Minutes of an adjourned regular meeting of the Comex Council of the
City of Rochester, Minnesota, held in the Council Chambers, in the City Hall,
In said City, on August 9th, 1926, at 7:30 o'clock P.M.
Meeting called to order by -President Weeks.
Roll Call: Present: Weeks. Adler. Bach. Hicks. Kitzman, Schroeder,
Absent: Postier.
On motion by Kitzman second by Hicks the minttes'of the meeting
held on August 2nd, 1926, were approved.
Kris Nielson brought the following communication -before the Common
Council and it was read, after which, following the discussion of the matter,
motion ;by Hicks second by Kitzman carried that Mr. Nielson be instructed to
haul all black dirt to the local parks, if the Park Board wants it without
cost to them, and the balance to the hole that he made South of Thirteenth
Street Northwest and West of Second Avenue Northwest, until it is filled:

This being the time fixed for the opening of proposals for the pur-
chase of $75,9000 00 City of Rochester, Minnesota, Sewage Disposal Plant Bonds,
the following proposals were opened and read:

Wells -Dickey Co., Minneapolis, Minn., par, accrued interest and
75*00 premium;
Northwestern Trust Co., St. Paul, Minn., par, accrued interest and

The Sinking Fund Commission of the City of Rochester, Minnesota, par,
eerued interest and premium of $3091.25 for $50,000.00 of the said bonds.
The City Attorney orally ruled that the proposal of the Sinking Fund Com-
ission could net be accepted as under the proosedings the whole block of $759000.00
ends must be sold to one purchaser,at which the local representative of Lane, Piper
nd Jaffray proposed the following, which was read; the same being later orally amend
d by him to the effect that he would sell back these50,000.00 bonds to the Sinking
and commission at 105,75:

The undersigned agrees that in the event they are awarded the
$759000. City of Rochester 4431% Sewagge Disposal Plant Bonds on their bid
of 100 and a premium of $3965.00 and accrued interest from June 1, 1926,
to date of delivery of the bonds, they will sell back to the Sinking
Fund Commission of the City of Rochester $502000, of the above bonds at
105,9325 and accrued interest.

Alderman Hicks introduced the following resolution, which was read:
"Be it resolved by the Common Council of the City of Rochester, Minnesota:

are hereby awarded and sold to Lane, Piper and Jaffray, Inc., and that the same be
delivered to them upon them paying into the City Treasury of the amount of the said
bid therefor, said bonds hereby awarded and sold' are described as being numbered: -

day of December in each of the years 1934 to 1944, inclusive, the said bonds bearing
interest at the rate of Q4 per annum payable semi-annually on the first day of June
and December of each year, both principal and interest on the said bonds being payablq
at the office of the City Treasurer in the City of Rochester, Minnesota, and

Clerk of said City are hereby authorized and directed to duly execute the said bonds

Upon motion by Kitzman second by Postier that the said resolution be adopt-
ed as read, and all voting in favor thereof, except Alderman Adler who voted "Nay",
President Weeks declared the said resolution duly passed and"adopted,
Alderman Hicks introduced the following resolution, which was read:

"Be it resolved by the Common Council of the City of Rochester, Minne-
sota:
That the bid and offer of Lane,, Piper and Jaffray, Inc., for
1025,u00.00 City of Rochester, Minnesota, 4.n� Sewage Disposal Plant Bonds,
,,dated September 1st, 1924, which were at this meeting offered for sale, being

:bonds and '230.90 as accrued interest from June lst, 19262 is deemed to be the
most .favorable proposal for the said bonds, and

The report of the City Weighmaster for the month of July 1926, show-
ng weighing fees collected in the amount of �13.00, was read, and President
eeks erdered that the same be referred to the Finance Committee.
General balance sheet, trial balance, statement of Sinking Fund in-
estments, statement of account with the Treasurer of Olmsted County, unex-
ended budget appropriation statement, statement of School District�No. 8,
arrants countersigned by the City Clerk, etc., of the City of Rochester,
innesota, as at July 31st, 1926, prepared by the City Clerk of said City,

The following report of the Milk Inspector was read,.and President Weeks

During the month of July I have taken 129 milk samples for laboratory
testing. I made 45 dairy inspections. I also made 2O.'.inspections covering
the 4 pastelirizing plants.
I finished my semiannual grading of the dairies supplying milk to

The report of the Health Officer for the City Farm for the month of July
1926, showing receipts in the amount of %11105048, disbursements in the amount of
$949093 and a balance on hand in the amount of $29570-88, was read, and President Weeke
ordered that the same be placed on Moo -
The application of Felix Jacobs for a driver's license, was read, and on
motion by Postier second by Schroeder license was granted,
The application of the Yellow Cab Company for two licenses to operate two
automobiles as taxi -cabs, were each separately read, and on motion by Hicks second
by Kitzman licenses were granted;

A petition asking that a street light:.be installed at the intersec-
tion of Third Avenue Northwest and Sixth Street Northwest, was read, and an
motion by Schroeder second by Postigr it was referred to.the Lighting Com-
mittee •
The application of W. H. Wilson 'for appointment as Assistant Super-
intendent at the local Sewage Disposal Plant was .read, and President Weeks
ordered that the same be placed on file.
The following communication was read, and on motion by Bach second
by FTicks the City Engineer was authorized and directed to furnish the Fair
Associstion with any amount of water for-,gny purpose and charge the same to
them at the regular rate;

