IIMinutes of an adjourned regular meeting of
the Co-rnnon Council of ty).e City of Rochester, Minnesota, held in the
Council Chambers, in the City- ?'all, in said City, at 7: 30 o'clock P.M.,
on April 10th91933.
Meeting called to order by President, Liddle,
Roll Call: Present: Liddle, Amundsen, Dallman,
Nicks, Miller, Moody, Norton. Absent: None.
Upon motion by Dallman, second by Amundsen, the
minutes of the meeting held on March 30th919339 were approved.

and continued hearing and action on the sprinkling/of streets during

1933, further consideration was given to that matter and it was decided_
that the situation in Southeast Rochester as to opposition against and

requests for that service there be decided by the circulation of petitions
and remonstrances, at which motion by Moody, second by Norton,carried that
further hearing on and action on the sprinkling and treating of streets
and avenues for the current year be adjourned and continued until the
next meeting of this Common Council, that is, after the above mentioned
petitions and remonstrances have been filed for action of the Common Council.
Alderman Amundsen introduced the following resolution
which was read:
"Be it resolved by the Common Council of the City of
Rochester, Minnesota:
n .
That the Rochester Post -Bulletin be and the said
r newspaper is hereby desi giated as the .official newspaper of the City of
Rochester, Minnesota, for and during the ensuing official year, and the
Mayor and City Clerk are authorized and directed to execute a contract
in accordance with their proposal of April 3,1933."
Upon motion by Moody, second by Dallman, that the said
- resolution be adopted as read, and all voting in favor thereof, President
i Liddle declared the said resolution duly passed and.adopted.

Upon motion by Hicks, second by Dallman, the Mayor's

veto and the resolution passed and adopted by this Common Council April 3rd,
19339 fixing wages to ,be paid by the Street & Alley Committee and the
j, City Engineer, were taken from the -table' at which President Liddle put

the question, "Shall this resolution be adopted :�-,(Jotwithstanding the
Mayor's vetg2" .
The vote on ouverriding the Mayor' s veto was
unanimous, and President Liddle declared the said resolution adopted
thereby.
The following communications. relative to milk
ordinance amendments were read, and President Liddle referred the same to
the special Committee for Milk Ordinance consideration, namely Aldermen

Moody, Miller, and Norton,and the Milk Inspector:
*We, the undersir*ned, recommend that the present milk ordinance be
amended and urge the adoption of the following amendment:
That raw milk with a bacterial count of less than fifty thousand
bacteria per c.c., produced from healthy cattle by people with no
communicable diseases and under reasonable sanitary conditions may be
sold within the confines of the city of Rochester. Reasonable, in this
ordinance, is to be interpreted as, utensils and containers free from
infectious bacteria or filth. Barns free from unnecessary filth. Pro-
ducers must agree to submit to periodic health examination by the
Health Inspector. Premises, equipment, and cattle of producers shall
be subject to inspection at any time by the ,Milk Inspector.

Gentlemen:
A special committee of the Rochester Chamber of Commerce
appointed to make a study of the Rochester Milk Ordinance held a
meeting on Monday, April 3,1933. After hearing from persons favoring
the retention of the ordinance as it now stands and from persons who
are objecting to the' ordinance, the committee voted unanimously to
recommend to your body that the present Milk Ordinance be retained.
This ordinance has been in operation in Rochester for eight
years and although it is not a perfect law it is modeled after the
best practices in this country. Since its adoption, several cities
in this and other states have modeled their milk ordinances after it,
chiefly because it contained a fair opportunity to all concerned to
come under its terms.
The law is aimed at only one thing. When a municipality
undertakes to regulate the parity of foods, such as milk sold within
its boundaries, it assumes a moral if not a legal responsibility for
the safety of the product, and citizens have a right to expect a
reasonable standard of purity to exist in such foods sold. The law
was made as strict as is consistent, with practicability, and still
furnish a fair standard of purity for the product. Although the law
is couched in legal phrases, it provides simply that the milk to be
used for drinking shall have come from farms following common sense
sanitary principles, that the cows shall be healthy, the milkers not
suffering from contagious diseases, and that the milk shall be cooled
to prevent the growth of harmful bacteria. The bacterial count is
simply an, indication of the general cleanliness of the milk.
We urge that the City Council in order to protect the health
of its citizens keep the present ordinance in effect.

