Minutes of a regular meeting of the Common Council of the City of Rochester, Minnesota, held in the Council Chambers, in the City Hall, in said City on August! 6th,1928r at 2: 00 o'clock P.M. Meeting called to order by President Liddle. Roll Call. Present: Liddle, Erickson, Hicks, Lemmon, Miller, Rommel, Schroeder. Absent: None, fji President Liddle at this time excused Alderman Schroeder, who left the Council Chambers. Upon motion by Rommel, second by Erickson, the minutes of the meeting held on July 23rd, 19289 were approved. yi President Liddle announced this was the time and placed fixed for E a hearing on the construction of curb and gutter on and the grading of First Street Southeast, between the East line of Eighth Avenue Southeast, and the West line of Eleventh Avenue Southeast, and asked if there was any person present who wished to be heard regarding the said improvements. There was no person present who wished to be heard. t President Liddle announced this was the time add place fixed for a hearing on the construction of a sanitary sewer in Broadway Street South, from the center of the intersection of Fourth Street Southwest and Southeast to a point 675 feet South, and a4ed if there was any person present who wished to be heard relative to the said improvement, There was no person present who wished to be heard concerning he said improvement. r President Liddle announced this was the time and placed fixed for hearing on the construction of curb and gutter on and Ighe grading of eventh Street Southwest, between the West line of Fourth Avenue Southwest and the East line of Fifth Avenue Southwest, and asked if there was any 31 ,erson present who wished to be heard regarding the said improvements. President Liddle announced this as being the time and place fixed for a a - hearing on the construction of curb and gutter on and the grading of Seventh Avenue Southwest, between the South line of Sixth Street Southwest, and the North line of Ninth Street Southwest, and asked if there was any person present who wished to be heard regarding the said improvements,, Newton Holland, for himself and Mrs. Olin, opposed this improvement as did Mrs. Susie Graham, while Harry Hanson requested that the improvement be extended to between Ninth Street Southwest and llth Street Southwest, President Liddle announced this as being the time and place fixed for a hearing on the construction of curb and gutter on and the grading of Thirteenth Avenue Northwest, between 134 feet North of the North line of Second Street North- west and the North line of First Street Northwest, and asked if there was any person present who wished to be heard concerning the said improvements. There was no person present who wished to be heard relative to th-- said curb and gutter or grading. President Liddle announced this as being the time and place fixed for a hearing on the opening of an alley in Block 6 in Kutzky's Addition, and asked if there was any person present who wished to be heard. There was no person present who wished to be heard regardin6 the said alley opening. 344 filll iiq I z A motion by Erickson, second by Rommel, carried that dire to an error in the description, the proceedings for the opening of the alley bbove,mentioned, be abandoned and that a new hearing be had under the proper description. President Liddle announced this as being the time and place fixed for a hearing on the petition for the vacation of the alley running North and South between Lots45 and 101 in Belmont Addition, and asked if there was any person present who wished to be heard. There was no person present who wished to be heard relative to the vacation of the alley above described. President Liddle announced this as being the time and place fixed for a hearing on the construction of a sanitary sewer in Third Avenue Southwest, commencing 95 feet South of the South line of Sixth Street SouthweO and running Southerly and Southwesterly to the diversion manhole at the Sewage Lift Station, and asked if there was any person present who wished to be heard. ' There was no person present who wished to be heard relative to the r said sanitary sewer, but a remonstrance agaiAst the construction of it was read, and President Liddle ordered the same placed on file. Alderman Schroeder returned to the Council Chambers and again took his Chair. Pursuant to ladjournment of action on the grading of Fourth Street Northwest, between the Eadt line of Eleventh Avenue Northwest and a point 200 feet East, a motion by Hicks, second by Erickson, carried that the City Engineer be instructed to secure the necessary labor and materiais, etc., and grade the said part of Fourth Avenue Northwest, in accordance with plans, profiles and specifications for the said grading; the cost not to exceed 25� per cu. yard for fill,otherwise the project shall be abandoned. President Liddle announced this as being the t 3me and place fixed for a hearing on the construction of a sanitary sewer and the laying of a ater main in the West site of Eleventh Avenue northwest, between a point feet South of the Northeast -corner of Lot 1 in Block 53, in Cascade Manor, nd a point 5 feet North of the South line of Lot 12 in Block 5 in Cascade anor, and asked ifthure was any person present who wished to be heard oncerning the said improvements. a Fly, 345- 7 ." President Liddle announced this as being the time and place fixed for a hearing on the construction of a sanitary sewer and the laying of a water main in Second 'Street Northwest from•the center'of Thirteenth Ave me'Northwest-to the West line of Sixteenth Avenue Northeest, and'askAd if there was any person present who 41khed to be heard concerning the said.sanitary sewer and water main., There was no person present who wished to be heard in regard