Roll Call. Present: Liddle. Amundsen, Dallman, Hicks, Ililler, ,toody. Norton. Absent: None. Upon motion by Moody, second by Amundsen, the minutes of the meetinggheld on February 6th,1933, and on February 14th,1933, were each approved. This being the time and place fixed for the opening of proposals for the purchase of the l,000,00 Certificate of Indebtedness offered for sale at this time, the following bids were opened and read: "To the Honorable Mayor and Common Council of the City of Rochester, Minn. Gentlemen. I hereby submit a bid 4.1`- for 81000 city dertificate of indebtedness applicable to Hog farm fund. Enclosed you will find certified check 120.00 Twenty Dollars. Respy submitted Mrs '1dargaret K. Kennedy." "Rochester, Minnesota, February 23, 1933. Honorable Common Council City of Rochester, Minnesota. Gentlemen: We, the Sinking Fund Commission of said City, offer a 4% basis for the City of Rochester 4� Certificate of Indebtedness dated 'February 1st, 1934, which is offered for sale at this time,, which makes our proposal, 1�1,000.00 for principal 82.44 for premium and $3,26 for accrudi interest. Alderman Amundsen introduced the following resolution, which was read: "Be it resolved by the Common Council of the City of Rochester, „4innesot a: That the bid and offer of Sinking Fund Commi ss ion for ?11, 000. 00 City of Rochester, Minnesota, 44110 Certificate of indebtedness, dated February 1st, 1933, and maturing February lst,1934, being $1,000,00 principal on the said oertifi- cate of indebtedness, 2,44 premium on the said certificate of indebtedness, and 13.26 as accrued interest on the said certificate of indebtedness, is deemed to be the most favorable proposal for the said certificate of indebtedness, and Be it Further resolved by the said Common Council: That the said certificate oft indebtedness numbered No.l, be and the same is hereby awarded and sold to Sinking Fund Commission and that the same be delivered to them upon their paying into the City Treasury of the amount of said bid therefor, and Be it further resolved by the said Common Council: That the Mayor and City Clerk of said City Pre hereby authorized and directed to 11execute the said certificate of indebtedness, and the City Treasurer is ?!hereby authorized and directed to deliver the said certificate of indebt- il edness to the purchaser upon the payment into the City Treasury of the 11and above mentioned purchase price; the said payment of principal, premium 0 accrued interest to be placed in the General Fund of said City. " Upon motion by Miller, second by Dallman, that the said resolu- tion be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Upon motion by Amundsen, second by Moody, it was ordered that the certified check of the unsuccessful bidder for the above mentioned certificate of indebtedness be returned to her. Charles Dtialdowski, Claude A,.Johnson, O.S.Cumnens, and another person (unidentified), as spokesmen for a large delegation from the so-called "Unemployed Council", demanded that local light and water service users who are delinquent in their 0symeAts .and have been cut off for non payment be returned to the enjoyment at those services; that matches, salt, soap and baking powder be added to the menu;_ and be among the food supplies furnished by -relief organizations for the local needy persons; that the Communist meeting plac@ be furnished light,, and water servicE; free of charge, and that a eo_-,mittee be selected from the Common Council of the City to meet jointly with a committee from each relief organization and a committee from the ,so-called"unemployed council" for the purpose of receiv- ing instructions from the said "unemployed council"as to how; why and where to dispense relief. No official action was taken on these demands but it was informally agreed that members of the Common Council would meet with the ommittee mentioned for a discussion of the matters above set forth. Oscar V. Hanson made oral opposition against the proposed . moving of the Florence Hotel to a location between his residence and that of Mfrs. George Pollock, and the following petitions carrying a total of 1146 names, were read: I 293 r file. "We, the undersigned, do, hereby, propose that .you, as City Officials, refuse to let, the Florence Hotel be moved to the location which is directly across the street from the Bethel Lutheran Church, as it would be a tremendous fire hazard and would ruin the price of property in this vicinity. It will also increase the fire insurance rate on property in this locality. We hope that you will see this situation from our stand point and will not grant the permit for moving this hazardous place across from our Church on Third Avenue Southwest. " "We, the undersigned, do, hereby, propose that you, as City Officials, refuse to, let the Florence Hotel be moved to the location, known as the Bryant Home at 219 Third Avenue Southwest, for the following reasons: It is a tremendous fire hazard. It ruins the price of property for our homes in this block. We feel that you would be justified in not granting the moving of a hazardous place of this kind, on account of its fire destroying element, as well as a financial injury to us. " President Liddle ordered that the said petitions be placed on