Upon motion by Norton, second by Moody, the special

committee mentioned above was given further time in which to make their

The annual report of the Public ,Ut ility Board for
a
the fiscal year ending March 31st919339was laid before the Common
Council and President Liddle ordered that the same be placed on file;
the said annual report showing a net profit in the Light Department
for that year of $92,130.03, in the Water Department $30,149.04, and
a
in the Steam Heating Department $$760.36.
The .report of the Clerk of the Municipal Court for
the week ending April 10th,1933, showing criminal fines collected $15.00,
IIcivil fees received $12.20, conciliation court fees received "1.50, and
, court costs charged to Olmsted County $17.70, was read, and President
Liddle referred the same to the City Attorney.
The report of the Building,Electrical and PlumbIng I
Inspector for the month of March,1933, showing building inspection fees
collected $40009 plumbing inspection fees $5.259 and electrical inspec-
tion fees $79259 was read, and President Liddle referred the same to the
Finance Committee.
The report of the City Engineer for the month of
March,1933, showing expenditures from the,Generalfund for labor in the
amount of $ 204.009 Street and Allcy Fund $1760.659 Sewer Fund $196.751,
aid Bridge Fund. $25.50, was read, and President Liddle ordered that the
same be placed on file.
The Marcb.1,1933 report by the Health Officer for the
City Farm, showing receipts in the amount of $1711.40, disbursements
e,570.76 and a balance on hand $37.91, was read, and President Liddle
ordered that the same be placed on file.
The report of the City Weighmaster for the month of
March,1933; showing $55030 collected for March and $.30 for October,1932,
was read, and President Liddle referred the same to the Fin.c,,,nce Committee.
The City Engineer's trial balance for March,1933, was
laid before the Common Council, and President Liddle ordered that the

same be placed on file.
The application of Chamberlain Brothers for two
vendors licensed covering the operation of pop corn and peanut wagons,
one at the northwest corner of the intersection of Broadway Street South
and First Street Southwest, 'and the other at the northeast corner of the
intersection of Broadway Street South and Second Street Southeast, was
read, and upon motion by Hicks, second by Miller, licenses were granted at
$100.00 each per year.

The application of Leonard Gilday for license to operate a pop
corn vending wanon on the boulevard north of the premises known as No.302 Broadway
Street South, was read, and upon motion by Dallman, second by Hicks, license was gra
ted at a fee of $100.00 per year with the occupancy of that location to b�e under the
supervision and approval of the Street & Alley Committee and the Chief of Police.
The application of E. A. Rae, for public dance permit at the
Woodman Hall April 12th,1933, was read.
The application. of the Rochester Electric Company for an
electrician's license was read,. and upon motion by Hicks, second by Dallman,
license was granted, covering the period April Bth,19339 to April 7th,1934.
The electrician's license bond of the Rochester Electric Com-
pany, with the Saint Paul Mercury Indemnity Compa4 as surety thereon in the amount
of $1,000.00 was read, and upon motion by Hicks, second by Amundsen, the surety
was accepted, the said bond was approved, and it was ordered that the same be placer
on file.
The application of J. J. Fitzgerald .for a plumber's license
was read, and upon motion by Amundsen, second by 'Ticks, license was granted covering
the period April l0th,19339 to April 9th,1934.