to either of the above described improvements. A petition requesting authority that the, sidewalk on the West side of Eighth Avenue Southwest, between Ninth Street Southwest and Tenth Street Southwest, be laid along the curb line in order to save the shade trees in that block, was read, and President Liddle ordered the same placed on file. r Chas, W. Smart asked that a surface -drainage sewer be laid in Seventh Street Southeast, between Eighth Avenue Southeast, and Ninth Avenue Southeast, and upon motion by Erickson, second by Schroeder, his request was referred to the Sewer Committee and the City Engineer. A Mr. Batdorf made objection to the assessment made against his property for thv widening of Eleventh Avenue Southeast, and -upon motion by Erickson, second by Hicks, his complaint was referred to the *City Attorney, with instructions that report be made by the next meeting of this Commas Council. Nels Tvedt, Wm. Radtke and A. L. Bach, opposed the proposed construction of a sidewalk along the North side of Ninth Street Southwest, between Seventh Avenue Southwest and Eighth Avenue Southwest, but no formal action was -taken. Eric Nelson made complaint about the unsanitary condition at the ware ousfirst Avenue Northeast, and Dr. D. C. Lochead Rochester Egg and Poultry Company, for the Health Officer, made promise that the Sanitary Inspector will make regular visits tc this place and insist that it be kept in proper order. This being the time and place fixed `for the opening of bids for the grading of Sixth Street Southwest, between the East line of Flathers' Addition, and the, West City Limits line, the proposal of • Kirs Neilson to do this grading for a tot&l s= of $69233081 or a basis of 69¢jper cubic yard, was opened and read, Upon motion by Hicks, second by Erickson, the said proposal of • iris NeMson was rejected, and it was ordered that his certified check be returned to him and i% was ordered that proceedings be prepared for a hearing on plans,'profiles and specifications which will eliminate the rock excavation on this project. The report of the City Treasurer for the Month ending July 31st, 19289 showing $381,465,54, as being on hand, was read, and President Liddle ordered the same placed on file. The application of D. B. Beaton for a soft drink dealer'•s licEn se at 19 First Street Southwest 'was read, and upon motion by Schroeder, seeond•by Erickson, the same was referred to the License Committee. A petition asking that a water main be laid in Third Avenue Southwest, between Sixth Street Southwest, and Seventh Street Southwest, was read, and upon motion by Ericks un, second by Schroeder it was referred to the Water Committee for their recommendations and report at the next meeting of this Common Council. A petition asking that a water main be laid in Eleventh Avenue Northeast, between Ninth Street Northeast, and Tenth Street Northeast, was read, and upon motion by Schroeder, second by Lemmon, it was referred to the Water Committee, for their recommendations and report &A� the next meeting of this Common Council. ` A petition asking that a water main be laid in Third Street Northeast, by extending ebst to Fifteenth Aveme Northeast, was read, and upon motion by Schroeder, second by Erickson, it was referred to the Water Committee for their recommendation and report at the next meeting of this Common Council. A petition asking that a sanitary sewer be constructed in Sixth Street Southwest from the center of the alley next West of Hammer & Fannings' Addition to the center of. Sixteenth Avenue Southwest, and that a 14 inch water pipe be laid in the same trench, was read, and President Liddle ordered the same placedon file. Notice of claim for damages in the amount of $25,000,00 was made by (Vivian Connors, as special administratrix of the estate of Leo F. Connors, for his accidental death while moving a house on 'Third Avenue Southwest, was read, and upon II motion by Erickson, second by Rommel, the said notice waB referred to the City Atto The application of Margaret L. Anderson, Health Office Stenographer, for a vacation begging on Au-ust 20th,1928, was read, e,nd,upon motion by Erickson, second by Schro Eder, sVe was granted a ten day vacation beginning on that date. Certificate by C. M. Babcock, Commissioner of Highways, designating the Foster Batttry Company as an official Lamp Adjusting Station, was read, and President Liddle ordered the same placed on file. The request of the Fire Department Relief Association, for approval of thei investment in $1600,00 first mortgage on the South half of the Southwest quarter of Section 26-109-13, in Wabasha County, and a $2825,00 mortgage on the East half of the . t Northwest quarter of Section 22-106-15 in Salem Township, was read, and upon motion by Lemmon, second by Hicks, approval was given to the, i investment. The appointment by the Mayor of W. B. McDermott as a Special Policeman for duty upon the property of theMayo Clinic, he to serve without ` pay,and the?