HomeMy WebLinkAbout09-15-1933573 +_ Minutes of an adjourned regular meeting of the Common Council of the City of Rochester, Minnesota, held in the Council Chambers, in the City Hall, in said City, at 7:30 o'clock P.M., on September 15th,1933. Meeting called to order by President Liddle. Roll Call: Present: Liddle, Dallman, Hicks, Miller, Moody, Norton. Absent: Amundsen. Upon motion by Ballman; second by Moody, the minutes of the meeting held on September 5th,1933, were approved. Balance sheet, income st"atements,etc., of the Public Utility Departments, prepared by the Secretary of the Public Utility Board as of August, 31st,1933, were laid before the Common Council, and President Liddle ordered that the same be placed on file; the income statement for the Light Department, August ,1933, showing a net profit of $5522.62, and a net loss after all charges of $329859,47) said income statement for the 5 months of this fiscal year showing a net profit of $319878.36, and a net loss after all charges,of $38,382.86; the Water Department. income statement for August 19339 showing a net profit • of $2865.23 and a net loss after all charges of 441,577.57, and for the 5 months, of this fiscal I year a net profit of $11,754.139 and a net loss after all charges of $34,769.73. i Alderman Amundsen came in at this time and took his Chair. i The application of Henry Gleekel for ajunk dealers license cover- ing the use of one auto truck, was read, and upon motion,by ?picks, second by Miller, his application was referred to the Common Council as a Committee of the whole. I The appointment by the Mayor of Carlton t. Anderson, and C.B.Hanscom, as Special Patrolmen September 15th to 21st ,1933, inclusive, at a compensation of $2.00 per day, was read, and President Liddle ordered that the same be placed on file. i A communication from Senator Henrik Shipstead accompanied by a letter to him from the Treasury Departments advising that the change in the i location of the &idewalk around the new Post Office building has been approved, were each read, and President Liddle ordered that the same be placed on file.. This being the time and place fixed for adjourned and i continued hearing and action on the proposals opened September llth,19339 for the construction of a trunk line sanitary sewer and the levying of laterals in Broadway Street South between Fourth Street and Sixth Street, the matter was given consideration by the Common Council, after which, upon motion by Hicks, second by Miller, all bids were rejected and it was ordered that the certified checks accom- panying the proposals be returned td the bidders. Alderman Moody introduced the following resolution, which was read: • I J' J J "WHEREAS, The bids received by the Common Council, of the City of Rochester, Minnesota, September llth,19339 for the construction of a Sanitary Sewer and the laying of lateral connections in a part of Broadway Street South, were deemed to be too high, and accordingly action thereon was adjourned and continued to a meeting of said Common Uouncil, held September 15th,1933, at wl-.i ch time, after furt her . consideration, the lowest blf-T, that of C.G.Fraser and L.M.Feller, was rejected, together with the higher bid of St.Cloud Construction Company, and WHEREAS, It was deemed expedient and necessary that the said improvement be made and done, either by day labor or under a lower bid received through re -advertising, • SO THEREFORE, Be it resolved by the Common Council of the City of Rochester, Minnesota: That the City Clerk of said City be and he is hereby authorized and directed to advertise for sealed proposals for the furnishing of all labor, materials, tools, equipment, etc., necessary for the construct ion of a sanitary sewer in Broadway Street South, commencing at a point ten (10) feet east of the center of the intersection of Fourth Street Southeast, and Broadway Street South, and running south parallel with the center line of Broadway Street South, to a point dirty (60) feet east and thirty-seven and one-half (372) feet north of the northeast corner of Lot No.7 in Block 103 of Willson's Addition, in accordance with the plins,and specifications as approved by the Minnesota State Board of health, as designated on sheets No.8 and 91, from Station No. 82 plus 23.9 to Station No. 91 plus 21.8. The elevation at Station No.!32 plus 23.9, being elevation 74,57 feet and Station No. 91 plus 21.8, being elevation 75.55 feet, City Datum. The pipe to be used in,the construction of the sanitary sewer shall be either vitrified -salt -glazed -clay sewer pipe or steel -reinforced -cement concrete sewer pipe, as specified in A.S.T.M.