As Supervisor of the Department,in charge of Light and
Water at the coming Olmsted County Fair to be -held August thirtieth,
thirty-first, and September first, and second, I elm writing to make
application for the free use of water for the race tracks.
We are not putting on regular horse races this year, but
are having some attractions in form of local races open to farmers.
Just how mach water will be needed cannot, be stated with certainty
at this moment, but if it is dusty, it will be absolutely necessary
to have a limited amount.
The reason I am asking for free use,of water is because
of the tremendous drive we are making to liquidate the indebtedness
of the Fair Association. and relieve the public spirited citizens who
have backed this indebtedness by their personal notes°

Copy of requisition made by the Health Officer on St. Mary's Hospital
for isolation Hospital services to Wm. Weichman, diagnosed to be suffering
from suspected scarlet fever, was read, and President -Weeks ordered that the
same be placed on file.
The application of Mrs. C. E. Gates, Milk Inspector, for permission
to take her vacation beginning August 12th, 1926, was read, and on motion
b- fficks second by Bach the Milk Inspector was granted a vacation of ten
days.
Estimate made by Chas. H. Armstrong, City Engineer, in -favor of Olm-
sted County'Oil Company showing the sum of $517,61 as being due to the said
Company for the furnishing of 802.E gallons of oil for the treating of creosot-
ed wood blocks, was read, and President Weeks ordered that the same be placed

The matter of making the sprinkling tax receipts into alphabetical order
)rior to, the time for their collection instead of making the collections from resolu-
�ions levied as districts (streets and avenues) by looking up each individual assess-
nent from the street or avenue resolution where the property might be abutting and
Nriting the receipt at the time the person appears ,to make the payment, was fully

considered, and it was decided that sprinklingcollections shall be made as in the j

past, that is, by the proceedings above last mentioned.

On motion by Adler second by Bach the Chair was requested to appoint a

Committee for the compilation,etc., Df;, the 1926 sprinkling assessments, as provided
for in Section 263 of the Charter of this City, and President Weeks accordingly
appointed the City Clerk, the City Engineer and the City Attorney as a Committee for

that purpose.
Alderman Adler+ introduced a resolution appropriating $551.93 from the Gener
al Fund and ordering payment made to the Rochester Post -Bulletin for official publice
tions and printing during the period June 30th, 1926, to July 31st, 1826, in accord-
Iante with sworn billing made by Clare W. Blakely under date of August 2nd, 1926,
which was read.
Upon motion by Bach second by Adler that the said .resolution be adopted as
read, and all voting in favor thereof, President Weeks declared the said resolution
duly passed and adopted.
Alderman Bach introduced a resolution appropriating l!'W1.93 from the Sewage
Disposal plant Fund and ordering payment made to Frederic Bass, Consulting Engineer
for the local Sewage Disposal P1ant,foT three inspection trips in connection therewitr
plus expenses incident thereto, which was read.
Upon motion by Adler second by Bach that the said resolution be adopted as
read, and all voting in favor thereof; President Weeks declared the said resolution
duly passed and adopted, I
Alderman Hicks introduced a resolution appropriating $10,672.66 from the
Sewage Disposal Plant Fund and ordering payment made to the General F1und of said City
for return of temporary transfers made from the General Fund to the Sewage Disposal
Plant Fundo under and by resolution passed and adopted July 26th, 1926j which was

Alderman Schroeder introduced a resolution appropriating $240.92 from
the General Fund and ordering payment made to the Light and Water Department
of the City of Rochester, `innesota, for the water furnished;-- for sprinkling
and flushing during the month of. July 1926, which was read.
Upon motion by Postier second by 'Bach that the said resolution be
adopted as. read, and all voting in favor thereof, President Weeks declared the
said resolution duly passed and adopted;,
Alderman Postier introduced a resolution appropriating $261037 from
the Street and Alley Fund and ordering payment made to Hayes -Lucas and Green
for cement, tar paper and red cedar siding furnished for the construction of
sidewalks, which was read.
Upon motion by Adler second by Bach that the said resolution be adopt
ed as read, and all voting in favor thereof, President Weeks declared the said
.resolution duly passed and adopted,
Alderman Postier introduced the following resolution, which was read:
"Be It resolved by the Common_ Co;Omcil of the City of Rochester,
sota:
That the sum of $329,19 be appropriated and paid to the Olmsted
County oil Company for gasoline and oil during the month of July, 1926, $158073
thereof being payable from the General Fund and $170,46 thereof being payable
from the Street and Alley Fund,
The Mayor and City Clerk are hereby authorized and directed to draw
a warrant .for said sum upon the City Treasurer in accordance herewith, and
cause said payment to be made,` "
Upon motion by Bach second by Adler that the said resolution be
adopted as read, and all voting in favor thereof, President Weeks declared the
said resolution duly passed and adopted.
Alderman Kitzman introduced a resolution appropriating .�n517,61 from
the Street and Alley Fund and ordering payment made to the Olmsted County Oil
Company for 8025 gallons of oil at ,0645 a gallon for use in treating creosot-
ed.wood block pavement, which was read..
Upon motion by Postier second by Hicks that the said resolution be
