!� Minutes of an adjourned regular meeting of the Common Council
of the City of Rochester, Minnesota, held in the Council Chambers, in the
City Hall, in said City at 7:30 O'clock P.M,,... on May 7th,1930.
T,feeting called to order by President Liddle.
Roll Call. Present: Liddle, Dallman, Hicks, Miller, Rommel,
i Vihstadt.. Absent,: Alderman Erickson; Alderman Erickson, being absent
on account of his death shay 5th,1930.
Upon motion by Hicks, second by Rommel, and all voting; in
favor thereof, B. Amundsen was duly appointed Alderman of the First Ward

of the City of Rochester, Minnesota., to fill the unexpired term of Mr.
Tollef Erickson who died May 5th,1930, i. e. until the first 34onday in April
1931, and until his successor is duly elected and qualified.

That Fourth Street Southwest, from the West line of Broadway Street
South to the East' line of'Second Avenue Southwest be widened to a width of 60 feet,
and that the strip between the present paving and the new curb be paved with 7" one
(course concrete and that a=oemeutteoncrete curb be constructed along the both sides
lof the paving' so widened;
That Second Avenue'Northwest; from the North line of Center Street West
Ito the South line of Second Street Northwest,"be widened to a width of 50 feet and
that the strip between the present paving and , the new curb be paved with 7" one
course concrete and,that a cement concrete curb be constructed along the both sides of
the, paving so widened;
The construction ofa combined concrete curb and gutter along both
11s idea of Third Avenue Southwest between the South line of Center Street West and the
North line of Second Street Southwest, the said concrete gutter shall be 36 inches
wide, the said curb to be 6 inches ,wide.. and .set to a distance of 50 feet, between
the inside faces; such concrete curb and gutter as now might be in place to be
,removed;
That Center Street East and West, from the West line of First Avenue
Southeast and. Northeast, to the East line of Fourth Avenue Southwest and Northwest,.
be widened to a width of. 54 . Peet; and that the strip between the present paving and
the new curb be paved with.7"- one course`concrete and that a cement concrete curb

uld necessitate the taking out, of their shade trees, and said that they would
obieet to the improvement if such was necessary.
John S. Case favored the widening of the roadway between the curb faces
on Third Avenue Southwest, ad above described, provided that the .0ity would pay the
cost of the improvement.
It was reported that Helen Posz opposed the widening of the
roadway on Third Avenue Southwest by' the construction .O f ' the new curbing
and the widening of the pavement on Center Street West, and Willard Hutch-
ins opposed the widening of the roadway on Third Avenue Southwest to the
extreme width proposed.
Upon motion by Hicks, second by Dallman, further proceedings
relative to the widening of the roadway on Third Avenue Southwest by the
construction of a new curb and gutter as above described,.were abandoned.
Frank Cowan, talking for Mr. Meeker and Helen Posz, claimed
100 per cent opposition to the widening of Center -Street, as that covers
the owners of the property between Third Average Southwest and Fourth
Avenue Southwest.
Upon motion by Vihstadt, second by Rommel, further proceedings
for the widening of Center Street . West, as above described, -were abandoned.
Upon motion by Miller, seeamd by Vihstadt,. the City Clerk
was instructed to prepare proceedings for the widening of„the paving on
Center Street East, and West, to a width of 59 ,Peet from the East line of
the alley running North and South through blocks 31,and-38•,Original Plat ,
and the West line of First Avenue Northeast and"Southeast.
John S. Case suggested that First Street.Southwest be widened
as far West as Eleventh Avenue Southwest instead-.of,st opping at Sixth
Avenue Southwest.
Upon motion by Vihstadt, second by Hicks, further proceedings
as to the widening of the paving on First ' Street Southeast'and Southwest, ,
as above deseribed,were.abandoned. -
Upon motion by Vihstadt,"second" bg"Hicks,'-the City Clerk
was instructed to prepare proceedings for the'widening of the paving•on
First Street Southeast and Southwest to a width of 59 feet between the
West line of First Avenue Southeast and the East f line of Third Avenue
Southwest.
In regard to the proposed curb and gutter for Seventh Avenue
Southwest, as above described, Mrs. Mark Olin and Miss Graham talked
against this improvement ,while RueheA Hood, Louise West•-; • R.16.Thompson, J.M.
Pruett, Harry Wood, Andrew Nalstadi Ed. Larson, and Ge-o. S.chmelzer.and
Harry Hanson for himself and Fred Rasmussen, favored the making of this
improvement as soon as possible.

