Minutes of a remzlar meeting of the Common Council of the City of
Rochester, 'Minnesota, held in the Council Chambers, in the City Hall, in said City,
l at 2 : 00 o'clock P.M., on March 6th,1933.
Meeting called to order by President Liddle.
Rohl Call. Present: Liddle, Amundsen, Hicks, Miller, Moody.
(Absent: Dallman, Norton.
Upon motion by Amundsen, second by Dicks, the minutes of the
meeting held on February 23rd,1933, were approved.
Alderman Dallman came in at this time and took his Chair.
The application of Adolph Effengham for a permit to move the
�so-called Florence Hotel from its present location on Tot 1 in Block 29, Original
Plat, to the East 90 feet of Lot 3 and the East 90 feet of the South 41 feet of
Lot 4, all in Block 16, in Original Plat, along and upon Third Avenue Southwest,
and the pdtition of Wm. H. Friedell that this permit be granted, were each read.

_om Davis made a plea before the Common Council, that this
'a'he petition of many local residents headed as follows, was
read, and President Liddle ordered that the same be placed on file:

Rochester, Minnesota:
`:.he undersirrned residents, voters and taxpayers of the City of
Rochester respectfully petition your honorable body to ree Lnsider the
petition heretofore filed for permit to move the Florence hotel from
its old location to the new proposed location and respectfully request
that the, application to move said Florence Motel building be granted as
prayed for in the original petition.
If said petition is grantdd it will not only increase the tax-
able value of the property in the city of Rochester but ,will also give ,
employment to a large number of people who will be engaged in the moving
and remodeling and improving said property. "
Upon motion by Hicks, second by Miller, the above mentioned

moving permit was granted to Adol_+-)h Effbngham, conditioned that a bond for 0"5,000,00
shall be filed guaranteeing that upon this building reaching its new location,
mssonry walls will be constructed around it to make it comply with building code
specifications for the construction of a building of that type in that location;
all voting in favor thereof except Alderman Dallman, who voted "Nay".
E. G. Capell e, as a comiiiittee chairman from the Holmes School
Parent Teachers Association, asked for an amendment of the local milk ordinance
that will allow the delivery to citizens of the City of Rochestcr, lMinnesota, of raw

milk not of so-called Grade "A", and insisted upon less rigid inspection
and gra::i_ing to the end that cheaper milk may be furnished, and further
that the spread between the consumer and the producer be reduced by
eliminating overhead, such as milk route duplieations,etc. Rev. Uhlenhopp
talked on the some subject.
Upon motion by Hicks) second by ':ioody, the Chair was requested to
appoint a Committee for the consideration of this matt..r, and President
Liddle accordin.glt- appointed Aldermen r..loody, Norton, and Miller, and the
'milk Inspector as members of such committee.
The report of the City Engineer for tl:e month of }-'ebruary,1933,
showing expenditures from the General Fund for labor of '!'22.60, from
the Street and Alley Fund `"',332.90, from the Sewer Far_d :'h449.25, and from
the Bridge Fund 11.C�, was read, and President Liddle ordered that the
same be placed on file .
The report of the Clerk of the Municipal Court ,for the week
ending February 87th,1933, showing criminal fines collected 'y8.40, civil
fees received A2.35, conciliation court fees 4h1.25, court costs charged
to Olmsted County 110.40, and A5.00 fine Collected and remitted direct to
the Btate Treasurer, was read, and President Liddle ordered that the same
be referred to the City Attorney.
The report of the Milk Inspector, for the month of February,
1933, was read, and President Liddle ordered that the be placed on
file.
The annual report of the City Engincer coverin the period
January 30th,lC.32, to January 27th,1933, was laid before the Cordon Council
and President Liddle ordered that the same be placed on f ile .
The City Engineer's trial balance for February,1933, commencing
January 28th,1933, and ending February 280.,1933, was laid before the
Common Council, and president Liddle ordered that the same be placed on
file.
The report of the City Treasurer for the month ending February
26th,1933, was read, and President Liddle ordered that the same be placed
on file; the said report showing the sum of '!�,336449,34 as being on hand.
The application of A. G. Berndt, for public dance permit at the
Woodman Hall, Mp.,reh llth,18th, 25th, and April lst,1933, was read.,
The application of henri Bakker for a soft drink dealer license
at17 First Avenue Southwest, was read, and upon.motion by Hicks, second
by Amundsen, license was granted.