he report of the Health Officer for the City Farm for the month of January,1933, showing receipts in the amount of 1,257,58, disbursements in the amount of A559,19, and an overdraft of $fi400.55, was read, and President Liddle ordereC that the same be placed on file. -'he report of the City We-ighmaster, for the month of January, 1933, showing weighing fees collected in the amount of $63,30, was read, and President Liddle referred the same to the Finance Committee. The re port of the Building, Electrical and Plumbing Inspector, for the month of January,1933, showing building inspection fees collected in the :mount of ",h4.00, electrical inspection fees collected $15.75, and plumbing inspect ion fees A6.00, was read, and President Liddle referred the same to the Finance Committee The report of the Clerk of the Municipal Court for the week ending February 13th,1933, showing criminal fines collected 113,45, civil fees received $.25, conciliation court fees 55,50, and court costs charged to Olmsted County 4,6,45; and for the week ending February 20th,1933, showing criminal fines collected 76.80, civil fees received $4,95, conciliation court fees $5.00, court costs charged to Olmsted County 935.80, and fines collected due to Olmsted County $50.00, were each read, and President Liddle referred the same to the City attorney. Upon motion by Dallman, second by Moody, the sum of $50,00 was appropriated from the General Fund and it was ordered that the said sum be paid to Olmsted County, Minnesota, for local Municipal Court fines collected due to Olmsted Count y,Minnes ota. Balance sheet, income statements, etc., of the Public Utility Depattments, prepared by the Secretary of the Public Utility Board, as of January 31st,1933, were laid before the Common Council, and President Liddle ordered that the same be placed on file; the said income statements showing a net profit in the light Department for the month of January,1933, . Of 17575.14, for the ten months of this fiscal year 174077.39, a net profit in the Water Department ror January,1933, of $76.99, and Water Department profits for the ten months $24269.60; $team Heating profits for January 1933, 1857.11, for the ten months of this fiscal year $3256.77. General Balance sheet, trI&1 balance, fund statement, statement of unexpended budget appropriat ions,ete., for the City of Rochester, (Minnesota, as of January 31st.1933, as prepared by the City Clerk, were (&aid before the Common Council, and President Liddle ordered that the same be placed on file. The annual report of the Financial Secretary of the Pu:;lic. ' (Library for the year ending December 31st,1932, was laid before the (Common Council and President Liddle ordered that the same be placed on file. The application of E.JzDurkee, for a solicitors license, was read, and upon motion by Dallman, second by Amundsen, license was granted. The application of Alvin W. Heim for a soft drink dealer !license, was read,•and upon motion by Amundsen, second by Hicks, license granted. The application of the Queen City Camp #1646, M.W.A. for public dance permit at the Woodman Hall, February 22nd,1933, and of erry Thompson, for a public dance permit at the Woodman Hall; February 1p4th,1933, were each read. The following request for substitution of insurance policy was ead, and upon motion by Dallman, second by Amundsen, the request for change of policy was granted: "Rochester, Minn. February 4th,1933. ,Mr.A.F.Wright, City Clerk, City of Rochester, Rochester, Minn. Derr Sir: Please accept the attached Insurance Polity #169777 in the Standard Accident Insurance Company covering the Town Taxi Cabs in place of the Policy now on file. Also please at your conveinence return the original Policy to us. Thank You. Yours Very; -truly, TOWN TAXI J .L .Adams " 295 The City Clerk. reported the payment by the Franklin Heating Station of 1118.61, as -g� per thousand cubic feet of natural gas used during January,1933,(23712000 cu. ft.) Copy of Health Officer's retauisition upon the Worrell Hospital fDr the isolation of Mrs. Helen McDermott, diagnosed to be suffering from diphtheria, and copies of requisitions by the Health Officer upon Saint Mary's Hospital for the isolation of Mrs, Helen McDermott, diagnosed to be suffering from diphtheria, and of Arthur Anderson, diagnosed to bei suffering from diphtheria, ' were each' read, and President Liddle ordered that the same be placed on file., The appointments by the Mayor of Carlton E. Anderson, as Special Patrolman during the period February 6th,1933, to February 12th,1933, and February 14th to 19.th,1933, and the appointment by the Acting :4ayor of Carlton E. Anderson as a Special Patrolman February 20th, to 26th,1933, were each read, and president Liddle ordered that the sane be placed on file. The following acknowledgement was read, and President Liddle ordered that the same be placed on file: "We shall always remember with gratitude your kind expression of sympathy. John Morton and family." The following copy of a letter written by the mayor and the reply thereto, were each read, and President Liddle ordered that the same be placed on file: "January 811933 Mr, Harry Peterson, Attorney General, St. Paul, Minn. J Dear Sir : Enclosed find correspondence with former Attorney