liquid asphalt,. the one bid of the Barber Asphalt Company w
opened and read, the said bid being $54.86 per ton, F. 0. B. Rochester, Minnesota.
The report of the Clerk. of the Municipal Court for the areek; ending Septembe
28th, 1925, showing criminal fines collected in the amount of $125.00, civil fees
received in the amount of 25 cents, and Olmsted County fees received for August 1925,
in the amount of $56, 60 9 and for the week ending October 5th, 19259 showing criminal
fines collected in the amount of $120,00, and civil fees received in the amount of
$10,79, were each separately read, end 'on motion by Coqk second by Bach the same wer

Alderman Cook introduced a resolution accepting the above mentioned
proposal of the Barber Asphalt Company for the furnishing of 25 tons of Genasco
liquid asphalt and fixing the amount of the bond to be given by the said contractor
at the sum of $1400.00, which was read.

Upon motion by Wright second by Cook that the said resolution be adopted
as read, and all voting in farvor thereof, President Weeks declared the said resolu-
tion duly passed and adopted:
Alderman Cook introduced,a resolution determining to adhere to all former
resolutionsin the proceedings relative to the construction of a sanitary sewer in
Sixth Avenue Southeast as above described, which was read. t
Upon motion by CoBk second by Adler that the said resolution be adolbted
as read, and all voting in favor thereof, President Weeks declared the said resolu-
tion duly passed and adopted:
- Alderman Kitzman introduced a resolution accepting the above mentioned
proposal of Wm. C. Fraser and Son for the construction of a sanitary sewer in Sixth
Avenue Southeast as above described, and fixing the amount of the bond to be given
by the said contractor at the sum of $300.00, which was read.
Upon motion by Bach second by Kitzman that the.said resolution be adopted

Alderman Wright introduced a resolution levying special assessments for
the construction of a sanitary sewer in Second Avenue Northwest commencing at the
center of the intersection of Second Avenue Northwest and Tenth Street Northwest and
running thence. Southeaftrerly, to a point 30 feet West of the Southwest corner of Lot
12 in Block 24 in Northern Addition, thence Southerly to a point 20 feet West of
the intersection of the center line of Binth Street Northwest with the East line of
Second Avenue Northwe°st, thence Southerly to a point 5 feet South and 30 feet West
of the Northwest corner of Lot 15 in Block 23 in Northern Addition, which was read.
Upon motion by Cook second by Wright that the said resolution be adopted
as read, and all voting in favor thereof, President Weeks declared the said resolu-
tion duly passed and adopted -

center line of Fifteenth Avenue Southwest, thence South degree 15 minutes
West 330 feet, to the center of Fifteenth Avenue Southwest, thence South along
the center line of Fifteenth Avenue Southwest to the center of Fifth Street
Southwest, which was reed.
Upon motion by Postier second by Wright that the said resolution ba
adopted as read, and all voting in favor hhereof, President Weeks declared the
said resolution duly passed and adopted.
Motion by Kitzman second by Wright carried that the property of Nattig
A. Riege,or any part thereof, described as the West 8 rods of the North 2 acres
of the East 10 acres of the West �3 acres of the North one"half of the North-
east quarter of Section 3, Township 106 North, Range 14 West, be not allolked
to connect to the above described Sewer in parts of Second Street Southwest
and Fifteenth Avenue Southwest until such time as *150 62 with interest there-
on from this date, is paid into the City Treasury of said City for distribu-
tion to the property owners who were on this day assessed for the above des-
cribed sanitary sewer costs.
On motion by Bach second -by Adler Council adjourned to 7:30 o'clock
P.M.., October 5th, 1925
At 700 o'clock P.M., on October 5th, 1925, pursuant to adjournment
taken, the Common Council again convened and were .called to order by President
Weeks.

The report of the Justice of the Feace of the__ First Ward for the
month of September 1925s which shows no, business before his court during that
period, was read, and on motion by, Postier second by Wright' the same was
ordered placed on file.

The report of the City Justice,forthe month of September 19251, show-
ing -record of thirty cases terminated before him during that period, was read.,
and on motiom by Wright second by Postier -the same .was referred to the City
Attorney.

The report'of the City Engineer for the month of September, 1925s
showing expenditures from the General Fund for labor in the amount of $788.049
from the Street and Alley Fund in the amount of $1187.751, from the .Sewer Fund
$152.00, from the Bridge Rind $10.50, and from the Permanent Improvement Rev
Revolving Fund $2557.659, was read, and on motion by Wright second by Adler it
was referred'to the Street and Alley Committee.
The report of the Building and Electrical Inspector for the 'month of