In the discussion preliminary to the ordering of plans, profiles, sp.eci-
ffieations and estimate of cost, for the Seventh Avenue Southwest curb and gutter,
it was agreed that the assessments for the. cost and expense there of shall be spread
over a period of five years.
'Alderman Dallman introduced a resolution ordering the construction of a
combined curb and gutter.on part of Seventh Avenue Southwest,.as above described,
ordering that the cost thereof ,.shall be paid .forby special assessments. levied as
provided .by law, and ordering that the City Engineer prepare and submit plans,,
profiles ,specifiOations and estimate of eost'for the said improvement,which was read,

.An ordinance governing plumbers and plumbing in the City of Rochester,

compliance with the Charter

Rochester, Minnesota, as to
the
super-
vision of streetsand the licensing, of plumbers in that it would deldgate those duties'
to.a board of master plumbers and business men commissioned to examine and license
competant plumbers, at which LeRoy BVLrddt, one of the promoters of the ordinance,
asked that the ordinance be: withdrawn gnt to be made so that it will comply with
the Charter of the City of Rochester,, and Alderman Miller, who introduced the
ordinance, asked for permission to withdraw it before action was taken on the third
and final reading.
Upon motion by Hicks, second by Rommel, Alderman Miller's request for
withdrawal of the above mentioned ordinance, was granted, and the ordinance was
handed to him..
An ordinance to amend Section 2 of an Ordinance passed by the Coiiarnon Coun-
cil of the City of Rochester, entitled "An Ordinance granting to the Wisconsin,
Minnesota, and Pacific Railroad Company, the right to construct, maintain and operate
a railroad across certain streets and alleys in the City of Rochester" was given its
third and final reading.
Upon motion by Hicks, second by Vihstadt, that the said ordinance be
adopted as read, and all voting in favor thereof, except Alderman Rommel, who voted
"Nay", President Liddledeclared the said ordinance duly passed end adopted.
The following relative to certain Committee appointments, was read, and
President Liddle ordered than the same be, placed on file:

The City Engineer made -oral report that 'the plat of Holm's
Sub -Division of a part of Lot 45 in State Sub -Division of Section 36-107-14,
is correct except that there are some errors in the dedication description,
at which he and -John J. !'err, who submitted this plat, retired from the
Council Chambers for the purpose of making the needed corrections.
The application of Robert A. Orr for an aubtionesale of jewelry,
stock in the building known as 227 First Avenue Southwest, commencing
June 1st,1930, and ending June 30th,1930, was read, and'upon motion by
Rommel, second by Vihstadt, license was granted.
The jewelry auction sale license -bond --of Robert A. Orr,
with Edward H. Coon and George F. Mercier as sureties"•thereon. each in the
amount of $500.00'. was read, and upon motion by Rommel" second by Hicks,
the said sureties were accepted, the said bond was approved and it was
ordered that the same be placed on file..
The following recommendations of the -Sewer Committee,. was
read, and President Liddle ordered that the same be placed - on file:

Alderman
Rommel introduced
an ordinance
of the City of Rochester,
Olmsted
County, State of Minnesota, granting to the Interstate Power Company, its successors
and assigns, permission to erect, install, construct, reconstruct, repair, own,
operate, maintain, manage, and control a gas plant within the copporate limits of the
City and a gas distribution system consisting of pipes, conduits and other fixtures,
in, under, over, along and across the streets, lanes, avenues, sidewalks, alleys,
bridges and public grounds of said City for:the purpose of furnishing gas tnt
light;heat and poorer purposes to said City and its inhabitants for a period of
fifteen years from and after the passage, approval and publication of tlrls ordinance
according to law, which was given its first reading.
`_'he 8200,00 payment by Dr. E. S. Judd, as heretofore arranged for the
annexation to the City of Rochester, of Lots 97, 989 99 and 100, in Belmont, was
presented to the Common Council, and upon --motion by Vihstadt, second by Hicks, the sad
200.00 was accepted into the miscellaneous budget division of the General Fund d8
the City Tredsury of said City.