A petition asking that Second Street Northeast, from the
east line of Eleventh Avenue Northeast to the east line of Fourteenth Avenue
Northeast, and Fourteenth Avenue Northeast, from the north line of Third Street
Northeast, to the South line of Second Street Northeast, be each graded to an
established grade line and to a width of thirty (30) feet, was read, and President
Liddle referred the same to the Street & Alley Committee and the City Engineer -
The application of Emanuel Kostakes for a license to operate
6 pool tables at No.116 Broadway Street South, was read, and upon motion by Dallman,
second by Hicks, license was granted.
The applications of Fred W. Oesterreich for license to operate
7 pocket billiard tables and 3 carom billiard tables at 9 Broadway Street South, and
5 pocket billiard tables and one carom billiard table at 322 Broadway Street South,
were each read, and upon motion by Dallman, second by Moody, licenses were granted.
The application of Ray Basset for a solicitors license was
read, and upon motion by Moody, second by Amundsen, license was granted.
The application,of W. R. Morgan for a solicitor's license
was read, and upon motion by Miller, second by Moody, license was granted:
The following applications for licenses to sell soft
drinks were each read, and upon motion by Moody, second by Amundsen,
licenses were granted: Louis Precht, Harry Drosos, Anna Ebenhoh, Bernard
G. Mayou, Albert F. Spiess, Emanuel Kostakes, W. T. Grant Co., Bourassa
Bros. (2) , Lillian Scherer.
The application of James L. Adams for an "Off Sale"
license to sell non -intoxicating malt liquors from the basement of
6-•10 Second Street- Southwest, was read, and upon motion by Dallman,
second by Amundsen, license was granted.
The applications of Weber & Judd Company, Louis
Precht, Anna Ebenhoh, Security Hotel Company, Max T-Targesheimer (2) ,
Emil Angelici, and C. J. Zemke .for "Off Sale" licenses to sell non -
intoxicating malt liquors, and the applications of Weber Judd Company,
Louis :'recht, Anna Ebenhoh, and the Fotel Arthur Company for "On Sale"
licenses to sell non -intoxicating malt liquors, were each read, and upon
motion by Dallman, second by Moody, licenses were granted.
The applications of the Yellow Cab Company for four-
teen taxicab licenses, the applications of John C. Adams ("'own Taxi) for
six taxicab licenses, and the application of Richard ".o lland, for one
taxicab license, were each read, and upon motion by Amundsen, second by
Hicks, licenses were granted.
Upon motion by Norton, second by !Doody, the City .
Attorney was instructed to notify the Rochester Bus Line that they shall
stop operations until they comply with the City Charter and local ordin-
ances relative to filing their 1932 operation statement.
Upon motion by Dallman, second by Amundsen, Walter E,
Dodge was appointed a member. of the Firemen's Civil Service Commission.
to hold office until the second Monday in April, 1936.
The following copy of resolution passed by the Public
Utility Board was read, and President Liddle ordered that the same be

"Be it and it is hereby resolved by the Public Utility
Board of the City of Rochester, Minnesota that the following employees
be appointed or re -appointed to their respective positions for one year
beginning April first 19339 at the rate of the following salaries, subject

Your letter of April 4th addressed to Minnesota Northern
Natural .Gas Company at our Rochester office has been handed to me for
attention.
We note that Section 291 of the City Charter as well as
Ordinance #320 require that all corporations exercising any franchise in
the City of Rochester shall file an annual report duly verified, setting
forth in detail the actual cost of the plant, incumbrance, debts and obli-
gations, if any, the amount of stock issued, the gross earnings, the
expense and net income, and the amount of outstanding stock of such corpora-
tion.
This is the first time that this matter has been called to
the attention of the writer, and not having familiarized myself ;:*ith your
Charter or your city Ordinances with respect to the. above matters, we had
no previous knowledge of this requirement. However, we will immediately
prepare report in compliance with your Charter and Ordinances and file the
same as soon as completed..
May I inquire whether or not you have any forms for these
reports, and if so will you please forward to the writer such forms for our
uset If you do not have such forms, I presume that we can draw it in any
form provided it covers the subject matter enumerated in the Ordinance.
Will you please be kind enough to give me an immediate
reply?

Dear Sir:
The sprinkling assessment for the year 1931 in the amount
of $$4.89 was levied against Lot 29 Block 19 Ireland's Addition. The
whole of this lot has been taken for highway purposes and though Mr.
Ireland paid the first half of the 1931 taxes the last half of the
general tax was cancelled by order of the Minnesota Tax Commission,
but the sprinkling tax of $2.49 is still delinquent.
Will you kindly take this matter up with your Council to
see whether or not they would appropriate this amount in order that this
delinquent tax may be dropped.
Also Chapter 989 Laws of 1933s provide for the payment of
1931 taxes without penalty and for the refundment of any penalties
already paid.
Included in your November ,1932, Settlement was an item of
$421.94 for penalties on 1931 taxes. Will you kindly refund this amount
in order that we might set up a fund for the refunding of penalties.

