October 1st, 19281 at 2:00 o'clock Par. Me6ting called to order by President Liddle, Roll Call. Present: Liddle, Erickson, Hicks, Lemmon,Miller, Rommel, Schroeder. Absent: None. President Liddle announced this as being the time and place fixed for an kd'jotarned and continued hearing and action on the levying of special assessments for the construction of a sanitary sewer in pact bf Broadway Street South, and asked if there was any person present who wished t0 be heard relative to the said improvement, There was no person present who wished to be heard relative to the said sanitary sewer. president Liddle announced this as being the time and place fixed for a hearing on the confirmation of awards for damages for the opening of an alley in Block 6 in A. W. Kutzky's Addition, and asked if there was any person present who S to be heard. 0 There was no person present who wished to be heard relative to the award of damages for the opening of the above mentioned alley. -Upon motion by -Erickson, second by Hicks, Dr. Geo. J.,Andersgn,Milk Inspec- tor,was granted a leave of absence during the period October 4th,19281, to October 14t] 1928, inclusive for to attend the National American Legion Convention at SanAntonie, Tarxas The application of C. L, Horn for permission to operate a striking machine on the boulevard space at the Northwest corner of the intersection of Center Street West and Broadway Street North.,' was read, and President Liddle referred the same to the License Committee. Recess of_ -,the Common Coui{cil was taken for the purpose of Viewing the lands to be taken in the petition for the opening of a continuation of Ninth Street Southwest, between,Ninth Avenue Southwest and the center line of Tenth Street r Southwest, if extended, after which Council again convened and were called to order by President Liddle, all being present and answering Roll Call. Deb. H. S, Plummer opposed `the opening of a continuation of Ninth Street Southwest, because of claimed dauggrous traffic conditions it would create and submitted a plat Ahowing a propoeed street aeeross :his- property commencing between a the intersections of the present Ninth Street ,Southwest and Tenth Street SouthweSt with Ninth Avenue Southwest, and running'Northwesterly through the valley and coming out on a continuation of Fourteenth Avenue Southwest. 426 M9� I IGj Upon motion by Hicks, second by Erickson. -the City Engineer was instructed to confer with the p**party owners concerned in the opening.of the petitioned Ninth Street'Sou thwest and the suggestions of Dr. Plummer relative to the location of a street in that section and iv , 3 e his recommen- dations as to the location thereof, and as to the feasibility of the ' installation of the necessary services. i The awards of damages made by the Commissioners in the opening ;J ing of an alley in Block 6 in A. W. Kutzky's Addition, were read, and President Liddle ordered that the same be -placed on file. '! The City Clerk reported that no objections to the above mentioned awards had been filed. Alderman Ericks;.n introduced the following resolution, which was read: "WHEREAS, Fred Jorgenson,E.C.Roth, and W.F.Lenz, the Commissioners appointed on August 20th,1928, in and by resolution of the Cob3moh Council of the City of Rochester, Minnesota, to view the lands and premises and to assess'the damages occasioned by the condemnation and taking by said City of Rochester for use as a public alley the lands described in said resolu- •tion of appointment, to -wit: i Commencing at ,the Northeast corner of Lot No.b in Block No.6 in KutzKy's Addition and running East and Northeasterly 141 feet to a point 401 feet West of the Northeast corner of Lot No.3 in said BlocK No.6, said point being 12 feet North of the Southeast corner of Lot No.17 of said Block No.6, and running thence North 16 feet and running thence West and Southwesterly 141 feet to the Southeast corner. of Lot No. 16 in said Block No. 6 and running thence South 16 feet tc place of beginning. Upon motion by Hicks, second by Schroeder, the City Attorney was instructed to secure a warranty deed for the property now used as an.!East and West Alley accross Block 11 in Northern Addition, between Second Avenue Northwest and Fourth Avenue Northwest. Alderman Schroeder introduced a resolution levying special assessments for the construction of a sanitary sewer in Broadway Street South described: Commencing at the center of the intersection of Broadway Street South and Fourth Street Southeast and Fourth 'Street Southwest and running Southwesterly 133 feet thence ,Southerly 100 feet., thence Southeasterly 47 feet and thence Southerly along the