W.deks, Adler, Bach, Hicks, Kitzman, Postier, Schroeder: Absent; None, On mot -ton by Hach second by Hicks the minutes of the meeting held on September 2-7th, 1926, were approved. Public hearing was held on the petition of. Harold H. Crawford and ; Louis A. Enke for the vacation of the alley running east and West through the West one half of i,lod,k 25 in Head and. McMahon's Addition, and Mr. Crawford and Mr, Enke were Moth before the Common Council with a request for favorable action on their petition, This being the time and place fixed_ for adjourned --and continued hearin; and. action or.. the 7_evying of special. assessments for the following described local public improvements, public hearing was held on each and all of them: That the paving of Third -Street Southeast fromthe Fast line of Broadway Street South to the Mill of the Rochester Milling Company be widened to th.E width of fifty (50) , feet by the paving with 6" one course concrete of a. strip 5 ft. in 1:vidth along each side of the present paving i on the said part of Third Street Southeast, and th:l,t a cement, concrete curb be constructed along Toth sides of the paving, so widened and that 4 the intersecting streets be paved and curbed to the curb line; That the paving, of Third Street Sout,hvest from the West line of s r First Avenue Southwest to the East lin,, of Third Avenue Southwest be widened by the paving wtth 6" one course concrete of .-? strip 112 ft-, in i width alone each side of the present paving on the said part of Third Street Southwest, and that a cement concrete curb be constructed along each sj.de of the paving so widened which said strip shall incline upward � P P from the present ;;utter line to the curb, and that the intersecting avenues be paved and curbed to the curb line;, - That the paving of First Avenue Southwest from the center line of . I There were no persons present, who wished to be heard reletive to either or any of the above described improvements, Under arrangements for a joint meeting made by this,Common Council at thet:-meeting 'thereof held on September 27th, 1926, relative to the Kiester offer to sell the buildings on and lots 5 and 6 in Flock 50 in Original Plat to this. City for $7500.00, the members of the Public Utility Board and the Superintendent of the Electric Light plant were present and in the discussion of the above mentioned offer, Wm, G. Roeder, as !'resident of the Public Utility Bbard, gave the informa- tion that his board is unanimou&ly in favor of allowing the Commissioner's npprais- ment, as amended by the Common Council, to stand,and abide by the result of Mr. KiestEer's appeal to the District Court, and during the consideration of this matter Mr. Roeder said that in so long as the Public Utility Department are not in irinredi- ate need for the space where the buildings stand,it is their intention to offer them to Mr, Kiester at a rental of $1.00 per month from the date of the confirma- tion of the award to such date as the additional space is actually needed. On motion by Kitzman second by Dicks it was agreed that a jury* of the District Court shall decide the aws.rri for the buildings on and the lands known a -- lots 5 and 6 in Block 50 in 0^iginal Plat, orm.ed by Henry W. Kiester and Mary F. Kiester, his wife. Superintendent Cowles, Superintendent of the local electric light plant, for the Public Utility Board, :_-abmitted a request that 138022.74 be included in the 1926 tax levy for lighting of public streets,.buildings hnd grounds; f to be for :street lit,htinr, and �,7874.88 thereof to be for Sighting and power at the sewage disposal pl.a,nt, and on motion by Postier second by Schroeder it was ordered that the said request be placed on file. Schwartz and Company as the sum recommended to' be paid by Chas. H. Armstrong, City Engineer., as set forth on final estimate for the construction.of the loc Sewage Disposal Plant, which adjustment arises through the contractor claim - in 1596.04 as extra work fpr ,the construction of the 20" venturi meter pit while the engineers claim a contract price should govern, which contract price would accrue to the contractor $395.20 for.21.4 cult yds. of class B concrete @ 118.00 per yd., thus Making a difference of P210.E4, one-half of which, ;105.42,.:t1iis hereby proposes to pay as an adjustment. President Weeks declared the said resolution duly passed and adopted; Alderman Adler introduced a resolution fixing 7:30 o'clock P.M,, October lSth, 1926s as the time for -A,, hearing on and the levying of special assessments for the Northeast intercepting seni;:ary sewer, also - known as the State Hospital outlet sanitary sewer, and for the Broadway Street North Trunk line sanitary sewer, which was read, • Upon motIon by Postier second by Hickethat the said resolution be adopted as read and all voting in favor thereof, President Weeks declared the said resolution duly Passed and adopted, -- Alderman Adler introduced the following resolution,which was read: "WHEREAS, the Ci4ty of Rochester, Minnesota, heretofore entered into contract for the construction and making of the following described local public improvements, in said City, the cost'and expense of which said public improvements shall be paid for by special assess- ments levied in the manner provided by law, to -wit: That the paving of Third Street Southwest from the.West lire of Broadway Street South to the Fast line of First Avenue Southwest be •widened to a width of 50 feet, by the paving with 3" vertical fibre out vitrified clay or shale, non -repressed and especially burned for street Paving, brick, of a strip 5 feet in width along each side of the present Paving of the said part of Third Street Southwest, and that a cement concrete curb be constructed along each side of the pe.ving so widened and that the intersecting street and avenue be paved and curbed to the curb line. That the paving of First Avenue Southwest between the South line of Second Street Southwest and the Center line of Fourth Street South- west be widened to a width of 60 feet ty the paving with 3" vertical fibre cut vitrified clay or shale, non -repressed and especially burned for street paving, brick,of a strip 10.feet in width along each side of the present paving onthe said part of First Avenue Southwest, which said strip shall incline upward from the present gutter line to a 4" curb, and that a. cement concretecurb be constructed along both sides of the said paving o widened, and that the:interbecting str.et be paved and curbed to the curb line; the present paving -or approaches to the property, where now paved with brick or concrete, not to be dis- turbed except for necessary= repairs* That Second Avenue oVhwest,from the South line of Third Street.