The following request for substitution of insurance policies
was read and upon motion by Hicks, second by Moody, the transfer requested was
granted: ,

A communication from the League of Minnesota Municipalities
relative to the extension of statutory powers of municipalities to 'permit
the acquisition and op -rating of natural gas distribution systems, accompanied by a
proposed bill, were each read, a-iC., President Liddle ordered that the same be placed
on file.
Legislative bulletin No.S, issued by the League of Minnesota
4unicipalities coim:aenting on the so-called Tax Limitation bill, Senate File 679,
was read, and after a discussion of the .yob jgettonable features set forth therein,
motion by Hicks, second by 14iller, carried that the City Clerk be instructed to req-

he Coamon Council of this City, at a meeting held yesterday afternoon,
discussed the so-called Tax Limitation Bill, Senate File 679, and instructed
me to request of you that you oppose t�)e passage of this proposed Act, as it
will allow those who want to beat the law to raise their values to lower the
will rate, thereby penalizing the municipality by making its tax pa,rtrs assume
wort than their boival share of State and County taxes, while those that hold
their values at normal will suffer the possibilities that the County members
of the edjudting board will take care of their budget first and thus leave the
"dribblings" to the municipality, i.e. whatever else can come under the forty
mills. ,
Another reason why this legislation should not be adopted is that it
would invite the issuance of bonds for budget items that are ordinarily taken
up by tax levy and by so doing me,kL an exemption deduetabl e, thereby permitting
an abnormal increase in some division which could get by owing to the bond issue
"evasion".
Your opposition to this legislation will be

The following copies of resolutions passed and adopted by the
Commissioners of the Sinking; Rund were each read, A.nd upon motion by
Moody, second by Amundsen, the actions set forth therein were each
approved, and it was ordered that the said copies of resolutions be placed

"Be it res..lved by the Commissioners of the Sinking Fund of
the City of Rochester, Minnesota:
That the sum of 11005,70 is hereby appropriated from the Sinking
Fund of said City, and it is ordered that the sold sum be paid to the
General Fund of said City, for the purchase of one City of Rochester,
Minnesota, 41- Certificate of Indebtedness, dated February lst,1933, and
maturing February lst,1934; `$,1,000.00 of the said sum being for principal
on the said certificate of indebtedness, 412.44 premium and .4,.3:26 accrued
interest; the said appropriation being made AW4.27 from Code 8 of the
Sinking Fund., and `�1001.43 from Code 9 of the Sinking Fund."
"Be it resolved by the Commissioners of the Sinking Fund of the
City of Rochester, I-Ainnesots:
That the sum of `"12985.45 is hereby appropriated from the Sinking
Fund of said City and it iv ordered that the said sum be paid to the First
National Bank of Rochester, Minnesota,, for 112,000.00 City of Rochester,
Minne:=ota, 5�1t Electric Light bonds maturing July 1,1941, purchased from
Piper, Jaffra,y RF Hopwood, of Minneapolis, and forwarded thru the said First
National Bank; 11?12,000.00 of the said sum being for principal on the said
bonds, 835.45 being for premium on the said bonds, and "150.00 thereof
being for accrued interest to march 31st,1933.
This appropriation being made from the following budget divisions
of the Sinking Fund: '.fi10696.20 from Code 23, `1.125.00 from Code 24,
�21139.25 from Code 25, and `�.25.00 from Code 26."
The appointments by the Mayor of Carlton E,. Anderson, as a
(Special Patrolman February 27th,1933, to ;,;arch 5th,1933, and of William
IlWilde as a Special Policeman for duty at the Franklin Heating Station

�lin April,1935, unless sooner,removed, were each'read, and President Liddle

Copies of requisitions made by the Health Officer upon Saint
ry's Hospital, for the isolation of Mrs. Ida Nelson, diag:ilosed to be a
diphtheria carrier, and of Mrs. Christine Johnson, d.�_bf;nosed to .be a
diphtheria carrier, were each read, and President Liddle ordered that the
same be placed on file; both of said perc:ons being residents of the
orrall Hospital.

reference as to hours that he shall be on duty for furnishing gasoline.

for financial assistance in the operation of the City Farm, and the Chair was requested
to appoint a committee for investigation into the operation of the City Farm.

Alderukin Amundsen introduced a resolution granting public dance
permit to A. G. Berndt,, for the Woodman Hall, March llth,18th, iLnd 25th,. and April

Upon motion by Amundsen, second by Miller, thatthe said resolu-
tion be,adopted as read, and all voting in favor thereof, President Liddle declared

Alderman Dallman introduced the following resolution,which w;as
read:
"Whereas, The Wm. T.MeCoy Post of the American Legion No,,92 cf
Rochester, Minnesota, has heretofore made application for a franchise to conduct
boxing exhibitions in the City of Rochester under and in accordance with the provi-
sions of the Statewide boxing law recently passed by the Legislature of the State of

Alderman Miller introduced the following resolution, which was
read:

tion be adopted as read, and all voting in favor thereof, President Liddle