`Designation C 13-32 T. for Clay sewer pipe, and designation C075-30 T. for concrete sewer pipe; Ahd commencing at a point thirty-seven and one-half (372) feet north and sixty (60) feet east of the Northeast corner of Lot No.7, in Block No.103 of Willson's Addition, and running West parallel with the north line of said Lot No.7, fifty-five (55) feet, and there ending; And commencing again at a point thirtyzseven and one- half (371) feet north and sixty (60) feet east of the northeast corner of said Lot No*7 and running south 27° 45' east forty-three (43) feet and E, there ending; Also, the construction of lateral connections to con- sist of 6" vitrified clay sewer pipe, and 1" copper water pipe, and 12" gas pipe, from the mains now in place or to. be constructed, to a point thirty- six (36) feet east and west of the center line of Broadwa,-y Street South, together with the necessary corporation cock, curb stops, curb boxes, L's. Vs, branches, crosses and junctions as shown on standard plan of the City En ;sneer for lateral connections for Broadway Street South, from Fourth Street Southeast and Southwest to Sixth Street Southeast, and South- west, to be constructed in accordance with standard specificatioli'e and the ordinances and charter of the City of Rochester, Olmsted County, Minnesota. The said sealed proposals will be received and opened t6t a public meeting of the Common Council, which is to be held at 7:30 o'clock P.M., on September 26th919339 and each of said proposals shall be in strict accordance with the plans, profiles, and spedifications for the said improve- ments which are now on file in the office of the City Clerk of said City. Each bid must be accompanied by a certified check upon some reputable bank drawn payable to the Mayor of Rochester, ?:rinnesota, for at least 10 per cent of the amount of the bid, which check and the amount, of money specified therein shall be forfeited to the City of Rochester,, Minnesota, as lictuidated damages if the bidder upon the letting of the contract -to him shell fail to enter into the contract so let; the said Common Council reserving the right to reject any and all bids. A surety bond written for the full amount of the contract by a surety company authorized to do business in the State. of Minnesota, will be required with the contract. (Personal bonds not to be accepted.) 9 575 All proposals must be addressed to Mr. A. F. Wright, City Clerk of Rochester, Minnesota., and shall have endorsed thereon, "Proposal for the construc- tion of a trunk line sanitary sewer in Broadway Street and laying of laterals." Upon motion by Hicks, second by Dallman, that the said resolu- tion be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. The following copy of resolution passed and adopted by the Public Utility Board was read., and President Liddle ordered that the same be placed on file: "Be it and it is hereby resolved by the Public Utility Board of the City of Rochester, Minnesota, that the Common Council of this City be and is hereby requested to authorize the said Board to enter into a contract with the McWane Cast Iron Pipe Company of Birmingham, Alabama, for the ,furnishing to the City of Rochester of 109880' of 6" McWane Class 150 B & S pipe @ .691 per foot together with 2,673 lbs. of 4" standard fittings at 5V per lb.-- making a total contract price of SEVEN THOUSAND SIX HUNDRED AND FIFTY-FOUR DOLLARS AND TWENTY-ONE CENTS ($71,65441) , and A contract with James B. Clow & Sons .of Chicago, Illinois, for the furnishing of 780' of 10" Class 150 deLavaud Cast Iron B & S pipe at $1.31 per foot and 2,700' of 4" Class 150 deLavaud Cast Iron B&S pipe at .48/ per foot together with 31239 lbs. of standard 4" and 10" fittings at 5�-j per lb.-- making a total contract price of TWO THOUSAND FOUR HUNDRED AND NINETY-FIVE DOLLARS AND NINETY-FOUR CENTS ($2 9495 94) ." The following communication was read, and upon motion by Amundsen, second by Dallman, it was referred to the Common Council as a Committee of the whole, the Mayor and the City Attorney: "ROCHESTER FIRE DEPARTMENT RELIEF ASSOCIATION Peter S. Mackey, Secretary Rochester, Minnesota Sept * 15 91933. The Honorable Mayor & Common Council; Gentlemen. At a meeting of The Board of Trustees, of the Rochester Fire Dept -,Relief Ass'n. held on Sept.14,1933. A motion was made and secondd and duly carried by .all voting aye, That the Relief Assn. loan money on the First mortgage on homes of members of The Fi remens Relief Assn, bearing interest at 3%9 payable in monthly instal&ents until said debt is paid. Respectfully submitted for your approval Peter S. Mackey Secretary" Upon motion by Dallman, second by Hicks, the sum of %114 77 was appropriated from the General Fund, Cqde 13, payable to the General Fund, Code 20, for flusher time, labor and water furnished the local Erosion Camp, heretofore charged to the City of Rochester, Water Department, and the City Clerk was instructei to bill these charges against the local C.C.C.Camp. . . Circular letter from L.P.Zimmerman, Executive Engineer of the Minnesota Public Works Committee,relative to additional information -'I;l:at will be required with applications for funds under the N.I.R.A. , and getting forth that the minimum wage scale for Minnesota, under the N.I.R.A. , will be $.50 per hour for unskilled labor and $1.20 per hour