City of Rochester, Minnesota, held in the Council Chambers, in the City Hall, in said City, on October lgth, 19262 at 7:30 o'clock P. IA. Meeting called to order by President Weeks. Roll call: Present:, Weeks, Adler, Bach, Ricks, Kitzman, Postier, Schroeder. Absent: Alone. Public hearing was held on the petition for the vacation of Seventh Street Southwest between the West line of Eighth Avenue Southwest and the East line of Ninth Avenue Southwest; C. E. Knowlton, Dr. H. S. Plummer, Dr. H. M. Connor, Dr. E. C. Kendall, and Dr. Kieth talking in favor of the vacation of the said part of Seventh Street Southwest, which was supported by petitions from various residents of the locality concerned, which were read, as was the follow- ing communication: 0 To the Common Council, Rochester, Minnesota . "Rochester, Minnesota Oct. 19th, 1926 Wherehs the Board of Directors of the Olmsted County Business Men's Association have had under advisement the closing of certain .streets in the city of Rochester and that through this Association wish to offer objection to the closing of any street in Rochester in general. Pertaining to the petition before you at the present time for vacating the one block in Seventh Street Southwest, the Board wished to suggest to the City Council that this particular block be cleaned up and put in respectable condition as it appears to be more or less an eyesore in its present state, or thht the road be properly outlined and graded through this particular. block. Olmsted County Business Men's Association, By C. F. Dabelstein." Alderman Postier introdueea the following resolution,which was read: "WHEREAS: E. C. Kendall,*H. M. Conner and Frank Fryer, owners of ;the abutting property, did on July 26, 1926, present to the Common Council of the City -of Rochester, Minnesota, a duly verified petition asking said Common Council to vaca-'Ce Seventh Street Southwest (formerly High Street) between the West line of Eighth Avenue Southwest (formerly 4, onroe Street a-L d the East line of Ninth Avenue Southwest (formerly State Street), with a plat thereof attached and Made a part of the said petition, and said Common Council at a duly held meeting of the said Common Council, in the Council Chambers, in the City Hall, in said City at 7:30 o'clock P. TvIT., on September 7th,,1926, did duly con- sider the said petition and the facts and reasons set forth therein, and the.whole thereof, and than and there duly adopted a resolution deeming said matter and vacatign gxpedient,- and that the matter and prayer of the said petition be proceeded with, and did then and there ,by said resolution order that,the.said petition be filed of record with the City Clerk of said City, and that he give notice in the official: newspaper of said City for four weeks, at least once in each week, to the effect that the said petition had been filed in his office and state in brief its object and that the said petition would be heard and considered by the said Common Council, at the Council Chambers, in thc: City Hall, in said City at 7:30 o'clock P. Upon motion by Postier second by Adler that the said resolution be adopted as read and all voting,in favor thereof, President Weeks declared the said resolution duly passed and adopted. ' It was announced that this was .the time and place fixed for hearing on ,the confirmation of the sprinkling assessment s for -the year • 1926 a which were levied by this Common Gouncil. It was announced that this was the time and place fixed for hearing on the levying of special assessments for the cost and expense of the repairing of side- walks and President Weeks asked If there was any person who wished to be heard, There was no person present who wished to be heard relative to the levy- ing of special assessments for the repair of sidewalks and the City Clerk_ reported that there had been no written objections thereto, received. It was announced that this was the time and place for hearing on the levying of -special assessments for the following described local public improvements, and President Weeks asked if there was any person present who wished to be heard relative to either or any of the said local public improvements: That the pa%--ing of Third Street Southwest from the West line of Broadway Street South to -the east line of First Avenue Southwest be widened to a width of 50 feet, by the paving with 3" vertical fibre cut vitrified clay or shale, non -repressed and especially burned for street paving, brick, of a strip 5 feet in width along each side of the present paving on'the said part of Third Street Southwest, and that a cement concrete curb be constructed alon.r-.; each side of the paving so widened and that the intersecting street and avenue be paved and curbed to the curb 1 ine ; That the paving of First Avenue Southwest between the South line of Second Street Southwest and the Center line of Fourth Street Southwest be widened to a width of 60 feet by the paving with 3" vertical fibre cut vitrified clay or shale, --on -repressed and especially burned for street