September 1925, showing building inspection fees collected in the amount of
$82.00, and electrical inspection fees collected in the mount of $14.25, was

read, and on motion by Adler.second by Cook the same was referred to the Finance
Committee.
The report of the Milk Inspector for the month of September 1925, was read,
and on motion by Bach second by Wright, it was ordered placed on file.
The application of Taylor. Cutshall for permit to hold, give and conduct

public dances in the Woodman Hall on October loth and 17th, 1925, was read.
The application of J. F. Stetson and Mike Boosalis for permits to place
and maintain signs were each separately read, and on motion by Bach second by Cook
permits were granted.
The application of W. J. Snellinger for permit to move his licensed sign
from 14 Third Street Southeast to 16 Third 'Street Southwest, was read, and on motion
by Bach second ,by, Cook carried that permission be granted.
A petition asking -that ornamental street lights be installed on both sides
of Second Street Southeast, East of the Right-of-way of the C. & G. W. R. R. Co.,
was read, and on motion by Adler second by Cook.the said petition was referred to
the Lighting Committee.
Alderman Kitzman came in at this time and took his Ch4r.
A petition asking that, Second'Avenue Southwest from the South line of
Sixth Street Southwest to the quarter section line in Section 2, Township 106, Range
14, be opened and that the said street be graded to an established grade line, was
-read, and on motion by Cook second by Wright the same was ordered placed on file.
The following recommendations for to be included in the 1925 sprinkling
and flushing costs were read, and on -motion by Wright second by Postier the same
were approved and ordered plaoed,on file:•

The report.of the City Clerk for the cost of sprinkling, flushing and
placing of calcium chloride and depreciation of equipment for the sprinkling season
of 1925, a total of $9709,729 was read, - and on motion by Cook second by Adler, the
same was ordered placed on file.
The City Engineer's report of the distribution of the said 1925 sprinkling,
flushing, etc., costs, was read, and on motion by Postier second by Wright the same
was ordered placed on files r

j A recommendation by the Board of Park ,Commissioners that $897.,00 be
I paid to Zuehlke and Christopherson on their contract for the construction of an

administration building at the New TouristPPark was read, and on motion by Cook
second by Wright the same was ordered placed on file.
The claim of St. Mary's Hospital in the amount of $15.00 for Tsola-
tion 'Hospital services in the establishing, maintaining and releasing of
quarantine in the case of Pauline Day as a diphtheria patient , six days at
$2.50 pefr day, was read, and on motion by Bach second by Cook, the said amount
was appropriated from the General Fund and ordered paid, and the City 'glerk
i was instructed to bill Olmsted County, Minnesota, for one-half of the said
charges.

The report of the Finance Committee to the effect that they had
checked the September 1925, report of the Building and Electrical Tnspector
and found the same to be correct was read, and on motion by Adler second by
'Cook the 'said 'Finance Committee report was ordered placed on file and 'the said
report of the Building and Electrical Inspector was ordered placed ton file.
Motion by Bach second by Adler carried that the City Clerk be in-

strueted `to turn over three more sets of plans and specifications for the local
Sewage Disposal Plant to G. Schwartz and Co., the contractors for the construc-
tion of the 'said plant.

Public liability and property damage insurance policy endorsements

r changing the firm name insured on policy No: -1039 from the Rochester Cab Com-
pany to George Lund, sole trader, doing business as the Checker Cab Company,
and changing the coverage on one Willgs-Knight .automobile to a Reo automobile,

were each read, and the application of George Lund that the said changes be
i made in his licenses -for the. use of automobiles in taxi service, cows read, and
on motion by Bach second by Cook the said endorsements were accepted and the
said application was granted and the City Clerk was- instructed to make changes
in his °license record accardingly.
= Alderman Postier introduced a resolution granting permit to Taylor
Cut,shall to hold, .give and conduct public dances in the -Woodman Hall, on Oct-
ober loth and lath, 1925, and fixing -'the fee at the total sum of $10.00, which
was read.
Upon. motion by Cook second by Kitzman that the said resolution be
adopted as read, dnd all voting in favor thereof, President Weeks declared the
said resolutidn duly passed `and adopted.
'Alderman Kitzman introduced a resolution fixing 8 o'clock P.M.,
October 19th, 1925, as the time for the levying o: special assessments for the
cost and expense of making sidewalk repairs and ordering notice of public hear-
ing thereon, which was read.

ed as read, and all voting in favor thereof,, President Weeks declared the said
resolution duly passed and adopted.

Motion by Kitzman second by Adler carried that the City Attorney be instruct- I .-
ed to make report as to whether or not the Interstate Power Company can legally re-
quire that their customers make a five dollar deposit before they be furnished with
gas service and also as to whether or not the said Company can make a mindmum charge
for their services. 1 3'
On motion by Cook second by Wright the paving of the alley running North
and South across Block 46 in Original Plat was accepted as completed according to
contract therefor.
First and final estimate prepared by Chas. H. Armstrong, City Engineer,
in favor of Feller Bros., for the paving of the above described alley, showing the
sum of $153809 as being due to the said contractors, was read, and on motion by
Kitzman second by Adler the said estimate was ordered placed on file.
Alderman Cook introduced a resolution appropriating 15 8.0 from h Y,