for skilled labor, with a classification for semi skilled labor between the $.50 rate and the 11:20 rater with a, IImaximum of 30 hours per week allowed, which restriction is construed: "To Permit working time lost, because of inclement weather or unavoidable delays in any one week, to be made up in the suceeding week or weeks of any calendar month. In no case shall maximum employment exceed 130 hours in any calendar month," were each read, and President Liddle ordered that the same be placed on file. Upon motion by Hicks, second by Amundsen, $10.00 was appropriated from the General Fund and it was ordered that the said sum be paid to D.L.Williams, Postmaster, for stamps for use of the City Clerk. .The following recommendation was read, .and President Liddle ordered that the same be placed on file: "Sept. 12 ,1933 Hon. Mayor and Common Council ` Gentlemen: The Street and Alley Committee and the City Engineer recommend that the hereinafter named streets and avenues be graded to an established grade to the width of 30 ft., being 15 ft. in " width on both the right and left side of the center line of the , streets and avenues. .«3 2nd Street Northeast, from the west line of 13th Ave. Northeast, to 10 ft . east of the west line of 14th Avenue Northeast. 14th Avenue Northeast, from the south line of 2nd Street Northeast, to the north line of 3rd Street Northeast. Alderman Hicks introduced the following resolution, which was read: "Be it resolved by the Common Council of the, City of Ro chest er, Minnesota: That the sum of 06740,56 be and the said sum is hereby appropriate from the Sewer Fund of said City and ordered paid to City of Rochester, Light, Dept., for power furnished as per billings of September 15th, 19339 5935 Sewage Disposal Plant $673.56 and 4961 Sewer Lift 4l*00. The Mayor and City Clerk are hereby authorized and directed to draw a warrant for said sum upon the City Treasurer in accordance herewith, and cause said payment to be made." Upon motion by Moody, second by Miller, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Dallman introduced a resolution appropriating $554.30 from the Park Improvement Fund and ordering payment made to the Mayo Trust Fund for payrolls for labor during the week ending September 8th,19339 which was read. Upon motion by Dallman, second by Moody, that the said resolu- t1on be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. 07 Alderman Moody introduced, a resolution appropriating 121.25 from the General, Fu4d Code. 10 , and ordering payment made to Margaret Ka Kennedy,, for interest due October lst919339 on Cdty of Rochester, 4 % Certificate of Indebtedness, Fo.5,, which was read. _ Vpon motion by Hicks, second by Amundsen, that the -said resolution be adopted as read, and all. voting in favor thereof. I President Liddle declared the said resolution duly passed and adopted. Alderman Miller introduced the following resolution, which was read: i "Be it resolved by the Common Council of the City of Rochester, Minnesota: That the Common Council of the City of Rochester, deem it expedient and necessary that local public improvements, the cost and f. expense of which shall be paid for by ,special a.:sessments levied as provided ' by law,be made in the City as follows: The grading to an established grade did to a width of 30 feet, being 15 feet' on each side of the center line, of Second Street Northeast from the west line of Thirteenth Avenue Northeast to 10 feet east ^f the west line of Fourteenth Avenue Northeast ; and the grading to an I established grade line and to a width of 30 feet being 15 feet on each side of the center line, of Fourteenth Avenue No'rtheas't, from the south line of Second Street Northeast to ,the North line of Third Street Northeast, SO THEREFORE, Be it further resolved by ,the said Common Council: That a public hearing of all persons interested in said improvements will be held at 2:00 o'clock P.M., on October 2nd, 1933, at the Council Chambers, in the City Hall, in said City, at which time and place all persons interested in said improvement may appear and be heard before said Common Council in relation to said improvement. Be it further resolved: That the City Clerk be and he is hereby directed to cause to be published in the official paper of the Vito a noi;1.