Minutes of an adjourned regular meeting -of .the Common,Council of the
Gity of Rochester, Minnesota, held in the Council Chambers, in the City Ralf
in said City, on August 16th, 1926,at 7:30 o'clock P.M.
Meeting called to •order )by .President Weeks.
Roll -Call: Present: Weeks, Adler, Hioks, Kitzman, Postier.-Absent:

Public hearing was had on the construction of a sanitary sewer in
Seventh Street Northwest,commeneing at the center of the,intersection of
Seventh Street Northwest -and Sixth Avenue Northwest and running Northwester-
ly along; the center line of Seventh Street Northwest to a point 792 feet
East of the East line of Eleventh Avenue Northwest, during which Alderman
Schroeder came in and took his.Chair,
Edward Dornack, for financial reasons, opposed the construction of.
this sanitary sewer -but upon an understanding that the assessment for it
would be levied for it in two installments he•withdrew opposition.
Mrs. W8,rren Lampman was neutral in the matter and John F. Stephan,
Wm. Sawinski and Leo Ranfrariz talked in favor of it.
.Alderman Bach came in at thi8 time and took his Chair.
Public'hearing wat had on the construction of a combined concrete
curb and gutter along both sides of Fifteenth Avenue Southwest from the
South line of Second Street Southwest to the North line of Fifth Street
South-west except along the North 231 feet on the West side-of•the said Ave-
nue, there being, no person present who wished to be heard relative to the
said curb and gutter. F
This being the time and place fixed for opening of bids for the con-
struction of the said curb and gutter, the following broposals were opened
and read:

combined completed curb and gutter 85¢ per lineal ft.;
John J. Kerr, completed gutter 22¢ per sq, ft., combined competed
curb and gutter 89¢ per lineal ft.
On motion by Postier second by Adler the said proposals were referred
Ito the City Engineer for tabulation and recommendations.
The application of E. M. Murphy for a driver's license was read, and
on motion by Postier second by Hicks license was granted.
The following copies of resolutions passed and adopted by the Com
missiottprs of the Sinking Pond were each: separately read, and on motion by
icks second by Adler the actions set forth therein were approved and"iit".,':+

"Be it resolved by the Commissioners 6f the Sinking Fend of the City of
'oehester, Minnesota:
That the sum of 52,875,00 be appropriated from the Sinking Fund of said
;ity and paid to Lane, Piper and Jaffray, Inc., to apply a.s the purchase price of
%O,000.00 43�, Sewage Disposal Plant Bonds of the City of Rochester, AAinr_esota, dated
,eptember 1st, 1924, and maturing three (3) thereof on the first day of December in the
rears 1932 and 1933, four (4) thereof on the first day of December in each°Yof the
rears 1934 to 1944, inclusive, the said bonds being numbered - 120, 121, 122, 138, 139,
L40, 156, 157, 158, 1590 174, 175, 176, 177, 191, 192, 193, 194, 209, 210, 2112 212,
?27, 228, 2290 230' 245, 246, 24711 248, 263, 364, 2659 2669 2811 282, 283, 284, 301,

L926, and all subsequent interest coupons attached; `�50,000.00 thereof being for prin-
,lipal on the said bonds and $2875.00 thereof being for premium on the said bonds.
The resolutions passed and adopted by the Sinking bond Commission August
9th, 1926, relative to the purchase of these bonds are hereby repealed, and the
warrants drawn in connection therewith are hereby cancelled.
"Be it resolved by the Commissioners of the Sinking Fund of the City of
Rochester, iinnecota:
That the sum of $461080 be appropriated from the Interest Fund of said
City and paid to Lane, Piper and Jaffray, Inc., for accrued interest June lst, 19269,
to August loth, 1926, inclusive, on $50,000.00 City -of Rochester, 1innesota, 4-
Sewa.e Disposal Plant Bonds purchased from them on that date.
The appointment by the Mayor of Ray Hellenbolt, Bert Dieter, Wilson
Dieter, George Schmel-Zer and Jim O'Connor, as Speciel Patrolmen for August 17th, 1926,
was read, and President Weeks ordered that the same,be placed on file.
The following communication was read, and President Weeks ordered that the
same be placed on file:

This is to certify that at a special meeting of the Board
of Education held August 11, 1926 at 6 A.M. Lester Fiegel was unanimously
chosen -to fill the vacancy on the Board of Education until the next
charter election, caused by the resignation of Mr.S. L. Seaman.