Permanent Improvement Revolving Fund and ordering payment made to Feller Bros. for
the paving of the North and South alley in Block 46 in Original Plat, which was read.
Upon motion by Cook second by Wright that the said resolution be adopted
as read, and all voting in favor thereof, President Weeks declared the said resolu-
tion duly passed and adopted.
Alderman Adler introduced a resolution appropriating $800.00 from the
ParkT.mprovement Fund and ordering payment made to the Mayo Trust Fund for to apply t
on pay rolls for labor during the period for the weeks ending August 23rd, 1925, to
October 2nd, 1925, inclusive, in accordance with sworn billing made by Wm. Dike,
Secretary of the Park Board, which was read.
Upon motion by Wright second by Cook that the said resolution be adopted
as read, and all voting in favor thereof, President Weeks declared the said resolu-
tion duly -passed and adopted.
Alderman Postier introduced a resolution appropriating $897,00 from the
Permanent Improvement Fund and ordering payment made to Zuehlke and Christopherson
on contract for the construction of an administration building at the 'New Tourist
Park, which was read.
Upon motion .by Cook second by Wright that the said resolution be adopted
as read, _and all ,voting in favor thereof, President Weeks declared the said resolu-
tion duly passed and adopted.
Alderman Wright introduced a resolution fixing 8 o'clock P.M., October
19th9 1925, as the time for a hearing on the proposed contraction of a sanitary sewer
in Sixth Street Northwest commencing at a point opposite the center of Lot 18 in
Block 2 in Conley's Addition, and running Northwesterly in Sixth Street Northwest
to a point in the center of Sixth Street Northwest 191:25 feet East of the East line
df Eleventh Avenue Northwest, thepee West along the center line of Sixth Street North
west to a point 45 feet Eastr of the East line of Elevent). Avenue Northwest, and

Upon motion by Cook second by Kitzman that the said resolution be
adopted as read, and all voting in favor thereof, President Weeks declared the
said resolution duly passed and adopted.
Alderman Wright introduced a resolution authorizing and directing the
Public Utility Board to. lay water mains in Fburth Street Northwest from
Fourth Avenue Northwest to Fifth Avenue northwest and First Street Northwest
from Eleventh Avenue Northwest to Twelfth Avenue Northwest, and in Sixth Street
Northwest from.the end of the present water main to Eleventh Avenue Northwest,
which was read.
Upon motion by Bach second by.Wright that the said resolution be
adopted as read, and all voting in favor thereof, President Weeks declared the
said resolution duly passed and adopted.
Alderman Po sti er introduced a resolution fixing 8 o'clock P JT., < 0 ct-
ober 19th, 1925, as the time for the levying of special assessments on the
following improvements and; ordering notice of public hearing thereon, which
was ready the improvements being;
Construction of sanitary sewer in Sixth Avenue Southeast from the
center of Eighth Street Southeast to a point 200 feet South;
The grading to an establishegj Z?rade of Ninth Avenue Northeast from
Third Street Northeast to Fifth Street Northeast;
The construction of concrete curb and gutter . on Sixth Street South-
east from Third Avenue Southeast to Fburth Avenue Southeast.
The grading to an established grade line of the alley running North
and South across Block 46 in Original Plat and the paving of the said alley

Motion by Adler second by Cook carried that record be made that George
Sherman, M. C. Lawler, Horace Doty, and Glenn Witherstine were the Citizens' Com-
mittee who worked with the Committee from the Common Council in the drafting of the
'traffic ordinance which abolished center parking.
Alderman Adler introduced a resolution regulating traffic within the City
of Roche st erg providing for the operation and parking of vehicles and designating
Arterial Highways in said City, which was given its first reading.
On motion by Adler second by Gook the rules were suspended and. the said
ordinance was given its second reading:
On motion by Book second by Adler the rules were suspended and the said
ordinance was given its third and final reading.
Upon motion by Cook second by Adler that the said ordinance be adopted

as read, and all voting in favor thereof, President Weeks declared the said ordi-
nance duly passed and adopted.
Request of the Mayor that $$39, 207.00 a be included in the 1925 tax levy for
Police Department operation, of *ubl. $5, 500.00 is to be for interest in police and
fire alarm telegrap� system; of the Health Officer that $6,640.00 be included for
Health Department operation; of the Civic League that $3250.QO be included for Visit-
ing Nurse salaries and expenses and Pest Room attendant, rental, etc.; of the Park

Alderman Cook introduced a resolution authorizing the City Engineer .

Upon motion by Wright second by Adler that the said resolution be
adopted as read, and all voting in favor thereof, President Weeks declared the
said resolution duly passed and adoptede
Motion by Cook second- by Wright carried that the City, Engineer be
instructed to make invettigation in the matter of street signs and make report
at the meeting of this Common Council which is to be held October 12th, 1925.
Motion by Bach second by Adler carried that the City Engineer be
authorized to buy one barrel of yellow paint for the purpose of marking park-
ing spaces.
On motion by Bach second by Cook the. City Engineer was granted a
vacation of ten days to begin October 27th, 1925.
