Minutes of a regular meeting of the Common Council of the
City of Rochester, Minnesota, held in the Council Chambers, in the City Hall, in
said City, at 2:00 o'clock P.M.,. on November 6th91933:
Meeting called to order by President Liddle.
Roll Call. Present: Liddle, Amundsen, 'Hicks, Millers Moody,
Norton. Absent: Dallman.
Upon motion by Hicks, second. by Amundsen, the minutes of the
meeting held on October 23rd,1933, were approved:
Alderman Dallman came in at t hi s time and took his Chair.
Carl G: Schwarz, City Treasurer, asked for authority to
employ a stenographer in connection with return of unpaid sprinkling assessments
for 1933, at which motion by Norton, second by Moody,carried that such authority be
granted.
The report of the Clerk of the Municipal Court for the week
ending October 30th,19339 showing criminal fines collected $97.00, civil fees
received $6.359 conciliation court fees received $1 50, and $52.45 received from
Olmsted County, for September,19339 municipal court fees, and .$37.70 court costs
charged to Olmsted County, was reed, and President Liddle referred the same to the
City Attormey.
The report of the Building, Electrical and Plumbing Inspector,
for the month of September,-1933, showing building inspection fees collected in the
amount of $99001 electrical inspection fees $12.75, and plumbing inspection fees
fi8.50, was read, and President Liddle referred the same to the Finance Committee.
The report of the City Engineer for the month of October,
1933, showing expenditures from the General Fund for labor of $372.689 from the
Street and Alley Fund 0993471 from the Sewer Fund $316.139 and from the Bridge
Fund $12,015, was read, and President Liddle ordered that the same be placed on file.
The report of the City Treasurer for the month ending October
31st,1933, showing .1333,669:98 as being on hand, was read, and President Liddle
ordered that the same be placed on file:
The October,1933, report of the City Weighmaster, showing
weighing fees collected in the amount of $614309 was read, and President Liddle
referred the same to the Finance Committee:
The application of A. G,� Berndt, for a public dance permit at
the Woodman Hall, November llth, 18th, 25th, and December 2nd, 1933, and of Local
Labor Union No.405, for a public dance permit at the Woodman Hall November 16th,1933,
were each read.
House Movers License No.20 issued to 6wrence E. Lysne,
covering the period of one year, February 28th91933, to February 27th,1934 , was
laid before the Commq}j Council, in that Mr. Lysne surrenderd this license in -order.-.
that the house movers Incense bond iven by him as principal with H.J.Harwick
and H. A. Johnson, as sureties theredn in the amount of $7500.00 each be released

at which motion by Hicks, second by Moody, carried that the said
house movers license No.20 be cancelled and that the said house movers
license bond sureties be released from any further responsibility thereon,
with condition that the bond remain in the files of the City of Rochester,
Minnesota, as a record in connection with the issuance of the said
house movers license:
The following application for transfer of Off Sale I ,
license No.5 to vend non -intoxicating malt liquors, was read, and upon
motion by Dallman, second by Amundsen transfer was granted:

Gentlemen:
Relative to your inquiry ift the matter of the opening
of the road running east from the southwest corner of Section 26,
Township 107, Range 14 West, Olmsted County, Minnesota, you are
advised that, in my opinion, all necessary proceedings were had and
taken in the proper manner and the action taken by the Council as
set forth in the attached excerpts is complete in every detail and
I' can see no reason why the City should not construct a bridge on
Frourteenth Street Northwest across Cascade Creek at any point
mentioned in the road description.

' Upon motion by Hicks, second by Amundsen, the City
Attorney was instructed to rule on the present status of an injunction
started by S. 0. Sanderson, wherein the City Engineer allowed Max Hoppe to

go onto property that S. 0: Sanderson W title to, at. approximately Second
Avenue Northwest and Fourteenth Street Northwest, and cut trees for the
wood, at which an injunction was served and it was referred to the City
Attorney for defence, which status is asked for at this time in that the
proceedings for the proposed Fourteenth Street Northwest bridge over Cascade
Creek provide that the City shall go onto this property for dirt to use in
making the embankment for the said proposed bridge.
The following request for release and replacement of
collateral securities, was read, and President Liddle ordered that the same

The claim of St. Mary's Hospital $30.00 for the
isolation of Rose Bluhm, as a n erysipelas patient in the isolation
hospital, entered Oct. 3rd, 1933, dismissed October 15th,1933, was
read, and upon motion by Norton, second by Hicks, the sum of $30000 was
appropriated from the General Fund for payment to St.Mary's Hospital
account for share in local sewage disposal plant operation, in payment of
the said $30.00. claim.

Dance Permit to A. G: Berndt, for the Woodman Hall, November llth, 18th, 25th, and
December 2nd,1933, and fixing the fee at $12000, which was read.

Alderman Dallman introduced a resolution granting
public danoe permit to the Local Labor Union No.405, for the Woodman Hall
November 16th,1933, and fixing the fee at $3.00, which was read.
Upon motion by Amundsen, second by Hicks, that the
said resolution be adopted as read, and all voting in favor thereof,
President Liddle declared the said resolution duly passed and adopted.