-a3poifttihent by the Mayor of T. H. Page, as a Special Policeman at the Tourist Park, he to serve without pay, and each to hold office until the second Monday in April, 1929, unless sooner removed, and ` the appointment by the Mayor of Paul Knutson, W. E. Dieter, B. A. Dieter ,and E. C. Jorgenson, as Special Patrolmen for duty July 28th, 29th, and 30th,' 1928, were read, and President Liddle ordered the same placed on file. Estimate prepared by the City Engineer in favor of Martin Pau]Aon for the construction of a sanitary sewer in Fourteenth Avenue Southeast, showing the sum of $233,74 as being due the said contractor; estimate prepared by the City Engineer in favor of Wm. C. Fraser & Son for the construction of a trunk line sanitary sewer in First Street Northwest, between Twelfth Avenue Northwest, and Thirteenth Avenue Northwest, showing the sum of ',1195.10 as being due the said contractors; and estimate prepared by the City Engineer in favor of Wm. C. Fraser & Son, i'howing the sum of$1275.00 as being due the said contractors for the construction of a sanitary sewer and the laying of a water main in parts of Ninth Avenue Southeast, Tenth Place Southeast, and Eleventh Street Southeast, were each read, and President Liddle ordered the same placed on file; the said estimate in favor of Martin Paulson carrying notation that 59 feet of 8 inch sewer in place was used and that $37.17•should•be paid to the owner for the above mentioned sewer in place. Upon motion by Rommel, second by Erickson, thB sum of $3 7.17 was appropriated from the Permanent Improvement Fund and it was ordered that the same be paid to Dee Teeter for 59 feet of 8 inch pipe sewer in place in Fourteenth Avenue Southeast. Npon motion by Hicks, second by Miller,tthe sum of A100.00, was appro— priated from the General Fund, and it was ordered that the same be paid to Mrs. Catherine &ritsch, for compensation for the, death of Christopher F. Fritsch, during the period of Shne..29, 1928, to August 2, 1928, inclusive. The following report of the City Engineer in connection with the proposal for the construction of a sanitary sewer in Broadway Street Southwest, was read,l and President Liddle ordered the same placed on file: . no 8-6-28 Honorable Mayor` and Common C ouncA 1. Gentlemen:. I beg to 'report tabulation of bid of Wm. C. Fraser & Son for construction of sewer in Broadway Street Mouth. The price bid is 2154.70 , Estimated cost is 1958.00 Difference $ 296.70 T%e price bid is $296.70 above the estimated cost which amounts to thirteen (13) per cent. CHA : mb Very respectfully, C. H. Armstrong, City Engineer." An insurance policy written by Holt & Perry, in the amount of $2,000.uO on the Public Library and contents, and insurance policy written by Kruse Insurance Agency for 110,000,.00 to$20,000.00 Public Liabilityand Al,000.00 Property Damage, on the Whippet Coupe, for use of the Health Department of said City, were laid before the Common Council, and President Liddle referred the same to the Insurance Committee c 350 The claim of H. S. Murphy $21.00 for taking evidence in the inquest on the body of Leo F, Connors, and for a transcript of the same, was read, and upon motion by Lemmon`, second by Hicks, the sum of $21.00 was appropriated from the General Fund and it was ordered that the -same be paid to H, S. Murphy for the purposes stated and that the City Clerk be instructed to bill the same to the Public Utili ly Department. Alderman Erickson introduced the following resolution, which was read: "Whereas, The Common Council of the City of Rochester has hereto- fore passed and adopted a resolution ordering a sidewalk to be constructed on the(West side of Eighth. Avenue Southwesttbetween 9th and loth Streets Southwest-mith the west side thereof along a line 2 feet and 8 inches outside of the property line of the said west side of 8th Avenue. S.W.; and Whereas, all of the property owners are desirous of having the said sidewalk constructed on the said west side of said 8th Avenue so that the outside thereof shall be along a line, which is 1* feet east of the property line along the said west side of Eighth Avenue in order to save many valuable shade trees.- . Now, therefore, be it and it is hereby resolved by the Common Council of the City of Rochester, Minnesota: That the resolution pAssed and adopted bye said Common Council on April 2nd, 1928, in so far as it applies to the construction of the said sidewalk above described, be and it is hereby repealed and that the said sidewalk be constructed in accordance with the desires and wishe._ of the said property owners, towit: So that the outside _line thereof shall be along a line which is 1* feet east of the said property' line on the west side of said 8th Avenue S.W. " Upon motion -by Erickson, second by Lemmon, that the said resolution II be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Aldpriqan Hicks introduced a resolution appropriating $1195,10 from the Permanent Improvement Revolving Fund and ordering payment made to ` Wm, C . Fraser & Sc*}, to apply on contract for the construction of a trunk r , line sanitary sewer in First Street Northwest between Twelfth Avenue Northwest and Thirteenth Avenue Northwest, was read. s. Upon motion by Erickson, second by Schroeder, that the said resolu- tion be adopted as read, and all voting in favor thereof, President Liddle 4 declared the said resolution duly passed and adopted. Y� } Alderman Schroeder introduced a resolution appropriating $1562,89 from the Park Improvement Fund and ordering payment made to the Mayo :x. Trust Fund for payrolls 1for labor during the period of the weeks ending July 273h,1928, and August 3rd, 1928, which -was read. Upon motion by Hicks; second by Lemmon, that the said Eesolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. A motion by Rommel, second by Miller, that the Common,Council secure plara, specifications and watimates of cost for the construction of a Central Fire Station and a new City Hall on the City Hall Grounds, or for a central Fire $tation and a City Hall on the so-called Central Park, to be separate buildings,in either case, and the ballots to be prepared 'in such form that the voters at the time of the bond election will make selection of the site, received the following vote: Ayes: Erickson, Hicks, Miller Rommel, Schroeder. A motion by Erickson, second by Miller, that local architects be asked to submit preliminary plans, specifications and estimates of cost or separate buildings, as above mentioned, to be constructed on�the present -City Hall site, or on the so called.