^e to all persons of the time, place and object of said meeting and hearing." Upon motion by Miller, second by Norton, that the said resolution be adopted as read, and all voting in favor thereof, Presi- dent Liddle declared the said resolution duly passed and adopted. < Alderman Amundsen introduced a resolution authorizing (� the Public Utility Board to enter into the contracts for the purchase of 4 water pipe, in accordance with the above quoted resolution request and fixing the amount of the surety bond to be given by each of the said contractors at the f-al-loamount of the contract in each case, which was read. Upon motion by Dallman, second by Moody, that the said resolution be adopted as read, and all voting in favor thereof, President (� Liddle declared the said resolution duly passed and adopted. it The City Engineer submitted plans, profiles, specificer Lions and estimates of cost for the repaving of certain parts of streets and avenues described below, his total of the estimate of cost,provided that the improvements were made under the City I6abor scale, being 031377.31, and his total estimate of the cost provided that the improvements were made under the N.E:R•A. Labor scale, being $39,593.87. ws 579 Alderman Moody introduced the .following resolution, which was read: "WHEREAS, It is deemed expedient and necessary that certain part of certain Ptreets and avenues within the City of Rochester, Minnesota, be repaved with brick, and WHEREAS, The City Engineer of said City has prepared and submitted plans, profiles, specifications and estimates of cost for the repaving with No. one (1) 2-�" vertical fibre cut lug paving brick as follows: Center Street West from the west line of Broadway Street North and South to the West line of First Avenue Northwest and Southwest, except that part of the intersec- tion of Center Street and First Avenue which is now paved with brick; First Street Southeast," from a point 15 feet west of the east line of Broadway Street South to the main track of the Chicago Great Western Railroad Comparq; Second Street Southeast and Southwest from a point 10 feet west of the east line of First Avenue Southwest ',to the west line of the alley next east and from a. point 15 feet west of the east line of Broadway Street South to the main track of the Chicago Great Western Railroad 'Company; Second Street Southwest from the center line of Eleventh Avenue Southwest to the east line of Fourteenth Avenue Southwest, less that part which is now paved with brick; Second Avenue Southwest, from the north line of Fifth Street Southwest to a point 110 feet north of the north line of Sixth Street Southwest; Fifth Street Southwest from the west line of First Avenue Southwest to the east line of Second' Avenue Southwest; 1. First Street Southwest from the west line of First Avenue Southwest to a point 4 feet east of the east line of Second Avenue Southwest; First Street Southwest, from the west line of Second Avenue Southwest to the east line of Fifth Avenue Southwest; Sixth Avenue Southeast, from a point 8 feet south of the north line of Fourth Street Southeast to a point 400 feet north of the north line of Fourth Street Southeast; Eleventh Avenue Northeast from the south line of Second Street Northeast in Carroll's Addition to the main track of the Chicago & Northwestern Railway Company; Eleventh Avenue Southeast from a point 50 feet south of the center line of Second Street Southeast to a point 50 feet north of the center line of Second Street Southeast. SO THEREFORE, Be it resolved by the Common Council of the City of Rochester, Minnesota: What the above described improvements be made and done and that t-ie said plans, profiles and specifications be adopted for the said improvements and pl�.ced on file in the office of the City Clerk of said City, and that the said estimates of cost be accepted and placed on file in the office of the City Clerk of said City, and Be it further resolved by the said Common Council: That the City Clerk of said City is hereby authorized and directed to advertise for sealed Proposals for the furnishing of all labor, materials, tools, equipment, etc., necessary for the repaving with No. 1 2�F" vertical fibre cut lug paving brick of the parts of the streets and avenues above described, which sealed proposals will be received and opened at a public meeting of this Common Council, which is to be held at 7:30 o'clock P.M., on September 26th,1933. Each bid must be accompanied by a certified check upon some reputable bank drawn payable to the Mayor of Rochester, Minnesota, for at least 10 per cent of the amount of the bid, which check and the amount of money specified therein shall be forfeited to the City of Rochester, Minnesota, as liquidated damages if the bidder upon the letting of the contract to him shall fail to enter into the contract so let; the said Common Council reserving the right to reject any and all bids. 580 A surety bond written for the full amount of the contract by a surety company authorized to do business in the State of Minnesota, will be required with.the contract. Upon motion by Hicks, second by Miller, the City j Clerk and Alderman Amundsen were authorized and directed to prepare i specifications and estimate of cost for the outside painting of the so-called Witherstine property building. . Upon motion by Miller, second by Dallma.n., the Public Grounds Committee were authorized and directed to pro-ide for the necessary carpenter work repairs and gutter and down spout repairs at the Witherstine property building. ,I Upon motion by Hicks, second by Norton, the { Common Council adjourned to 7:30 o'clock P.M._, September 26th919330 � C C I �3 City Clerk. ;r