The claim of Saint Mary's Hospital $160.00 for the isolation
of Arthur Anderson 1415 Ninth Street Northwest, as a diphtheria patient, February
15th,1933, to March 27th,1933, was read, and upon motion by Norton, second by Hicks,
the sum of $100.00 was appropriated from the General Fund and it was ordered that
the said sum be paid to the Sewer Fund of said City to apply on Saint Mary' s Hodpit
account for share in operation of the sewage disposal plant.
Data from Evanston, Illinois, relative to the tax anticipa-
tion warrant sales plan in operation there, was laid before the Common Council,

Alderman Moody introduced a resolution granting public
dance permit to E. A. Rae, for the Woodman Hall April 12th,19339 and
fi Ming the fee at MOO, which was read.
Upon motion by Dallman, second by Amundsen, that the
said resolution be adopted as read, and all voting in favor thereof,

Alderman Moody introduced a resolution appropriating
$226.08 from the General Fund and ordering payment made -to City of
Rochester,Steam Heating Department, for steam heat furbished at the City
Hall during the month of March919339 which was read.

Upon motion by Moody, second by Dallman, that the said resolu-
tion be adopted as read, and all voting in favor thereof, President Liddle declared
the said resolution duly passed and adopted.
Alderman Miller introduced the following resolution, which
was read:
"WHEREAS, Chapter 98 of the Laws of 1933 provides for the
payment of 1931 taxes without penalty and for the refundments of any penalties
already paid, and
WHEREAS, In the November,1932 tax settlement, the City of
Rochester, Minnesota, received 0421.94 for penalties -on 1931 taxes, 'S400.15 of which
was credited to the General Fund of said City, and $21079 of which was credited to
the Permanent Improvement Revolving Fund of said City,
SO THEREFORE, Be it resolved by the Common Council of the
City of Rochester, Minnesota:
That the sum of $$400.15 is hereby appropriated from the
General Fund of said City, and $21.79 is hereby appropriated from- the Permanent
Improvement Revolving Fund of said City, and it is ordered that ti_e said sums be
paid to the Auditor of Olmsted County, Minnesota, as refundment of the above
mentioned 1931 tax penalties as provided for in said Chapter 98 of the Laws of
1933, and
Be it further resolved by the said Common Council: That the
sum of $2.49 be and the said sum is hereby appropriated from the General Fund of
said City, and it is ordered that the same be paid to the Treasurer of Olmsted
County, Minnesota, as the last half of a 1931 sprinkling assessment levied against
Lot 2, Block 1, in Ireland's Addition, the said lot having been taken for State
Highway purposes after the owner thereof had paid the first half of the said sprink-
ling tax.
The Mayor and City Clerk are hereby authorized and directed to
draw wa:t.,rants upon the City Treasurer in accordance herewith and make payments
accordingly."
Upon motion by Dallman, second by Amundsen, that the said
resolution be adopted as read, and all voting in favor thereof, President Liddle
declared the said resolution duly passed and adopted.
Alderman Miller introduced the following resolution, which
was read:
"Be it resolved by the Common Council of the City of Rochester,
Minnesota:
That the sum of $$247.96 is hereby appropriated and it is ordere
that the said sum be paid to the City of Rochester, Light and Water Departments for
electricity and water furnished to public buildings in accordance with billings of
March 25th,1933; $167.36 thereof to be from the Lighting Fund, $$26.15 from the
General Fund, $$6.06 from the Street & Alley Fund, and $26.37 from the Fire Protection
Fund.
The Mayor and City Clerk are hereby authorized and directed to
draw warrants upon the City Treasurer in accordance herewith and make payments
accordingly."
Upon motion by Amundsen, second by Moody, that the said
resolution be adopted as read, and all voting in favor thereof, President Liddle
declared the said resolution duly passed and adopted.
Alderman Norton introduced a resolution approving the salaries
to be paid by the Public Utility Board in accordance with their above quoted resolu-
tion, which was read.