paving, brick, of a strip 10 feet in width along each side of the present paving on the said part of First Avenue Southwest, which said strip shall incline upward from the present gutter line to a.4" curb, and that a cement concrete curb be constructed along both sides of the said pavan;:; so widened, and that the intersecting streets be paved and curbed to the curb line; the present paling or approaches to the property, where now paved with brick or concrete, not to be disturbed except for necessary repairs. Sixteenth 240 L Avenue Southeast and running Easterly along the center line of Second Street Southeast to a point 5 feet East of the West line of Lot No. 1 In Sanderson's Second Addition; The construction of a sanitary sewer in Eighth Place Northwest Commencing at the center of the intersection of Eighth Place Northwest and Second Street Northwest and running Northerly along the Center line of Eighth Place Northwest to a point 5 feet North of the South line of Lot 6 in Block 24 in Cummings' Addition; `)The construction of a sanitary sewer in Seventh Street Southwest commencing at a point 5 feet West of the East line of Lot 1 in Block 6 in Head and McMahon's Addition, and running Easterly along the center of Seventh Street Southwest to the center of the intersection of Fourth Avenue Southwest and Seventh Street Southwest; The construction of a_sanitary sewer in Seventh Street Northwest commencing at the center of the intersection of Seventh Street Northwest and Sixth Avenue Northwest and running Northwesterly along the center line of Seventh Street Northwest to a point 792 feet East of the East line of leventh Avenue Northwest; The grading to an established grade line and to a width of 66 feet of Fifteenth Avenue Southwest, between the South line of Second Street outhwest and the South line of Fifth Street Southwest; , The grading to an established grade line and to.a width of fifty 50)-feet of that part of Eleventh Avenue Southeast from the South line f Fourth Street Southeast to the North line of Fifth Street Southwest; On motion by Hicks second by Tritzman the City Attorney was instructed to such evidence as he can in connection with the Fred Lind injury case, and get the approximate cost of ala appeal to the Supreme Court of the Industrial Commission's decision in the matter.. The reports of the ' ; Clerk of the .Municipal Court for the week_ ending October 4th, 1916, showing criminal fines collected in the amount of $80.10, civil fees received in. the amount of n'2.00, 01.7,90 court costs charged to Olmsted County and <11.85 fines collected due to Olmsted County, for the yveek ending October llth, 1926, Showing criminal fines collected, 328.00, civil fees received in the amount of',2.35,and -16.70 court costs charged to Olmsted County, and for the week ending October 18th, 1926, show- ing criminal fines collected-$282,00, civil fees. received in the amount of `9.00, ''23.70 court costs charged to Olmsted County and $96.25 fines dol- lected due to Olmsted County, were each separately•read, and President Weeks ordered that the same be referred to the City Attorney. ' On motion by Bach second by Hicks the sum of$108.10 was approprdated from the General Fund and it was ordered that the same be paid to Olmsted County for the abo--,;-e mentioned fi::.es. collected due to the said Counter. The applications of the Whitlock -Sonnenberg.' Post No.1215,Veterans of Foreign Wars, for public dance permit at the Armory, October'30th, 1926, and of the Rainbow Club for public dance permit at the Woodman Hall, Oc- tober 19th, 1926, and of the Elks' Drum Corps for public dance permit at the Armory, October 23rd, 1926, were each separatdly read; The application of Company C, 205th Infantry, Minnesota National guard, for license to conduct a roller skating rin* in the building known s the NatAonal Guard Armory,•for one month beginning October 31st, 1926, as read. ' I On motion by.Hicks second by Postier, license was granted at a fee of �1025.00 for the period mentioned. The applications,of the Motor Inn Garage and of 14. F. Doty for permits Ito place and maintain signs were each separately read..and on motion by Postier 1Isecond by Hicks, permits were granted. The application of Bemel Brothers for junk dealer's license was read Iland on motion by Postier second by Bach, license was granted. The Junk Dealers License Bond of.Bemel Brothers, with the American 11Surety Company of New York as surety thereon in the amount of $1000.00, was read, gland on motion by Bach second by Adler the said surety was accepted and said bond was approved and it was ordered that the same be placed on file. The -application of A. H. Foster, doing business as Foster Electric Comprany,for an eleetriotan's license was read and on motion by Hicks second by JBach, license was granted. ThO ElectridiaAls License Bond of A. H. Foster, doing business as Foster Electric Company, with A. R. Naehreiner, and Karl B. Kjerner as sureties thereon, each in the amount of 111000.00,was read and on motion by Bach second by Dicks the said