7��eeting called to order by President TAiddle.
Roll Call. * Present: Liddle, Amundsen, Dallman, flicks, Miller,
goody, Norton. Absent: None.
Upon motion by Dallman, second by Amundsen, the minutes of the
meetin,� held on :larch 15th,1933, March 21st,1934, and lk_!Iarch 27th,1933, were each
approved.
President Liddle announced this as being the time and place fixed
for hearing on the sprinkling of streets and avenues and alleys during the season
of 1933, and asked if'there was any person present who wished to be heard on the
subject.
'_here was no person.present who wished to be heard, but four
different remonstrances and one petition were read; the said petition being a
request that the sprinkling of Eighth Avenue Southeast, between Eleventh Street
and �_'welfth Street be continued; one of the remonstrances being against the sprink-
ling of Sixth Street Southeast between Ninth Avenue ayd Tenth Ava-,zue; another
remonstrance against the sprinkling of,Ei;hth Avenue Southeast between Eleventh
Street and 'welP.th Street; another. against the sprinkling of Ninth Street Southeast,
`. ;nth Street Southeast, and the intersecting avenues; and one against the sprink-
ling of ':tenth Avenue Southeast between Fifth Street and Sixth Street.
President Liddle referred the above mentioned remonstrances and
petition to the Sprinkling Committee.
Upon motion by Hicks, second by 'Moody, the hearing and action
on sprinkling and treating of streets and avenues during,the season of 1933 was
adjourned and continued to 2 : 00 o'clock P.M., April 3rd,1933.
C'his being the time and place fixed for the opening of proposal
fcr the furni^hing of 180 tons to 300 tons calcium chloride, the following proposal
were opened and read;
Hayes-Lacas Lumber Co.npany,-$27.14 per ton;
Columbia Alkali Corporation, `y27..10 per ton, with 'b.21 deductioi
for paymbnt in ten days, together with an offer to pay 2b% on the F.O.D. works
price Barberton, Ohio of ;20,50 per ton to the Aiilerican Legion Welfare Fund, at
Rochester, ..lianesota, in lieu of the coamission ordinarily, paid to a local
representative;
payment in ten days;

President Liddle referred the .above mentioned quotations
to the City ,Engineer for his tabulation and recominendations.
Mrs. Don. F. Postier asked that the Ladies Auxiliary.:: of the
Veterans of Foreign Wars be given permission to sell"Buddy" popr;ids
on the streets of the City of Rochester, Minnesota,, May 27th,1933, and upon
motion by Moody, second by Dallman,the permission requested was granted.
This being the time and place fixed for the opening of
proposals for the purchase of the. 1,000.00 City of Rochester, Minnesota,
4-4N certificate of indebtedness, the following proposals were opened and
read:

Iftrgaret K. I:ennedy, par, and a premium of �'2.50 or a. 4%
Sinking Fund Commission of Rochester, Minnesota, par and
a premium of fi>1.39, or a 4,10% basis.
Alderman. Dallman introduced a resolution selling the above
Imentioned certificate of indebtedness to Mrs, Margaret K. Kennedy, for par
and a '�!2,50 premium, which was read.
Upon mction by Hicks, second by Dallman, that the said
resolution be adopted as read, and all voting in favor thereof, President
IlLiddle declared the said resolution duly passed and adopted.
Upon motion by Hicks, second by Dallman, it was ordered
that the check' filed by the unsucZessful bidder be returned to them,
Joe Fakler,for the Veterans of Foreign Wars, asked for the
se of the Sewage 'Disposal Plant grounds for gardens for the unemployed of
he City of. Rochester, and that the City Engineer be authorized and directed
o plow these grounds a,t'eity expense, at which motion by Hicks, second by
mmridsen, darried that'the use of the sewage disposal plant grounds be
iven'over for the purpose stated during 1933, -and that the City Engineer
e authorized to plow t'^use grounds at City expense.

Dr. Geo. B. Eusterma.n., presented and read an Izaak Walton League
Committee report on the pollution of the Zumbro River, with special reference to waste
petroleum products.
A resolution passed Vy the Izaak Walt'on Tieamie protesting the
pollution of the'Zumbro River, was read.
A comrminication yvas presented and read by Irving T-i. Ekholdt
referrin7 to the local ordinance prohibiting pollutioh and to the Minnesota Law in
that regard.
A recommendation by the Chamber of Commerce Com;Attee on the,
matter of a trunk line sewer construction, was read.
'resident Liddle ordered that these co,f;munications and
report- be placed on file.
Upon .Notion by Eicks, second bar Dallman, a, request was made of
the Cha r that a Cor.;rrlittee be appointed to work in conjunction witli the Izaak Walton
r_,eap,ue Pollution Committee, Dr. Geo.B.Eustepwan, Irving L. Ekholdt, Earl E. Wocdhous(
and Rex R. Robinson, Ex-Officio, and President I.,lddle accordingly appointed
Aldcr_A.n Moody, Amundsen, and Miller, b,s members of` the said Committee, to act
in consideration of the enforcement of the local ordinance r-�;(ld state lairy prohibiting
the pollution of the Zumbro River with waste oils from garages, and filling stations,
Charles Dzialdowski, as spokesman for the delegation from the
Unemr;lo�ed Council th:;.t yrere before the Common Council, stated that his organization
is "not so hot" for the construction of the proposed trunk line sewer but that they
willnot oppose -it except that there is a, discrimination in the distribution of the
labor involved.
Joe Cooley expressed himself' as bej.nC1 6-;:.posed to h-:ving John S.
Reed desi:cnate -who shall work on City, County, or State projects.
Claude A. Johnson discoursed against the'..Aayor's proposed scrip
stair) tax money s,nd pointed out that it amounts only to a sales tax that would have
to be absorbed by the laboring man who reeeivea the scrip for his services in that
he has to -,Race the first stamp on the scrip before the exchange for his necessities
can be made if he is successful enough to find a business men that will take it at
all.
The report of the City Weig;hwaster :for. February,1933, showing
156.20 collected, was read, and President Liddle referred the same to the Finance