Alderman Miller introduced a resolution appropriating
s $937.96 from the Park Improvement Fund and ordering payment made to the
Mayo Trust Fund, for payrolls for labor during the period of the weeks
ending October 27th,1933, and November 3rd,19339 which was read.
Upon motion by Moody, 'second by Dallman, that the
said resolution be adopted as read, and all voting in favor thereof,
President Liddle declared the said resolution duly passed and adopted.
Alderman Norton introduced a resolution appropriating
$214:25 from the General Fund and±;ordering: payment made t o the Wigwam
for meals for prisoners $181.25 9 and meals for lodgers $33000, during

October 19339 which was read.
Upon motion by Hicks, secon+y Norton, that the
said resolution be adopted as read, and all voting in favor thereof,
President Liddle declared the said resolution duly passed and adopted.
Alderman Norton introduced a resolution appropriating
11' $476*59 from the General Fund and 'ordering payment made to the Co -Operative
Oil Company for gasoline furnished the City Filling'Station during October
1933, which wad read* '
Upon motion by Norton, second by Amundsen, that
the said resolution be adopted as read, and all voting in favor thereof,

Alderman Amundsen introduced a resolution appropriatirg
$285.70 from the General Pond and ordering payment to the Rochester Pbst-'
Bulletin, for official publications and printing during October,19339 which'

resolution be adopted as read, and all voting in favor thereof, President

Upon motion by Dillman, second by Amundsen, the collateral
securities proposed by the First National Bank of Rochester, Minnesota, for
replacement of securities to be released as set forth in the communication quoted
above, were referred to the City Attorney for his ruling as to their market value
and the indebtedness record of the counties whose bonds are to be used for
replacements.
Alderman Moody introduced the following resolution,which was
read:
"WHEREAS, The gross total of the 1933 tax levy made by the
Common Council of the City of Rochester, Minnesota, October 23rd, 19339 was
$349,512,43, and
WHEREAS, The Public Utility Board of said City have expressed
themselves as anreeable to a continuation of the payment of 10% on gross ineQnes
from the operation of the Electric Light Department and the Water Works Department,
and
WHEREAS, It is est imat ed that this 10% on gross incomes, from the
operation of the above mentioned departments will, during the period October 1st,
1933 to May 31st,19359 amount to a total sum of $72,000.00 in a pro rata reduction
of all funds concerned to arrive at the net levy total of $277,512.439 and
WHEREAS, It is necessary that the Public Utility Board of said
City be authorized to make payment of the 10% on gross incomes from the operation
of the Electric Light Department and the Water Works Department;
SO THEREFORE, Be it resolved by the Common Council of the
City of Rochester, Minnesota:

That the Public IIt illty Board of said City be and the said Board
is hereby authorized to appropriate to the City Treasurer of said City for distri-
bution to the various funds of said City described below, 10% of the gross incomes
from the operation of the Electric Light Department and the Water Works Department
of said City, Octr 1,1933 to May 31,1935, incl., which appropriations are to be
made ordinarily upon the 16th day of each month, for the 10% on incomes from opera-
tions during the preceeding month. The share each fund of the City of Rochester,
Minnesota, shall have in the estimated $72,000.00 total is as follows: General Fund
$21,673,139 Street and Alley Fund $3425.479 Fire Protection Fund $12,426994, Sewer
Fund $3984053, Bridge Fund $1767.64, Park Improvement Fund $9270.06, Lighting
Fund $6519.789 Library Fund $2607.84, Interest Fund $2014.959 Sinking Fund
$7694.66, Firemen's Relief Fund $515,000.
Upon motion by Hicks, second by Amundsen,.that the said resolur
tion be adopted as read, and all voting in favor thereof, President Liddle declared
the said resolution duly passed and adopted.
Alderman Hicks introduced the following resolutions which was
read:
"Be it resolved by the Common Council of the City of Rochester,
Minnesota:
That the Mayor and City Clerk of said City be and the said
officials are hereby authorized and directed to execute an agreement with the
United States of America, in connection with the thirty (30) percent grant made
by the Federal Emergency Administration of Public Works toward the cost of labor
and materials for the construction of a trunk line sanitary sewer in Broadway
Street North and South from Fourth Street Northeast to Sixth Street Southeast and
Southwest, a siphon section of trunk line sanitary sewer running from Broadway
Street South in Third Street Southeast to Third Avenue Southeast and in Third
Avenue Southeast from Third Street Southeast t.o Fourth Street Southeast., the con-
struction of a new bridge over the Zumbro River on Fourth Street Southeast and the
construction of a new bridge over Cascade Creek on Fourteenth Street Northwest, whi
grant is known as P.WA:Docket No414731 a copy of the said agreement being attached
hereto and made a part of this resolution, which agreement consists of fifteen page

Upon motion by Hicks, second by Amundsen, that
the said resolution be adopted as read, and all voting in favor thereof,
President Liddl a declared the said resolution duly passed and adopted**'.
Upon motion.b y Moody., second by Miller, it was
ordered that a street light be installed ' on Eighth Avenue Southeast just
south 'of Fourth Street Southeast and the City Clerk was instructed to
request of the Public Utility Board that installation be made accordingly.
Upon motion by Hicks, second by Moody, it was.
ordered that a street light be installed $A the alley back of Magaw & Kjerner's
grocery store, one at the intersection of Seventh Avenue Southwest and
Eleventh Street Southwest, and one at the intersection of Sixth Avenue
Southwest and Eleventh Street Southwest )and one on First Street Southwest at
about the 1400 block, and the City Clerk was instructed to request of the
Public Utility Board that these installations be made.
Upon motion by Hicks, second by Miller, the Chief
of Police was authorized to purchase 3 rectifiers at $25.00 each, and
42 battery parts at $1.50 each, totaling $138v009 for use in the repair of
the police signal system.
Upon motion by Miller, second by Amundsen, the Common '
Council adjourned to 7:30 o'clock PDX., on November 27th,1933.