General., The matters therein discussed have been adjusted. We are getting 10% of the gross earnings of our Utilities', which we are paying over monthly to the city treasurer to reduce taxes. Our surplus is about the same as before, around �9200.000 and we need a new trunk -line sewer which may require 1100.000. It has been pro- posed that on account of the idle men in Rochester, that we build this sewer ;.with surplus funds on hand and save the supporting of these men and their families through charity. '!'his work would be all hand labor. We would like your opinion, practicle, justifying such action from legal standpoint, so that we may act if we think best. Our present light rates are from 10 to 50% cheaper than Winona, St.Clou d and Mankato, cities of our size. They have been that ever since we built our plant and last year at these rates, we made a profit of $139.000,00, I am mailing you under separate cover last years' report. I am also enclosing the City Clerk's financial statement of our utilities. If any more information is wanted, kindly write, and oblige Yours truly, J. J. Reilger, Mayor. " "State of Minnesota, Law Department Saint Paul. February 8, 1933 Hon, Julius J. Reiter, Rochester, Minnesota Dear Mayor: This is in reply to your communication of January 8th. You,inquire whether the City of Rochester would have the right to use the surplus fund created by the operating of your power utility .for the purpose of constructing a new trunk line sewer, In our opinion such part of the earnings or your power utility remaining after the Public utility Board has pursuant to Section 154 of your city charter made sufficient allowance for the cost of the operation, maintainenee and extension of the plant, the interest on all bonds which have been issued on account of any extension of said plant, and for a reasonable reserve fund for use at any time in making repairs, and extensions, may if there are no outstanding unpaid bond obligations or other lienable claims against such fund or plant be used by your municipality for general city purposd1which would include, of course, the construction of a new trunk line sewer pursuant to subsection 38 of Section 103 of the charter of the City of Rochester. The following petition by a number of residents in the l locality mentioned, was read, and President Liddle referred the same to the Police Committee, and requested that the Mayor and Chi,f of Police serve in the consideration of this petition: "We, the undersigned owners and occupants of property situated north of the C.& N.W.R.I.tracks and between Second Avenue Northwest and Second Avenue Northeast, respectfully petition your honorable body to take whatever steps may be necessary to give adequate police protection using a patrolman for patrol,duty instead of the police squad car system now in effect." An invitation for attendance at the Minnesota Tax Conference to be held in Saint Paul, Minnesota, March 9th and 10th,1933, was read, (� and President Liddle ordered that the same be placed on file. Lysne, for a license to carry on° I the business of house moving for a period of one year commencing on the 23rd day of February,1933, and ending on the 23rd day of February,1934, was read, and a motion by Miller, second by Hicks, that the said license be not granted, carried by all voting in factor thereof. Upon motion by Hicks, second by Amundsen, that the said i resolution be adopted as read, and all voting in favor thereof, President " Liddle declared the said resolution duly passed and adopted, Alderman Hicks introduced a resolution appropriating $872,00 :'eft from the Park Improvement Fund and ordering payment made to the Mayo Trust Fund, for payrolls for labor during the period of the weeks ending .: January 27th,1933, February 3rd,1933, February 10th,1933 , and February i 17th,1933 , which was -read. i Upon motion by Moody, second by Amundsen, that the said resolu- tion be adopted as read, and all voting infavor thereof, President Liddle declared the said resolution duly, passed and adopted. Alderman Dallman introduced a resolution appropriating 589.41 from the General Fund and ordering payment made to the New City Hall Fond to apply on overdraft, the same being the amount distributed thus far from Public Utility income tax, which was read. Upon motion by Amundsen, second by Hicks, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said res ..lution duly passed and adopted. Alderman Amundsen introduced the following resolution, vihich was read: "WIEREAS I The budget division of the General Fund of the City of Rochester, Minnesota,, for that purpose, has been without sufficient funds for making of temporary transfers, and WIH:RI,AS, To create funds for making of teaporary transfers, the Public Utility Board have made loans from the Public Utility Fund of said City to the said budget division of the General Fund for miscellaneous purposes, by an appro- priation of t1,000.00 made December 20th,1932, and $2,000.00 made February 16,1933,an: "I',FH.-,RLAS, ^he funds so realized by the loand mentioned have been temporarily tra.-sferred to the budget division of the General Fund through which appropriations to the Mayor's Contingent Fund are made, and the said $3.0-00,00 total has been disbursed to Julius J.