The report of the Clerk of the ldunic ipal Court for the week

The FebruarV,1933, report of the Building, Electrical,
and Plumbing Inspector, showing `.,15.00 building inspection fees collected
";fi3.50, electrical inspection fees, and fi3.50 plumbing inspection fees,
was read, and President Liddle referred the same to the Fin,�,nce Committee.
The. City Engineer report on the above mentioned proposals
for furnishing ez-!,leium chloride . . in which he stated that
Hayes -Lucas is low by 5 cents per ton, and that the City of Saint Paul
purchased calcium chloride for .'26.60 per ton in 25 ton lots for the
season of 1933, was read, and President Liddle ordered that the same be
placed on file.
Upon motion by Norton, second by Amundsen, each of the above
mentioned proposals for furnishing calcium chloride were rejected and it
was ordered that the certified checks filed by each bidder be returned
t o him.
The application of Mirs. ?Raude Van Kirk, for public dance
permit at the A.O.U.W.Hall, April 13th,1933, �:nd of E .A .Rq.e, for public
Dance Permit at the Woodman Ball, April 5th,1933, were each read.

second by Dallman, license was granted accordingly.
Summons &'Complaint of William D. Esneland, vs. City of Rochester,

costs were each read, and President Liddle referred the saine to the City Attorney.
The appointment by the idayor of Mrs. Mabel Fountain as Public
Health Nurse for the period ending on the second Monday in April,1934, was read, and
President, Liddle ordered that the same be placed on file.
'.-Phe appointment Vy, the Mayor of Carlton E. Anderson, as a
Special Patrolman March 21st,1933, to March 27th,1933,inclusive, and March 28th,
1933, to April 3rd,1933,inclusive, were each read, and President Liddle ordered
that the saine be placed on file.
A communication from the Industrial Commission of Minnesota
re la,t ive *t o the taking out of permits for wrecking and razing of buildings was read,
and Presidey_t Liddle ordered that the same be placed on file.
The City Clerk reported that John J. Kerr had placed in his
hands results of his work as Field Engineer in making record of the natural gas
installations, as to the location, elevation, etc., and asked if it was the wish of
the Common Council that these records remain in the custody of the Mity Clerk, at
which motion by Moody, second by Norton,carried that these records be turned over to
the City Engineer;
The City Clerk called attention of the Common Council to the
fact that the Tri-State Telephone & Telegraph Company, under the Railroad and Ware-
house Commission order, should not charge $.25 per month rental for the se -called
French style telephones, after they have been in service one year, and read
clippings on the subject from the Pioneer Press issue of March 17th,1933, and March
28th101933 .
The City Clerk asked for consideration of furnishing the City
Clerk's office with a set of plats for assessment work,etc., in that the City
Engineer's department have retained everything of that kind since the separation of
the Clerk 'and En.rrineer offices.
The City Clerk reported the payment by the Franklin Heating
Station of 1145.76 as being one-half cent per thousand cubic feet on 29,151,000 cu.
feet of natural gas used during February,1933.
A telegram from Ambrose Fuller asking for support of HouBe Fi!_e
1675, and Senate File 1614, which are bills providing for sewer service rentals, was

read, and upon motion by Hicks, second by Norton, the City Clerk was
instructed to ask Senator Richardson., and Representative McIntosh, that

Ninth Street Northwest, diagnosed to be suffering from diphtheria, was

A communication from A. N. Anderson, City Ticket Agent .
for the Chicago Great Western Railroad Co., in regard to the '"4,20 account
against the said Company for pumping waster out of the depot basement, was

Mayo Trust, Fund for Payrolls for labor during the period of the weeks

Upon motion by Amundsen, second by Moody, that the 'said

Alderman De.11man 4ntrodueed the following resolution, which
was read:

Alderman Dallman introduced a resolution authorizing r+, d
directing the City Clerk to a,djust his stock records and
inventory records to conform to the suppliers and equipment shown on the

Upon motion by Amundsen, second by Miller, thrlt the said
resolution be Adopted as read, axrl all voting in .favor thereof, President,

Alderman hicks introduced a resolution levyinrt special
assessments for scavenger service, which was read.