center line of Broadway Streetk South 411.5 feet to a point which is 675 feet South of the place of beginning, which was read. Upon motion by Schroeder, second by Miller, that the said resolution be adopted as read, ,ard All voting in favor thereof, President Liddle declared the said resolution duly passed ana adopted. The report of the Milk Inspector for the month of September,19281, was read, and President Liddle ordered the same placed on file. The application of the Zumbro Chapter Order of DeMolay and of the Queen City Lodge No.52, Degree of Honor, -for dance pwrmits, were read. The appointment by A. F. Wright, City Clerk and Commissioner of Registra- tion of T. F. Kennedy, as a temporary Clerk of Registration, for October 3rd, 1928, was read, and President Liddle ordered the same placed on file. The applicatian of S_OW-e Cooke, Assistant City Engineer, for a vacation during the period October 10th,1928, to petober 20th,192u, inclusive, was read, and upon motion by Lemmon, second by Erickson, the `vacation requested was granted. t 430 The following copy of resolution requesting authority was read, and President Liddle ordered the same placed on file: "Be it and it is hereby resolved by the Public Utility 'Board of the City of Rochester, Minnesota that the Hon.Common COuhcil Of the d6id City be and'i s hereby requested to authorize the saidi$oard to enter into a contract with the Northwest General Electric Supply Company of St. Paul, Minnesota for the furnishing to the said City of 8400 feet of various sizes cable as per specifications on file at a total contract price of TWELVE HUNDRED TWErITY SIX DOLLARS AND SEVEN CENTS ($1226.07) F.O.B. cars Rochester, Minnesota." Upon motion by lemmon, second by hicks, the sum of $80,00 was appropriated from the General Fund and it was ordered that the same be paid to Mrs. Catherine Fritsch for compensation for the death of Christo- pher F. Fritsch during the period August 31st, 1928, to September 27th,1928, inclusive. The following recommendations of the Street and Alley Committee and the City Engineer, were read, and President Liddle ordered that the same be placed on file: ' " 10-1-28 Honorable Mayor and Common Council. Gentlemen: The Street and Alley Committee and.the City Engineer beg to report a8 tfollows: Sept. 4th., the Common Council at the request of the City Engineer moved to ask theMayor to issue an emergency permit for the purchase of a Four and one-half- (4�) ton truck. The Honorable Mayor did issue such permit, it being understood that the truck was to be the same type as the three and one-half (3=`) ton truck now owned by the City and to use the old Pierce Arrow Body, the cost to be about four thousand three hundred and fifty (4350,00) dollars. The order was placed on September 4th. On Sept, 7th. Mr.,Putman called upon the Mayor and the City Engineer and stated that they were not making any more •f our (4) cylinder trucks and that six (6) cylinder Hall Seatt would cost three hundred ($300) dollars more but that they would let us have one for an incleabe of two hundred (0200) dollars. Later Mr, Putman stated that the truck was not a six (6) cylinder but a four (4) cylinder Hall Seatt. After careful investigation it is�found that .the truck in Allly worth the increas`4, or four thousand five hundred and fifty ($4550,00) dollars, as the presen-L sale price is five thousand eight hundred thirty-five $5835,00) dollars, making the value with the old body six thousand one hundred thirty-five ($6136,00) dollars. The truck is equipped with starter, geneiator, and speedometer in addition to what we expected to receive and this committee recommends that the truck be accepted and payment made November 15th,1928. Upon motion byLemmon, second by Erickson, the sum of $10,00 was appro- printed from the Gen tral Fund and ordered -paid to the League of Minnesota MunicipRli- ties, as an assessment for the legisl6tive services to be receibed by this City during the months of January, February, March and April, 1929. The following communication from the Chief of Police was read, and upon motion by Erickson, second by Hicks, it was referred to the Mayor and the Police Committee: "Rochester, Minn. Sept. 26,1928. To the Police Committee and Common Council. Gentlemen: I submit the following for your consideration: The Police Department is in need of a better automobile than we have. The automgb ile that we have,has made about twenty-two thousand miles, and is in need of repairs. We also need three more lockers. 4 We also need some more lights over the desk on the Police Cf.11 System. Some repairs on broken windows. Very truly, G. E. McDermott Chief of Police."