su,eti�s were accepted, the said bond was approved and it was ordered that the same -be placed on file. A petition asking that street lights be installed at the intersection of Fourth Avenue Southeast and Ninth Street Southeast and at the intersection,of Fourth Street Southeast and Tenth Street Southeast, was read and on motion by Postier second by Hicks it was referred to the Lighting Committee. The following resignation was read and President Weeks ordered that the same be placed on file: "October 16th, 1926, Mr. A. F. Wright, City Clerk, Rochester, Minn. Dear Sir: Please accept my resignation as stenographer in your office, effective today, the 16-15h of October, 1926. Respectfully, Mary V..Porter." The appointment by the Mayor of JaMea O'Conner as a Special Patrolman for the period October 16th, 1926,to October 24th, 1926, inclusive, was read and President Weeks ordered that the same be placed on file. I desire to ask the Council before acting on the project of a municipal golf course to inspect "Fair Oaks", my country place, adjoining the corporate limits. This place has been pronounced by e .perts as being an ideal place for a golf course. It consists of 170 acres • it has 140,000 worth of buildings and improvements, and commands the ay:> most beautiful view in this part of the country. Alderman Adler introduced a resolution confirming the sprinkling assessments for the year 1926,,.-as levied October llth, 1926, which was read. Upon motion by Bach second.by Adler that the said resolution 'oe adopted as read and all voting ir} favor thereof, President Weeks declared the saaid resolution duly passed and adopted. .._ 246 11 'Alderman Kitzman introduced a resolution accepting combined concrete curb end gutter constructed on -Fifteenth 'Avenue' Southwest from Second Street, Southwest to Fifth -.:Street Southwest, as being completed according to --contract by the Utton Construction Company, Inc., which was read. Upon motion by Adler second by Bach that the said resolution be adopted as read and all voting in favor thereof, President Weeks declared the said resolution duly passed and adopted, Alderman Hicks introduced a resolution accepting the sanitary sewer cutover`in Thirteenth Street Northeast a:; being completed according to contract made with Wm. C. Fraser and Son, which was read, Upon motion by Hicks second•by Bach that the said resolution be adopted as read end all voting in favor thereof, President Weeks declared the said resolution -duly passed and adopted, Alderman Adler introduced a resolution accepting the sidewalk on the East side of the bridge over Cascade Creek on Eighth Avenue Alorth- est as being completed according to contract made with Feller Brothers, hich was read. Alderman Hicks introduced a resolution appropriating `"3792.81 from he Sewer Fund and ordering payment made to Wm. C. Fraser and Son for anal estimate on contract for the construction of sanitary -sewer cutover n Thirteenth Street Northeast, which was read. Upon motion by Adler second by Bach that -the said resolution be dopted as Diead and all voting in favor thereof, President Weeks declared , he said respolution duly passed and adopted, 0 Alderman Bach introduced a resolution appropriating 1485.00 from the General Fund and ordering payment made to Griswold Safety Signal Company of Mitfne- apolis, Minnesota, for two "Slow" signals com»lete and for one bell for No. 3 traffic,regulator, in accordance with their invoice dated June 1st, 19263, which wp•s read. Upon motion by Bach second by Adler that the said resolution be adopted as reed and all voting in favor thereof, President Weeks declared the said resolution duly passed and adopted. Alderman Bach introduced a resolution appropriating $794.00 from the Bridge Fund and order payment made to Feller Brothers for the construction of a sidewalk on the East side of the bridge over Cascade Creek on Eighth Avenue Northwest, which was read. Upon motion by Bach second by Schroeder that the said resolution be adopted as read and all voting in favor thereof, President Weeks declared the said, resolution duly passed and adopted. Alderman Kitzman introduced a resolution appropriating `*1101.60 from the Permanu-rt Improvement Re olving Fund and ordering payment made to Utton Construction Company, Inc., for the construction of combined concrete curb and gutter on Fifteenth Avenue SoutIvibst from Second Street to Fifth Street, which was read,. Upon motion by Sehroeder,seeond by Kitzman that the said resolution be adopted as read and all voting in favor thereof, President Weeks declared the said resolution duly passed and adopted. Alderman Kitzman introduced a resolution appropriating ,�p610.80 :from the Park Improvement Fund and ordered payment made to G. Schwartz ?- Company for truck time for hauling fill to Tourist Park in accordance with their invoice dated October 7th, 1926. Upon motion by Kitzman second by Adler that the said resolution be adopted as read and all troting in favor thereof, President Weeks declared the said resolution duly passed and'adopted.