On motion by Adler second by Postier the sum of A40.uO was appropriated
from the General Fund and ordered paid to the League of Minnesota tiAunicipalities for
City of Rochester, 1.1innesota, dues for the year ending September 1st, 1927.
The claim of St. Mary's Hospital for J7,50, for Isolation Hospital ser-
vices to Veronica Knitter as a measles patien�,seven days at $2.50 a day, with the no.
tation thereon that the patient is unable to pay, was read, and on motion by Adler
second by Postier the said sum was appropriated from the General Fund for payment to
St. Mary's Hospital, the City Clerk was instructed to bill the County of Olmsted for
one-half of the said charges and the City Attorney was instructed to collect the othe
half from the person who received the services, all voting in favor thereof except
Alderman Schroeder who voted "Nay".
On motion by Hicks second by Adler the sum of $.45.76 was appropriated

.from the General Fi.ind for payment, to D. Ti. Williams, Postmaster, .for two
treiisand two -cent stamped envelopes for use of the City Clerk.
On motion by Postier second by Hicks the sum of.$60.00 was appropriates
ed from the Street and Alley Fund for payment to'3.4rs. Catherine Fritsch for
compensation for the death of Christopher F. Fritsch during the period
July 23rd, 1926, to August 12th, 1926, and -the sum of 154,00 was appropriat-
ed from the Street and Alley Fund for payment to Fred S. Brown for compensar
Rion for injury during the period July 2.0th, 1926, to August 16th, 1926,
The following claims for cutting weeds were each separately read, and
on motion by Hicks second by Adler the sums mentioned therein were appropri-
ated from the General Fund for payment to the claimants mentioned:

50 cents; ,

al., 11.50;

and gutter on Fifteenth Avenue Southwest, was read, and on motion by Postier
second by Adler it was ordered that the same be placed on file:

Alderman Postier introduced a resolution determining to adhere to the

provisions Of all former resolutions .passed and adopted in the proceedipgs; for the
struction of a combined curb and gutter on a. part of Fifteenth Avenue Southwest,as
ibove described, which was read:
Upon motion by Postier second by Hicks that the said resolution be adop
is read, and,all voting in favor thereof, President Weeks declared the said resolutionl,

Alderman Flicks introduced a resolution accepting the above mentioned pro -I
osal of the Utton Construction Co., Inc., for the construction of combined curb and
utter on a part of Fifteenth Avenue Southwest, and fixing the amount of the bond to be
given by the said contractor at the sum of ,$2000.00, which was read,
Upon motion by Fieks second by Adler that the said resolution be adopted
s read, and all voting in favor thereof, President Weeks declared the said resolution

On motion by Hicks second by Schroeder it was ordered that the certified
heck of the unsuccessful bidder for the construction of the Curb and gutter on a part
of Fifteenth Avenue Southwest be returned to him.
Alderman Adler introduced a resolution appropriating 0264.00 from the
ark Improvement Fund and orderkrig payment made to -John J. Kerr for labor and materials
in the construction of the foundation and floor for the service building at the New
ourist Park, which was read.
Up&n motion by Adler second by Nicks that the said resolution be adopted

Alderman Bach introduced a resolution appropriating $228.60 from the
treet and Alley Fund and orderJL.ngpayment made to Kos Bros. Tire Shop for two 30 x 6

Alderman Hicks introduced a resolution appropriating 1220,00 from the
eneral Fund and ordering payment made to the rriswold Safety Signal. Company, Minneapolis,
innesota, for two bell assemblies at $35.00 - 70.00, invoiced under theft number 538,
nd two rotating cylinders to replace theoold type in "American Bobby", traffic signall,
t $75.00 - A150.00, invoiced under their number 537, which was read.
Upon motion by Hicks second by Adler that the said resolution be adopted
s .read, and all voting in favor thereof, President Weeks declared the said resolution
my passed and adopted.
A1deaman Schroeder introduced the following resolution, which was read:

"Be it resolved by the Common Council of the City of Rochester, Minne-
sota:
Thf,t the sum of 11�254.77 be and the said sum is hereby appropriated`
from the said funds of said City and ordered paid to the T'ruse bumber and
Coal Comna,ny, 14,%227.99 tb.ereof to be from the Street and . Alley Fund for 323
sacks of cement 1.4205.92, and for lumber for use in connection with the con-
struction of sidewalks r-*22.07, and A26.78 thereof from the Permanent Improve-
ment Revolving ]wand for 42 sacks of cement used in connection with the pavin
re -paving and curbing of Second Street Southwest, First Avenue to Third
Avenue.
TheMayor and City Clerk are hereby authorized and directed to draw
a warrant for said sum upon the City Treasurer in accordance herewith, and
cause said payment to be made. "
Upon motion by T;itzman second by Ficks that the said resolution be
adopted as -read, and all voting in favor thereof, President Weeks declared
the said resolution duly passed and adopted.
President Weeks at this time excused Alderman Postier who left the
Council Chambers.
Alderman Schroeder introduced the following resolution, which was
read:
"WHEPFAS, Harold H. Crawford and Louis A. Enke, being the owners of
a.11 of the property abutting on the alley running East and West through the
West half of ?lock 25 in Head and McMahon's Addition have presented their
peti.tfon to the Cor►u..on Council of the City of Rochester, Minnesota, praying
for the vacation of the alley running East and West through the West half
of _Flock 25 in Head and McMahon's Addition, commencing at the West line of
said Block and running thence Fast to the West line of the alley running
North and South through said Block, and
iNIHFRFAS, it is deemed expedient that the matter shall be proceeded
with;
SO THEREFORE,, Be it resolved by the Common Council of the City of
Rochester, Minnesota:
That the said petition be :filed of .record with the City Clerk of said
City, and that the Common Council of said City will hear and consider the
same in the Council Chambers, in the City Hall., in said City, on Monday the
4th day of Octotzer.', A. D. 1926, at 2 o'clock", -P.M.) and that the City Clerk
of said City be and he is hereby ordered and directed to give notice thereof
as required by the Charter of said'City. "
Upon motion by Adler second by Schroeder that the said resolution be
adopted as read, and all voting in favor thereof, President Weeks declared
the said resolution duly passed and adopted.
A_ resolution introduced by Alderman Postier., prior to his being excus-
ed, ordering plans, profiles, specifications and estimate of cost for the
construction of a sanitary sewer in Seventh Street Northwest, commencing at
the center of the intersection of Seventh Street Northwest and Sixth Avenue
Northwest and running Northwesterly along the center line of Seventh Street
?Northwest to 6• point 792 feet East of the East line of Eleventh Avenue,
Northwest, was read.
Upon motion by Nicks second by Adler that the said resolution be
adopted as``iead, and all voting in favor thereof, President Weeks declared

Chas. H. Armstrong, City Engineer, submitted plans, profiles, speci-
fications and estimate of cost for the above described sanitary sewer 14 part of
Seventh Street Northwest, which were considered by the Common Council, the said esti-
gate of cost being $2343.01.

Alderman Postier returned to the Council Chambers and attain took his

plans, profiles and specifications for the construction of a sanitary sewer in part
of Seventh Street Northwest,as above described, ordering that the same be placed on
File in the office of the City Clerk, ordering that the said estimate of cost be plac-
6d on file in the office of the City Clerk and ordering that the said improvement be
made and done by special assessments levied as provided by law, ordering notice of
public hearing thereon for 7:30 o'clock P.M., August 30th, 19269 and ordering adver-
td.sement for bids to be opened at 7:30 o'clock P.M., August 30th, 1926, which was read

as read, and all voting in favor thereof, President Weeks declared the.said resolution,

president Weeks at this time excused Alderman Adler who left the Council
Chambers.
The following claims were read, and on motion by Kitzman second by Hicks
the same were allowed and the Mayor and City Clerk were authorized and directed to
(draw warrants upon the City Treasurer and make payment accordingly:

On motion by Postier second by Hicks the City Engineer was instructed to
Put City water into the local Sewage Disposal.Plant for a test of the tanks,
pumps, etc., and on motion by Postier second by Hicks the City Engineer was
Instructed to secure the necessary labor, materials, etc., and replank the
City Scales,
On motion by Bach second by Schroeder the City Weighmaster,.0. E.
McCoy, was granted a ten days vacation with pay, to be taken sometime within
the next four weeks.
The recommendation of the Lighting Committee that a street light be
installed at the intersection of Sixth Street Northwest and Third Avenue
Northwest, was read, and on motion by Bach second by Schroeder it was order-
ed that the same be placed on file, and that the City Clerk bequest of the
Public utility Board that installation be made accordingly.
On motion by Bach second by Kitzman Council adjourned to August 39th,
1026, at 7:30 o'clock P.M.