Alderman Moocy introduced the following; resolution, which
was read:
"VMEREAS, John C. Brumm was injured on the 25th day of December,
193? while in the ejaploy of the City of Rochester as a laborer at a weekly gage of
024.00 under a Minnesota contract of hire, and,
WIIRRLAS, said injury as sustained is an actual injury arising
out of and in the course of his employment, and
WH R' AS, the healing period of twelve weeks was necessary to heal
the injuries received and a hospital bill of $76.25 and a doctor bill of 075.00,
were incurred and the said John C. Brumm was required to pay the sum of $2.50 for
crutches because of said injury.
'.'IP I'LPORE, Be it resolved, by the Common Council of the City
of Rochester, Minnesota that the sum of 1194,50 be and the save is hereby appropriate
to John C. Bruwm as reimbursement for sum paid for crutches and as compensation for
twelve weeks at the rate of 116,00 per week; that the sum of 076.25 be appropriated i
to the Colonial Iospital as and for payment in full of the hospital bill on account o'
said injuries and that the sum of &' 75„00 be appropriated and paid to the Mayo Clinic
as and for payment in full df the medical expense in connection with said injuries.
All of the aforementioned appropriations to be from the sewer fund of said city. The
.Ay -or and City Clerk of said City of Rochester are hereby directed to draw warrants
on the city treasury in accordance herewith and to cause said payments to be wade."
Upon motion by Moody, second by Amundsen, that the said resolutio
be adopted as read, and all voting in'fa,vor thur;;of, President Liddle declared the
said resolution duly passed and adopted.
Alderman Amundsen introduced the following resolution, which was
read
"WIEREAS, the sanitary sewer system running north and south on
Broadwgy Street, North and South in the City of Rochester, Minnesota how is and
for some time past has been in need of rebuilding; and,
WH::REAS, there are not sufficient moneys in the sewer fund of
the said city for the purpose of paying for said improvement, and, {
WHEREAS, the ,_:ublic utility board of said city has a surplus i
fu; d over and Rbove all necessary reserves for additions, extensions and betterments,
and.,
WH: R-,;AS, the attorney general of the state of Minnesota has on I
two different occasions ruled that such surplus funds of the public utility board may

legally be used for the purpose of paying any government improvement, and
WHl:RFAS, the estimated cost and expense of the aforementioned
improvement will be one hundred thousand dollars,
11',HLREPORE, BE IT RESOLVED, by the Common Council of the City of
Rochester, Minnesota, that said Common Council does hereby request the public utility
board of said city to immediately make available for the aforesaid purposes the sum
of one hundred thousand dollars out of its surplus funds and.eause same to be trans—
ferred into the Sewer fund of the City of Rochester"

upon motion by Uick_s, , second by Dallman, that the said
resolution be adopted as read, and all voting in favor thereof except
Aldermen ';400dy and Norton, who voted,"Nay", President Liddle declared the
said resolution duly passed and adopted.
Alderman Dorton introduced the following resolution, which
was read:
"WHI!;RT;AS, the Tri-State Telephone Company and the northwest
Bell Telephone Company have filed an application with the Minnesota Railroad
& Warehouse Coiunission to transfer the common stock of the Tri-State Tele-
phone Company, and,
WHIERFAS, a number of protests have been filed with said
{commission rcgtiesting that the commission do not approve the transfer, and
V .-U."P AS, the Common Council of the City of Rochester,
Minnesota contends that the amount of stock to be issued after such
transfer and consolidation would be more in the aggregate than the ,ctual
value of the property involved And for that reason objects to said transfer
and consolidation.'
THFREFOR-E, BE IT PFSOLVED, by the Common Council of the
City of Rochester, Minnesota that said Common Council do protest the
approval by the Railroad & Warehouse Commaission of the transfer and con-
solidation applied for bee?,use of the reasons hereinbef ore stated, and
further that said Common Council do urge the Railroad & Warehouse Commission
to -appear before the Interstate Commerce Commission for the purpose of
opposing the proposed transfer add consolidation.
BE IT "URTHER RESOLVED, by said Common Council that the City
Clerk of the City ciT Rochester be and he is heraby crdt;red and directed to
mail a copy of this resolution to the Railroad & Warehouse Co:;mlission to
Senator IT,.% B. Richardson and Representative J. A. Ma,cIntosh and urge upon
them their attendance at the public hearing before the Railroad & Warehouse
Commission to be held at 10:00 o'clock, A.M. on Friday, April 7, 1933 for
the purpose of opposing such transfer and consolidation."
Upon motion by Hicks, second by Dallman, that the said
resolution be adopted as read, and all voting in favor thereof, President
Liddle declared the said resolution duly passed and adopted.
President Liddle at this time excused Aldermen Dallman who
left the Council Chambers,
Walter H. Newsome talked against the use of cement blocks
for chimney construction and cited personal experiences which show theip to
be a fire. hazard, and President Liddle referred his complaint to the
Building Inspector.
Alderman t.Jloody complained of a cellar excavation that has
been left open near the intersection of Thirteenth Avenue Southeast and Sec -
and Street Southeast and President Liddle referred the matter to the Build-
ing Inspector.
