Minutes of an adjourned Regular Meeting of the Common Council of the
lCity. of Rochester, Minnesota, held in the Council Chambers in the City Hall in said
City on September ;D7th, 1926,at 7:30 o'clock P. M.
Meeting called to order by President Weeks.
Roll Call: Present: Weeks, Adler, Bach, hicks, Postier, Schroeder.
(Absent: Kitzman.
On motion by Hicks second by Bach the minutes of the meetings held on
(September 13th, 1926,and September 14th, 19216, were each approved.
Public hearing was held on the re -surfacing of the paving base of
IFov.irth Street Southeast between the East line of Broadway Street South and the East
line of Third Avenue Southeast, and Frank Stoppel and J. A. Lawler opposed this
proposed improvement„
Alderman Kitzman came inat this time and took his Chair,
Alderman Postier introduced a. resolution ordering plans profiles,
specifications and estimated cost for the above mentioned proposed improvement,,
1whieh was read, but no action was taken thereon as no one moved its adoption,
On motion by Postier second by Adler the City Engineer was instructed
to send his plans, profile;; and specifications for the above described proposed
improvement to the State Highway Department, for their approval and that he ask for
their assurP,nce that the: Highway Department will pay for the cost of the c(,nter
eiJl,teen foot strip in this project.
Public hearing; was held on the levying of special assessments for the
cost of the. .following described local public improverrimts; there being no person
present who wished to be heard in regard to either or any ofthem:
That the paving of Third Street Southeast from the East line of
Broadw-,iy Street. South to the Mill. of the Rochester Milling Company be widened to
tl,,e width of tfth (50) feet by the pavin ; with 6" one course concrete of a strip
5 ft. in widt'_Z Jonrc each side of the present, pavi.n on the said part of Third Street
Southeast, and that aacement concrete curb be constructed along both sides of the
paving so widened and that the intersecting streets be paved and curbed to the curb
line;
That the paving; of Third Street Southwest from the West line of First
Avenue Southwest to the East line of -third Avenue Southwest be widened by the paving
with 6" one course concrete of a strip 11-` ft. in width along each side of the pres-
ent paving, on the said part of Third Street Southwest, and that a cement concrete cu
be constructed along each side of the pa•,ink* so widened, which said strip shall in-
cline upward from the present mitter line to the curb, and t1le intersecting

That the paving; of First Avenue Southwest from the center line of

H. P,-Whiting made oral remonstrance against the license of H, Lip -
Junk dealer and bi-bught to the Common Council a remonstrRn.ce

signed by many residents of the north past of tre City, which was rend; the said
remonstrance was opposing the condu.eting of such a business in that neir;hbcrhood.
On. motion by Hicks second by Postier the junk dealers license of
u .t.ipsch.itz was .revoke, and the Mayor and.. City Clerk_ wc;re authorized and directed
to draw warrant from the general F d pn the City Treasurer for the refundmen t, to
him of t':e unearned portion of th �s d junk dealers license.
Mayor Lemmon reported that the old automobiles) etc., which have been
stored and placed by Max Shapiro on hisproperty at Fifth Street Northwest and
Plinth Avenue Northwest has been called a nusiance for that part ofthe City; Harold
Akenread reporting that the garage busineds conducted by S. A. Welch on Fifth
Street Northwest is objectionable to that locality and Alderman Postier also men-
tioned that the premises of W. H. Watson were receiving adverse comment there, and
on motion by Postier second by Schroeder the City Attorney was instructed to take
proceedings for the abatement of the conditions at, these locations.

The petition of Arnold Bjerririg, Susie Graham and C.G. Roesler asking,
for -('.he vacation of Eighth Street Southwest between Seventh Avenue Southwest
and Eighth Avenue Southwest,was read, and. on motion. by TTAcks second by
Schroeder it war, referred back to them for correction in that it was not
accompanied by a plat of the part of Eighth Street Southwest concerned. and that
it was not veri.f.ied by the oath of at least two of the petitioners.
The following communication was read and on motion by Bach second
by Adler the employment of the persons mentioned therein was approved:

All work pertaining to our contract for the erection of the Sewage Dis-
posal Plant for the City of Rochester was completed Septeriicer 6th and our
contract provides that final inspection be me.de on completion of work.
We presume th
at owing to the fact the sewer connections are not as yet
completed it is impossible to make a test of, the machinery and equipment, butj
we feel that this should not in any way affect our. contract,
We have no objection to the City withholding a portion of the balance
' due us until this test hao been made, but we certainly do not expect to assume
any expense in taking care of this building anylonger, nor do we intend to i
be held responsible for any damage which may occur to the building, machinery;
or premises from this date on. We have kept a night watchman on the premises
since the 6th of September, but we feel that we bhould not be required to
assume this expense.

favor of 0. Schwartz & Company for the construction. of the local Sewage
Disposal plant,showing the sum of $32,578.30as being due the said contractors
as final e.-timate and a recommended adjustment payment of %05.42, was read
and on'motionby Hicks second by Schroeder it was ordered that the samb�be
Placed on file; as was certificate made by Chas. H. Armstrong, City Engineer,
in favor of the said contractors showing the stun of 03,055.15 as being due
the said contractors for extra labor and materials furnished in the construc-

Alderman Adler introduced the following reablution:which was read:

Minnesota:
That the sureties on the City Depository Bonds of the Union
Nati.onnI Bank of Rochester, Minnesota, for double the sum of

be and the said sureties cn the said i_;onds are hereby accepted and
the sRij bonds are hereby approved and ordered placed on file in the
office of the City Clerk of said City; s airl bonds being silbmitted,
accepted, approved and ordered filed under and in accordance with
the proposal of the said Union Yational hank dated Septe-amber 13th,
192G, �,nd the desinati_on t.��* this Common Council under date of
September 13th, 1926, of the said Union ?rational Bank as a City
Depository, with the wholethereof to be governed by Sections 47 to
54, inclusive, of t',,e Charter of the sal-d City, and such other sec-

relative to City Depositories.
Be it further re -solved by the said Common. Council: That, the
City Treasurer shall, subject to the above mentioned sections or

account at an interest rate of two (2) percent per annum, as pro-

Upon motion by Kitzman second by Postier that the said resolution
be adopted as read and all voting in favor thereof, President Weeks declared the
said resolution duly passed and adopted.
Alderman Schroeder in the following resolution which was
read:
"Be, it resolved by the Common Council of the City of Rochester,
Minnesota:
That the sureties on the City- Depository Bonds of the Olmsted
County Bank and Trust Company of Rochester, Minnesota, for double the siim of
1132750.00) dated September 14th.2 19? , and September ?1st, 1926, be and the
said sureties on the 'sal-d bonds are hereby accepted and the said bonds
are hereby approved n�nd ordered placed on. file in. the, office of the City
Clerk of. said City; sold bonds bel.ny submitted, accepted, approved and
ordered filed under and i.n accordance with the proposal of the said Bank
and Trust Company dated September 13th, 1926, and the desi,ma,tion by this
Common Council under date of September 13th, 1026, of the said Bank anal Truct
Company as a Cit;r Depository, with the wholethereof to be governed. by Sec-
tions 47 to 54, inclusive, of the Charter of the 4 a.id City, and such other

Be it farther resolved by the said Common Council: 'That the

Upon motion by Adler second by Schroeder that the said. resolution
be adopted as read and all voting in favor thereof, President Weeks declared
the said resolution duly passed and adopted.
Alderman Dicks introduced the following resolution which was read:

an interest rate of two (2) percent per annum; as provided for in the