Alderman Hicks introduced the following resolution,
which was read:
"Be it resolved by the Common Council of the City of
Rochester, Minnesota:
That the •$2409000.00 securities deposited by the First
National Bank of Rochester, Minnesota, with the Federal Reserve Bank of
Minneapolis, Minnesota, as shown by their receipts dated June 20th,19329
and Julp 13th91932 , be and the same are hereby continued as collateral in
lieu of a City depository bond covering the said First National Bank of
Rochester, Minnesota, as a City depository for 1,2009000.00 which designa-
tion was made by the Common Council of said City, April 3rd91933, and
Be it further resolved by the said Common Council:
That the City Treasurer of said City is hereby authorized and directed to
9lace $150,000.00 in the First National Bpnk in Savings account and
60,000.00 in the said First National Bank in an open deposit account for
the purpose of disbursement. and for paying of warrants drawn upon the City
Treasurer of said City, with the interest rate thereon to be as set . forth
? in their proposal of April 3rd,1933. "

said resolution be adopted as read, and all voting in favor thereof, Presi-

Alderman Amundsen introduced the following resolution,
which was read:
"Be it resolved by the Common Council of the City of
Rochester, Minnesota:
That the $729000.00 securities deposited by the Union
National Bank of Rochester, Minnesota, with the Federal Reserve Bank of
Minneapolis, Minnesota, as shown by their receipts dated February 25th,
1933, be and the same are hereby continued as collateral in lieu of a City
depository bond covering the said Union National Bank of Rochester, Minne-
Isota, as a City depository for $509000.00, which designation was made by
,the Common Council of said City April 3rd91933, and
Be it further resolved -by the said Common Council:
That the City Treasurer of said City is hereby author-ized and directed to
place $50,000,00 in the said Union National Hank of Rochester, Minnesota,
in Savings Account with the interest rate thereon to be as set .forth in
their proposal of April 3rd91933."a

11 Alderman Dallman introduced the following resolution,
which was read:
"Be it resolved by the Common Council of the City of
Ro chest er,Minnesota:
That the $27,500.00 securities deposited by the Olmsted
County Bank & Trust Company of Rochester, Minnesota, with the First National
Bank of Minneapolis, Minnesota, as shown by their receipts No.6167 dated
April 16th,1931, and No.7126, 30126 dated May 7th,1932, be and the same are
hereby continued as collateral in lieu of a City depository bond covering
the said Olmsted County Bank & Trust Company as a depository for $25,000.00
City of Rochester funds under the desiation made by the Common Council of
said City April 3rd,1933, and

Be it further resolved by the said Common Council: That the
City Treasurer of said City is hereby authorized and directed to place $251,000.00
in the said Olmsted County Bank & Trust Company of Rochester, Minnesota, in savings
account with the interest rate thereon to be as set forth in their proposal of

Alderman Amundsen introduced the following resolution %,xhi ch
was read:
"Be it resolved by the Common Council of the Cityof Rochester,
Minnesota:
That the sureties on the City Depository Bond of the Rochester
Loan & Trust Company of Rochester, Minnesota, for double the sum of $50,000.00
dated April 8th91933, be and the said sureties on the said bond are hereby accepted
and the said bond is hereby approved and ordered placed on file in the office of the
City Clerk of said -City; said bond being submitted, accepted, approved and ordered
filed under and in accordance with the proposal of the said Rochester Loan & Trust
Company, dated April 3fd,19339 and the designation by this Common Council under date
of April 3rd919339 of the said Loan & Trust Company as a City depository, with the
whole thereof to be governed by Sections 47 to 549 inclusive, of the Charter of said
City, and such other sections or parts thereof of the said Charter as may be relat iv
to City depositories.
Be it further resolved by the said Common Council: That the
City Treasurer shall, subject to the above mentioned sections or parts thereof
which are for the government of the said Treasurer and of the said depositories,
and the said proposal and designation, place the sum of $50,000.00 in the said Loan
& Trust Company in savings account at an interest rate of one (1) per cent per annum,
as provided for in the above mentioned proposal."
Upon motion by Norton, second by Moody, that the said resolu-
tion be adopted as read, and all voting in, favor thereof, President Liddle declared

President Liddle referred the matter of an open well near
Eleventh Street Southeast and between Fifth Avenue Southeast and Sixth Avenue
Southeast, to the Street & Alley Committee, and the City Engineer.
Upon motion by Dallman, second by Amundsen, the sum of w5.00
was appropriated from the General Fund and -it was ordered that the said sum be paid
to D. L. Williams, Postmaster, for postage stamps for use of the City Engineer.
President Liddle announced that he would re -appoint the same
Council Committees that were in effect inr1932-1933.
Upon motion by Dallman, second by Amundsen, the Common
Council adjourned.
