Meeting called to order by President Liddle. Roll Call. Present: Liddle, Amundsen, Dallman, Hicks, Miller, Moody, Norton. Absent: None. The following copy of letter from YN. N. " The following report from the City Engineer was read, and President Liddle ordered that the same be placed on file: " Dec. 79 1933 Hon. Mayor- and - The Common Council -and The Public Utility Board of the City of Rochester, Mini Gentlemen: Please be informed: December Sth, 1933, Alderman John MNorton and the City r- Engineer, met with M. _Wm. N. Carey, State Engineer, P.W.A. , at St. Paul, Minnesota, and submitted certified copies of the following items in the matter of proposals for construction of Bridge in 4th Street Southeast and 14th Street Northwest, this city: Stem No. 1 Tabulation of bids and recommendation by City Engineer. Item No.2 Certified copies of all proposals received. (Note: only the low bid was required) Item No. 3 Certified copy of Council Resolution accepting Recommendation of City Engineer. Item No. 4 Certificate. of• City Engineer Registered - Professional Civil Engineer and Land Surveyor. The items as above listed were examined and approved by the State Engineers P.W.A. The following requirements were made by the State Engineer, NW. A- , the contractor to provide: Item No.5. Pinancial Statement ) forms furnished Item No. 6 Certificate of Compliance N R.A. Provisions. ) forms furnished Item No. 7 .Contractor's Experience Statement Item Noli 8 Statement from Insurance C04 carrying compensation. Item No. 9 Contract as executed. ( 1 copy ) Item No. 10 Bond as executed. ( 1 copy ) Item No. 11 Resolution appropriating and insuring necessary funds to finance project, to be at least, 75% of total cost. Which is arrived at as follows: Contractor's bid for construction $ 3595700 Cost of plans,surveys and blueprints, 251.13 Cost of Inspectors and miscellaneous expense ----------- --------------- 45000 Total $ 36658:13 On the basis of the City furnishing 75% of the total cost, it becomes necessary that the sum of $279493060 be made available'. There is at this time $24950000 appropriated for use tbereforf it Is advisable that $2,993.60 be provided. Mr. Carey, State Engineer, has offered the suggestion that an itemized statement of costs of labor and material on each bridge, together with that costs of compensation insurance be made up by the contractor and checked by this office, that the finding be forwarded to the office of the State Engineer, P.W.A.- that he will immediately forward the same to Washington urging that an additional allotment be made, that will include the costs that may be over and above the original allotment; and will if possible, include the cost of compensation which we both agree, is properly a part of the labor cost. In conclusion, we beg to suggest the following items: There `should be $3000:00 in additional funds provided. The total cost of the two bridges will amount to----$36658,13 The cost to be paid by the city will amount to------$27493.60 The cost to be borne by the P:W.A.will amount to $ 9164453 U If the bridges were built by the City at City -labor -scale at the price estimated by the City Engineer, the total cost would be: Construction cost, 4th St. Bridge " " 14t h St . " Alderman Norton introduced the following resolution,which was read: "WHEREAS, The Public Utility Board of the City of Rochester, Minnesota, have heretofore appropriated $249500.00 as being seventy (70%) percent of the estimated cost for the construction of bridges, one over the Zumbro River on Fourth Street Southeast, and one over Cascade. Creek on Fourteenth Street Northwest, and WHEREAS, The United States of America, under P.W.A.Docket No.14739 has allowed a grant of the other thirty (30%) percent for the estimated cost of these bridges, and WHEREAS, Upon advertisement for bids the total of the lowest bids received for the construction of these bridges was $3599579-009 and WHEREAS, The cost of plans, surveys, blue ,prints, etc., has been $251,13, and it is estimated that the cost for inspectors services and miscellaneous expenses will be a total of $4504009 thereby malting the cost of these two bridges $3696589139 instead of the City Engineer's estimate of $35,000.00 which was the basis used for making the above: mentioned appropriations, -and WHEREAS, It is the request of Mr. Win. N. Carey, State Engineer, P.W.A., that at least seventy-five (75%) percent of the cost of these bridges be made available by cash actually on hand in the City Treasury of the City of Rochester, Minnesota, meaning an additional appropriation of $29993.60, and WHEREAS, Pursuant to prior offer of the Public Vtility Board to assume possible additional costs in connection with the construction of these two bridges; Be it and it is hereby resolved by the Common Council of the City of Rochester, Minnesota: That the- Public Utility Board of the City of Rochester, Minnesota, be and the said Board is hereby authorized and respectfully requested to appropriate $29993:60 from the Public Utility Fund of the said City to the Bridge Fund of said City to set up additional 5% required as above set forth." Upon motion by Amundsen, second by Norton, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. - The report of the Clerk of the Municipal Court for the week ending December 4th,19339 showing criminal fines collected in the amount of $106.00 9 civil fees received $3.709 conciliation court fees $4.759 County check for October,1933, $97.759 and court costs