The Mayor submitted the following proposed Charter Amendments and explainer r the same: PROPOSED AMENDMENTS TO THE CHARTER OF THE CITY OF ROCHESTER,MINNESOTA. To the Honorable Fred W. Haase, Mayor of the City of Rochester, Minnesota: 'ge,the Board of Freeholders of said city duly appointed to draft a chartef for said city of Rochester and to propose and, submit amendments to said charter, do hereby propose and submi-i, the following amendments to the Charter of the City of Rochester. It IN 536 Amendment No. 1. Amend Sections Nos. 14, 41 and 295 of the Charter of the City of Rochester so that the same shall read as follows, respectively: Section 14. The elective officers of said City shall be a Mayor, an Alderman at Large, 'and an Assessor, a Treasurer, a Justice of the Peace for the city, who shall be styled "City Justice",. The Mayor and Assessor i; shall be elected at the general city election in each odd numbered year, and each shall hold .office for a term of two years, and until -his successor shall be elected and qualified., The Alderman at Large shall be elected at the general city election in each even numbered year, ''and 'shall hold office for a term of two years, and until his successor shall be elected and ? gyalified. The Treasurer shall hold his office for a term of one year and until his successor shall be electAed aaiqualified. The City Justice shall hold his office for a termof two years. Section 41, The Assessor shad qu'slify in manner and form prescribed by the general law as well as in the manner and form by this -prescribed Charter. He shall perform all the duties pertaining to the office of � b Assessor required q y the general laws of the State, and shall also perform 'records such other duties and keep such in such form as, from time to time, may be prescribed by the Common Council, and shall have the powers, rights { Oil and privileges allowed by the general law respecting the listing of property � y for taxation. Amendment No. 2 Amend Section No. 219 of the Charter of the City of Rochester so hat it shall read as facllows: Section 219: The Common Council shall have power to ppen, ate&lish and lay out new streets, lanes, and alleys within the city; to iden, extend, alter or straighten any street, lane, alley or highway; 0 out, fill, excavate, grade, level, pave, repave, curb, wall, bridge, ravel, macadamise or plank any street, lane, alley or highway and to keep he t same in repair; to construct, lay, relay and repair retaining walls, ters, drains and pipes for surface water and private drains in, over r under any street, lane, alley or highway; to construct* ornamental limiting ystems in, over, and along any street, lane, alley or highway, or any part hereof; and to levy a special assessment for the cost and expense of ny such improvement according to any of the methods specified in Section 21 of this charter. Fiegel, The City Attbrney submitted the following ruling by the Attorney General in the matter of truck ttw asportation within the City of Rochester, which was read, and President Liudle ordered that the same be placed on file: "STATE OF MINNESOTA LEGAL DEPARTMENT St. Paul November 28,1928. James T. Spillane, Esq., City Attorney, Rochester, Minnesota, Dear Sir: • I Your letter of the 21st inst., addressed to the attorney general, has been referred to me for attention. You state: "At the last meeting of the Common Council I was instructed to prepare an ordinance that would prohibit trucks holding certificate of Public Convenience and Necessity from the Railroad and Warehouse Commission of Minnesota from making any deliveries by such trucks in the City of Rochester. It is the contention of some of the members of the Council that such treks should be required to haul merchandise only into the terminal here in the City from which it will be picked up by local transfer companies and delivered to its destination. It occurred to the writer that suen an ordinance would be invalid because it would discriminate against the company holding a certificate of Public Convenience and Necessity from the Rail- road and Warehouse Commission. Will you kindly give me an opinion as to this matter?" In my opinion such ordinance would be invalid, first, because it would unlawfully discriminate between companies' operat ng under a certificate of pubfie convenience and necessity granted them by the railroad and warehouse commission and other companies not possessing such a certificate. Such a classification rests upon no reasonable basis and would be arbitrary and capricious; second, while a city has power to take reasonable regulations governing the use of its highways the city is without power to prohibit vehicles from operating over its h ighways . Under Sec, 18, Chapter 185, Laws 1925, the act relating t c motor bus transportation, yft will note that the provisions of that act are not to be construed as taking from or curtailing the right of any city or village to regulate and control the routing, parking, speed, or safety of operation of a motor vehicle operated by a transport&tion company. Your proposed ordinance, however, seeks to prohibit such vehicles from operating at all through the streets of the city. Clearly this can not be done, You.La trulY, John F. Dr. A. H. Sanford, R. W. Chadwick and Wabter b. Fratzke, as the Building and Grounds Committee'of the Board of,Education of School District Na. 8, and Superintendent Sanberg, were before the Common Council, with requ-st for better traffde control on First Street Southwest, Second Street Southwest, Center Street East and West, and Seventh Avenue Southwest, with special reference to the condition that exists on First Street Southwest at the High School and Central School, they offering all of the cooperation possible in the elimination of the danger caused by the absolute disregard by automobile drivers of the traffic signs around the local school buildings and the right of the school children as pedestrians. We understand that the School Board will maintain public rinks at all of the,Ward Schools and the Central School as they have done in the past. 3. There is no park property available for a skating rink at the present time: 4. We understand that the Park Board does not desire to operate a skating rink at this time, 5. The budget for the ensuing year does not include any amount for such a purpose. 6. There appears to be no public necessity for the construction of any additional rinks than those mentioned above. The report of the .Clark of the Municipal Court for the week ending November 26th,1928, showing criminal fines collected $168,00, court costs charged to Olmsted County $26:80, and fines collected clue to Olmsted Obunty $20,70, was read, and President Liddle referred the same to the City Attorney. Upon motion by Hicks, second by Lemmon, the sum of $20470 was appropriated from the General Fund and it was ordered ,that the same be paid to the Olmsted County, minnesota, for local municipal court fines collected due to Olmsted County. The shipment was delayed tc, such an extent 'hat we were obliged to stop opera- t ions . Later, forty-nine (49) drums vttf iller were shipped to us from LaCrosse by local freight without any order from this department to do so, and for this forty-nine (49) drums we are billed thirty-four dollars and eighty cents (34,80) per ton as against a price of twenty-six dollars -,and ten cents ($26.10) per ton as the price was made. Later a carload of mixed material was delivered, from which we took fifty (50) drums. This lift* (60),drums was billed at twenty-six dollars ana ten cents ($26.10) per ton, which is acceptable.
