M. Meeting called to order by President Weeks. S Poll Call: Present: Weeks, Bach, Nicks, Vitzman, Postier, Schroeder. Absent: .Adler. On motion by Schroeder, second by Postier the minutes of the meetings held bn November 29th, 1926, December 6th, 1926, December Sth, 19?:=,, and December loth, 1926, were each approved. This being the time and place fixed for the opening of proposals for the purchase of -28,000.00, City'of Rochester, °Rinneso1i,a, 42 per cent Permanent Improvement -Revolving Fund Bonds, the followinT'proposals were opened and read; Sinking Fund Co:umission, City of 'Rochester, Minnesota; par, accrued interest and a prei:iiiu:'_: of q,�,4.53,60; -Ilorthwestern< Trust•. Upon motion by Kitzman second by Hicks that thu said resolution be adopted as read and all voting in favor thereof, President Weeks declared the said resolution duly passed and adopted, Alderman Schroeder introduced the following resolution, which was read: "Be it resolved by the Common Council of the City of Rochester, Minnesota: That the sum of'$146.27 be .and the said sum is hereby appropriated from the General Fund of said City and ordered paid to J. T. Lemmon, Mayor, for use in his Mayor's Contingent Fuad; it being specifically orderbd And agreed upon that he shall at the end of this fiscal year make report to this Common Council of his disbursements thereof. 326 The Mayor -and City Clerk are hereby authorized ana directed to draw a warrant for said sum upon the City Treasurer in aeeordance..herewith, and cause said payment to be made,,". Alderman Schroeder introduced a resolution appropriating $1995.36 from the Musical EntertainMen t Fund and ordering payment made to A. J., Lentfer, Treasurer of the Rocheste8 Park'Band,for furnishing free musical entertainment to the general public, the same being the amount collected for that purpose in the November, 1926, tax settlement, which was.read. Upon motion by Schroeder, second by Postier, that -the said resolution be adopted as read ,and all voting in' favor thereof, President Weeks declared the said resolution duly passed and adopted. Alderman Schroeder introduced a resolution appropriating $4664;22 from the General Fund and ordering payment made to the Permanent Improve- ment Revolving Fund for to apply on deficit in the said Revolving Fund, the same being the:.smount collected for that purpose in the November, 19261,tax settlement, which was. read. Upon motion by Hicks second by Schroeder that the said resolution be adopted as read and;;all voting in favor thereof, President Weeks declared the said resolution duly passed and adopted. Alderman Postier introduced the following resolution, which was read; "WHEREAS, the. Common Council of the City of Rochester, Minnesota, being cognizant of the fact that there- is a loss 'in interest through. the collection of special assessments,.under existing State Laws, and WHEREASz there is no remedy thgt: will eliminate :this loss except the amendment of the present State Laws relative to the collection of real estate taxes. SO THEREFORE Be it resolved by the C orm►oncC ounc i l of the City of Rochester, Minnesota; That the said Common- Council does hereby. respeotfully request of. the Legislature of the State of Minnesota at the Forty-fifth ,Session thereof, that Section 2104 of the General Statutes: of Minnesota for the year 1923, which at present reads ad follows:. "On June 1 of •each year a penalty of fire per cent shall accrue and thereafter: be charged upon all unpaid taxes on real estate on the current lists in the hands of the Sounty treasurer, and .thereafter on the first day of each month, up, to and including Xovember 1 following, an additional penalty of.one per cent for eadh month shall,.accrue And be charged on all such unpaid taxes, and any County treasurer who shall make out and deliver or countersign any receipt for such taxes without including such penalty therein shall be - liable to the county for the amount of such, penalty; . Upon motion by Bach second by Adler, the Street and Alley Committee and the City Engineer were instructed to confer with H. E. Chard, District Superin- tendent of Highway Maintenance, relative to the rental of a ca Mpiller tractor with a scarifier and `planer attachment for use in smoothing the ruts inthe local streets and if satisfactory arrangellents can be made they shall proceed accordingly. The following report was read and President Weeks ordered that the same be placed on file: " Rochester, Minnesota. December 27th,1926; Honorable Common Council; City of Rochester,. Minnesota. Geb tler4en: The matter of the claim against C. W. Schruth for repairs to paving on Second Street Southwest having been referred to me, I beg to report as follows: I have written to bdih Schruth and the bonding c ompany. onthis, 'job, but to date have not received a reply..VIt has been reported to me that Mr. Schruth is not..in the, State, ,end,.is not at present in business. No doubt the bonding company has the matter under consideration, brit I _have' not:been informed as to' the position which they take regarding the matter -of his default; Since this is also properly a charge for'msintenance of a State Trunk Highway, I suggest -that the State Department be billed for the repairs, whiibh action might assist in brir4ng matters to a head with the bonding company. Alderman Postier introduced a resolution granting -public dance permit to the Wm. T. McCoy Post No.92, American. Legion, to,hold,give and conduct a public dance in the National Guard!Armory, December 31st, 1926, and fixing the fee at the sum of $5.00, which was read; Upon motion by Postier second by Hicks that the said resolution be adopted as read and all voting in favor thereof, President Weeks declared the said resolution duly passed and adopted, Alderman Schroeder introduced, a -resollution granting public dance ermi't to the Zumbro Chapter Order of Deltolay, to hold, give -and conduct public dance in the Masonic Temple .-on December 30th, 1926,, and fixing he fee at $5.00', which was read,;' Upon motion by Schroeder second by Hicks that the said res olutiontbe: Ak. dopted as read and all voting infavor thereof, President Weeks declared the ' aid resolution duly passed and adopted, a Alderman Postier introduced an ordinance to prohibit personal operating or driving vehicles over and across grade railroad crossings in the Qity of Rochester'afte'r the watchman on duty at such crossing has raised the "STOP" sign, which was given its first reading, On motion by Schroeder second by Hicks the 'rules were suspended and , the said ordinance was given its second reading. On motion by Bach second by Adler the rules were suspended and the • said ordinanee,was given its third and final reading. Upon motion by Bach second by Hicks that the said ordlance be adopted as read and all ivoting in favor thereof, President Weeks declared the said ordinance duly passed and adopted, On motion by Bach second by Schroeder the sum of $54.00 was appropriatec from the Street and Alley Fund and it was ordered that th:: same be paid to Fred S . Brown for compensation f or•indury during the period December 7th, 1926, to December 27th, 1926, inclusive, and the sum of $60,06 was appropriated from the General Fund and it was ordered that the same be paid to Mrs. Catherine Fritsch .as -.