charged to Olmsted County $16,50, and for the week ending December llth,1933, showing criminal fines collected $10.00, civil fees received $10.259conciliat ion court fees $3.00, and court costs charged to Olmsted County $2.15, were each read, and President Liddle referred the same to the City Airtorneyt The report of the Milk Inspector for the last half of October and the month of November, was read, and President Liddle ordered that the same be placed on f ile. The report of the City Engineer for the month of November, 1933, showing expenditures from the General Fund for labor in the amount of $834.96, from the Street and Alley Fund $50420439 from the Sewer Fund $641.07, and from the Bridge Fund $1070.83, was read, and President Liddle ordered that the same be placed on fil 700 I I The report of the City Weighmaster for the month of November,1933, showing weighing fees collected in the amount of $69,70 was read, and President Liddle referred the same to the Finance Committee. Balance sheet income statement,etc. , of the Public Utility Departments, prepared by the Secretary of the Public Utility Board, for= t,he month of-September;1933, showing a net income for September of $5,090.60 and a net loss for the 6 months of this fiscal year of $33,292.26, in the Li#ht Department, a net inebme of $49122.17 for September and a net loss of $30;647.56 for the 6 months, in the Water. Department, and a net income of $88.98 for September, and $972.76 for the 6 months of this fiscal year in the Steam Heat ing .Department; and balance sheet ,income statements, etc., of the Public Utility Departments for October,19339, prepared by the Secretary of the Public Utility Board, showing a, net income of $4.406.78 for October, and a net loss for the 7 months of $28,885148, in the Light Department, ,s net income of $645.01 for October, and a net loss of $30002.55 for the 7 months of this fiscal year, in the Water Department, and net loss in the Steam Heating Department for October of $74789 and a net income for the -7 months of this fiscal year of $897.989 were each read, and President Liddle ordered that the said reports be placed do file. The application of A. G. Berndt for a. public dance permit at the Woodman Hall, December 20th and 27th91933, and January 3rd and 6th91934, was read. The application of Foster-Mrachek Electric Company for an electrician's license, was read, and upon motion by Dallman, second by Moody, the license was granted. The electricians' license' -bond of the Foster-Mrachek Electric Company, with the Fidelity and Deposit Company of Maryland as surety thereon in the amount of $19000.00 was read, and upon motion by Moody, second by Amundsen, the said bond was approved and the surety thereon was accepted, and it was ordered that the same be placed on file: Warranty'deed given by Henry E. Alexander and Alice B. Alexander, his wife, conveying to the City of Rochester, Minnesota, a strip of band commencing at the northwest corner of Lot No -four (4) of Block No.thirty-four (34) in Morse & Sargeant's Addition to the City of Rochester, and running south along the west line of lots Nos.fdur (4) and one (1) in said Block No. thirty-four (,34)9 ninety-nine (99) feet, to the southwest corner of said lot No. one (1); thence east along the south line of said Lot No. one (1) , sixty-six (66) feet, thence north 560 50' west 109 ft, to place of beginning, containing 2767 square feet, the same to be used for a public foot -path, was read, and upon motion by Moody, - second by Miller, the same was accepted and it was ordered that the some be placed on record. The requisition by the Health Officer, upon Saint Mary's Hospital, for the isolation of Grace Lee, age twelve years, living at 23 Second Avenue Northeast, diagndeed to be suffering from scarlet fever, was read, and President Liddle ordered that the same be placed on file. The City Clerk reported the receipt of $121056 from the Franklin Heating'Station, as i cent per thousand cubic feet, on 2493119000 cubic feet of natural gas used during November,1933. The appointment by the Acting Mayor of Carlton E. Anderson as a Special Patrolman during the period December Bth,1933,, to December 14th, 19331, was read, and President Liddle ordered that the same be placed on file. The following resignation was read, and upon motion by Hicks, second by Dallman, the same was accepted. "Rochester Minn Bept. 169 1933. Hon. Julius J. Reiter Rochester Minn. Hon. Sir: It is with deep regret that I find it impossible to qualify as a member of the Police Commission. Kindly accept my resignation. You honored me by this appointments and I hope at some future time I can be of service to you and the good people of Rochester. Believe me I am, Very Respectfully yours, I. A. Johnson." The ,following appointment by the Mayor, was read, and upon motion by Norton, second by Hicks, the same was approved: " Rochester, Minn. Dec. 11-1933 To the Honorable City Council - I have this day accepted the resignation.of I.A.Johnson as Police Commissioner of this City Respectfully submitted Julius J. Reiter Mayor. Rochester Minn Dec llth,1933 To the Honorable City Council - I hereby appoint Louis A. Kepp, as Police Commissioner to fill the vacancy caused by the resignation of I. A. Johnson. " The Mayor submitted the following correspondence and after the reading of the same, President Liddle ordered that the same be placed on file: IT OPFICE OF THE MAYOR Rochester, Minnesota Attorney General State of Minnesota St. Paul, Minnesota