Alderman Hicks introduced an ordinance annexing a part of Section 3,
Township 106. North,of Range 14 West, to the City of Rochester, Minnesota, which
was given its first reading.
Upon motion by hicks, second by Miller, the rules were suspended and the
said ordinance was given its;second reading.
Upon motion by Miller, second by Dallman, the rules were suspended and the
said ordinance was given its tlxird and final reading.
Upon motion by Rommel, second by Hicks, that the said ordinance be
1-adopted as read, and all voting in favor thereof, President Liddle declared the
said ordinance duly passed and adopted.
'j'he report of the Clerk of the Municipal Court for, the week ending
April 28th,1930, showing criminal fines collected A148.00, civil fees received
,,A.452 $28.15 received from Olmsted. County for March,1930,Municipal Court fees, and
$35.45 court costs charged to Olmsted,County, was read, and President Liddle referred
the same to the City Attorney.
The report of the Building and Electrical Inspector for the month of
Apr,il,1930, showing building inspection fees. collected in the amount of �,230.00,
and electrical inspection fees collected in the amount of $17.50, was read, and
as Alderman hicks, as, Chairman of the Finance Co;amittee, orally approved this report,
President Liddle ordered that the same be placed on file.
The report of theCity Treasurer for the month ezidipg April 30th219302
showing $299284658 as being on hand, was read, and President Liddle ordered that
same be placed on file.

The City Engineer's trial%"balance of disbursements in his
department during April,1930, was 'read, and President Liddle ordered `
that, the same be placed on file.
The report of the .City Engineer for the month of April,
1930, showing expenditures from the General Fund for labor in the amount
of ''?518.47, from the Street and Alley F uid 11441.10, and from the Sewer
Fund 1218.39, was read, and President Liddle ordered that the same be
placed on file.
The apIllications of Chris Lane, B . G. Mayou, and Drumm &
White, for soft-drink deeler licenses were read, and upon motion by RorimLel,
second by TTicks,ldcenses were granted.
The application of the Rochester Amusement Company for motion
picture licenses at the Cho.teau-Dodge Theatre, the Lawler Theatre, and the
Empress Theatre, were each read, and upon motion by Hicks, second by
Vihstadt, licenses were granted.
Alderman Miller brouht up the matter of the 'theatre proprie-
tors allowing their patrons to enter and leave the theatre in the same
aisle at the same time and by the same aisle thel•eby leaving the possibility
of serious injury and probable deaths in the' case of a panic, and President
Liddle referred Alderman Pdillerlb suggestion to the Fire Department,
Committee and the Fire Warden, with instructions to. see if can be arranged
so that the filJ..ing of the seating will help to cause those leaving the
theatre to do so by a different aisle than those' coming in to see the next
show.
The following communication was read, and after a prolonged
discussion of the subject, motion'by Hicks, second by Vihstadt, carried
that the. City Attorney be instructed to draft an -..ordinance amending the
present ordinance,which shall provide a license fee 'of �200.00 for six
days license, which six days shall be exclusive of Sunday, providing that
the carnival concerned is under the auspieds of a local organization:

to authorize the said Board to enter into a contract with the Cedar River Lumber
Company of Minneapolis, Minnesota for the furnishing to the said City, inaccordance
with specifications, of 100=7" top 35 ft.Western Red Cedar Poles at a price of "11.78
each and 200 13" top 12' long Western Red Cedar Stubs at a price of 17.85 each -the

To the Honorable Mayor and Common Council
of the- City of Rochester
Gentlemen:
Thdre has been considerable•agitation amongst the business men in
regard to the matter of Street Flushing in the business sections.
Acting upon this feeling, the 20chester Commercial Club would like to
ask that the flushing of the streets in 'the- business districts be done
after mid -night. It is felt that the job would be easier `and could
be .better done at thiq time qn account, of there being practically no
traffic and very few cars parked on the streets at that time.
We feel certain that if this suggestion is made to the City
gngineers-Department and to. the Street and Alley Committee that they
will see fit to so arrange the work so that this can be done at a time
that will be satisfactory to all.

President Liddle ordered that the same be placed on file.
Upon motion by Miller, second by.Dallman, the sum of $160.00 was appro-
priated from the General Fund and it was ordered that the same be paid to Mrs.
Catherine Fritsch, as compensation for the death of Mr. Christopher F. Fritsch during

in their bereavement, was read, and President Liddle ordered that the sate be placed

Upon motion by Hicks, second by Miller, -'the City Attorney was instructed
to draw a resolution of sympathy for 'drs. Tollef Erickson and family, to be spread

upon the records of this Common Council, which resolution shall have a provision
that a certified ,copy ther.e.of shall be given to Mrs.Erickson.

Vihstadt, the same were allowed and the Mayor and City Clerk were authorized and