Dear Sin: Pecember 59 1933. I am contemplating 'an appointment of. Louis F. Keppe on our Police Commission, he being an electrical contractor. Would that disqualify him ,in receiving any contracts that might be let in the City of Rochester. An answer would be appreciated. Yours respectfully, Julius J . Reiter mayor." Dear Mr. Reiter: In answer to yours of the 5th in which you inquire whether or not the appointment of Louis F. Keppe on the Police Commission would disqualify him from receiving contracts that might be let by the City of Rochester, I beg to advise you that his appointment would not disqualify him from receiving contracts from the city. It would, however, disqualify him ffrom receiving any contracts from the Police 'Commission of which he would become a member. Membership on the Commission would disqualify him from awarding a contract to himself as a contractor. Otherwise, he would be free to receive any contracts that the city would have to let. • With best wishes and sincere regards, I am Yours very truly, Harry H. Peterson Attorney General IT Copies of communications between the City Clerk's office and the Chicago & Northwestern Railway Company headquarters, and between the City Clerks office and the City Engineer's office, relative to Chicago & Northwestern Railway Company assessments for sprinkling on Seventh Street Northwest, were Lead, -end President Liddle ordered that the same be placed on file. The following copy of resolution passed and adopted by the Public Utility Board, was read, and President Liddle ordered that the same be placed on file: "Be it and it is hereby resolved by the Public Utility Board of the City of Rochester, Minnesota that the Hon. Common Council of the said City be and is hereby requested to authorize the said Board to enter into a contract with Maass and McAndrew Company for the installation of a Bteam Line Extension from the alley between First i i ki and Second Avenue and Second and Third Streets Southwest to the Lawler Theatre building, for the sum of NINE HUNDRED DOLLARS (900000) said company being the lowest responsible bidder." Copies of correspondence between the City Engineer's office and Williams, Bradbury, McCaleb & Hinkle, of Chicago, Illinois, in regard to infringem of patents by the use of apparatus in the sewage disposal plant, were read, and President Liddl a referred the same to the City Attorney. The following copy of emergency authority given.by the mayor was read, and President Liddle ordered that the same be placed on file: Mr. C. E. Ginther, "December llth, 1933. Chief of the Fire Department, City. Dear Sir: In accordance with the, request of the Common Council in a resolution passed and adopted December 4th, 19339 I hereby issue emergency authority to you, to go into the open market and purchase the following equipment for the new service truck for use in the Fire Department of the City of Rechester, Minnesota, conditioned that the company making the sale shall accept and agree to no payment on this equipment, other than approximately $800600, which shall be paid on delivery, the balance to be paid; one half thereof on or before July 1, 19349 and the other half thereof to be paid on or before December 19 19349 without interest or any other, extra charge on account of the delay in payment: (Approximately) Aerial ladder, $ 1300.60 Hose body 500.00 Running Boards and finders 100.00 Pump 1100.00 Service ladders, 550.00 $ 3550 000 This emergency authority is given under Section 284 of the Charter of the City of Rochester, Minnesota. Randall and family of sympathy extended to them by City Officials, was read, and President Liddle ordered that the same be placed. on file. The following paragraph from The Rochester, Minnesota k Chamber of Commerce Events, published December 5th,1933, was read: Vter raising funds for the business men's share of Christmas lighting and apparently arranging with the Council for the city's cust unary share, the Council declined to assume any part of the cost. This ` unexpedted development for a time threatened to leave Rochester without' street demraktions for the holidays. The Retail Division immediately resumed efforts to secure council approval. Members were called in for a general discussion on the matter and this was followed by another appearance before the Council. At a special meeting, the aldermen approved an appropriation and Rochester's streets are now lighted for the holiday season -- credit for which is due entirely to the activities of your Chamber of Commerce." The following report was read, and President Liddle ordered that the same be placed on file: i " December 8, 1933 Honorable Common Council City of Rochester, Minnesota i Gentlemen: Relative to the request of the First National Bank of t Rochester,Minnesota to substitute bonds as security for deposits of the City of Rochester as set forth in their letters to you of October 27th, and November 8th919339 and. of the Union National Bank to substitute bonds for the same purpose as set forth in its letter to you of November 69 19339 you ,are advised that I have investigated the market on all of the bonds desired to be substi- tuted and find same .to be of. sufficient market value for the purposes desired. We beg to recommend that the dis�ributian price be fixed at the amount of that decimal of one cent, that may be over the nearest even cent, per gallon,, in contract price, and that,the practice of adding one cent to the decimal of a cent be discontinued.
