Upon motion by Moody second by Amundsen the minutes of the meeting held on February 4t h,1935 , were approved: General Balance sheet, trial balance, fund statement, statement of unexpended?:budget appropriations,, etc., prepared by the City Clerk as of January 319t919359 were laid before the Common Council and President Liddle ordered that. the same be placed on file,& The City Engineer's Department trdal balance for January,1935, was laid before the Common Council, and President Liddle ordered that the same be placed on file: The report of the Health Officer for the City Farm for the month of January 1935, showing receipts 015..189 disbursements $595438, and a balance on hand $1300449 and :a.- -statement of hogs on hand, showing 335 on hand January lat,1935, 57 sold January 31-st91935, 7 died between January 5th, and 29th,1935, leaving 271 on hand February lat,19359 were each read,and President Liddle ordered that the same be placed on file. - The report of the Financial Secretary of the Public Library Board for the year ending December 3191934, was read and President Liddle ordered that the same be placed on file. _ . . The report of the City Weighmast er for the month of January,.1935, showing weighing fees collected in the amount of $12:20 was read and President Liddle referred the same to the Finance Committee4 Balance sheet, income statements, etc:, of the Public Utility Departments,prepared by the Secretary of the Public Utility Board as of January 31,1935*9 was laid before the Common Council, and _ President Liddle ordered that the Same be placed 'on file; the said income statements showing a net profit in the Light Department for the Month of January 1935, of $11418:60, and net income $8815:61, for the ten months of this fiscal year a net profit of $7446977, net incase $53397.90; the Water Department a net loss of $4139.58, fat January, net 667 profit. for the ten months $36313:171 net lees $8399.60; Steam Heating Department January net income $2569.119 and for the ten months $52020-50. The reports of the Clerk of the Municipal Court for the week ending February llth9i9359 showing .criminal fines collected 4143:00, civil fees received 910.75, conciliation court fees 031509 and fines collected due to Olmsted County $1010,00 0 and for the week ending February 18th919359 showing criminal fines collected $206.10, civil fees received $7.609 conciliation court fees received $3.,259 court costs charged to Olmsted County $39.159 and fines collected due to Olmsted County $1100-00, were each read,and President Liddl a referred the same to the City Attorney Upon motion by Moody second by Amundsen the am of $120000 was appro- priated from the General Fund and it was ordered that the payment be made to Olmsted County,Minnesota, for local Municipal Court fines collected due to Olmsted County, The application of Albert B. Sanger, and of A. E. I[ilsie for drivers •licenses, were each read and upon notion by Amundsen second by Moody licenses were granted. The application of T. V. Nagle for a public dance permit at the Woodman Hall, February 23rd and March 2nd919359 and of Corwin Stoppel, Chairman, for public dance permit at the Armory January 21st91935, were each read. The following applications for permits to place and maintain signs were each read and upon .motion by Amundsen second by Fryer, permits were granted: McGeary Motors, Inc.., (2) , Co -Operative Oil Company, Superior Service Station. EFFECTIVE IN: Rochester, 'Minnesota, within corporate limits. CLASSIFICATION: Residential and Commercial customers. AVAILABILITY: Available to customers using automatic storage type electric water heaters under the terms and conditions herein specified. RATE: 1 00j gross, y90/ net per kilowatt hour. When the electrical heating capacity exceeds the ratio of 20 watts per gallon of tank capacity, an additional monthly charge proportionate to such excess capacity will be made at the rate of $140 net per KWj MINIMUM CHARGE: The monthly minimum charge shall be $100 net for the first KW or fraction thereof: For additional heating capacity in excess of one KW, the monthly minimum charge shall be increased proportionately at the rate of $20,00 net .Rer KW per month. F. Wright City Clerk Rochester, Minn. Dear Mr. Wright: I have your letter asking for a copy of the Carley bill attempting to impose a tax upon municipal property located outside of its limits. That bill is House'File 39 Senate File 240, and we have a typewritten -copy which I am -enclosing herewith. I will also call your attention to the fact that we are mailing out • legislative bulletin today"An which we have commented on this bill. It is general in its character and would apply to all municipal property including gravel pits owned outside of the corporate limits. I happen to have been before the Municipal Affairs Committee a week age yesterday when the bill was discussed, and there was a question raised then as to its constitutionality. Although the bill says it is not a tax the court might not take the bill at its word: The hope in writing the note in the bulletin was that other municipalities would interest themselves in the bill also. Reiter Mayor D Rochester, Minn: Dear Mr. Reiter: Let me thank ou for your efforts before the Municipal Affails Committee of the House yesterday morning on behalf of the eague. Your sta emen was helpful. You ask for the numbers of three bills, with a statement on them so that your council may take action on the ,same. The bill that was, under discussion yesterday was a one or two line bill simply calling for the repeal:' of Chapter 211, Laws of 1933, the effect of which would be to abolish the League of Minnesota Municipalities. That bill was House File 486. It has not been introduced into the Senate. The power extension bill, I assume, is the one that was laid over for action Wednesday at the special meeting of the committee at 11:00 o'clock. It is the amendment to Chapter 1419 Laws of. 1933, proposed by Representative Nolan, and proposing to strike out the twenty-five mile limit on extensions on power lines outside of municipal limits, and to repeal the requirement of a vote. That bill is House File 237. The bill proposing a tax on natural gas of five cents per thousand Cubic feet is Senate File 366. It was introduced February lot and referred to the Committee on Taxes and Tax Laws of the Senate. I do not find that it has been introduced in the House. Incidentally, the committee"to-which this has been referred is the one -that the late Senator Sullivan was -chairman of: It is just possible that his demise may delay the action of the 4committee in the considerat: of some of the matters before it. Nagle for the Woodman Hall, February 23rd, and March 2nd,19359 and fixing the fee at $6:009 which was read. Upon motion by Moody second by Amundsen, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted: Alderman Amundsen introduced a resolution granting public dance: -permit to Corwin Stoppel, Chairman of Father Coughlin Committee, for the Armorer February 219t,1935, and fixing the fee at $3:00, which was read: Upon Motion by Amundsen second by Fryer, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Fryer introduced a resolution memorializing the Congress of the United States and the President of the United States to approve ,if passed the General Pulaskis Memorial Day resolution now pending in Congress, which was read. Upon motion by Miller second by Fryer that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the saic resolution duly passed and adopted. Alderman Moody introduced a resolution authorizing the Public Utility Board to place in effect the Water Heating rate in accordance with their above quoted resolution request, which was read: Upon motion by Fryer second by Green that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolu- tion duly passed and adopted:. Alderman Miller introduced a resolution making appropriations for use of supplies between departments during January919359 which was read. sm 676 Upon motion by-Fryor second by Moody that the said resolution be adopted as read, end' all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Miller introduced a resolution making appropriations for use of equipment between departments during January,19359 which was read. Upon motion by Green second by Fryer that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted4 Alderman Moody introduced the following resolution which was read: "Be it resolved by the Common Council of the City of Rochester, Minnesota: That the sum of $115478 be and the said sum is hereby appro- priated from the Frank E.Williams Estate Fund of said City and ordered paid to Olmsted County, Minnesota, for 1932 special assessments certified and remaining unpaid against the City of Rochester, Minnesota, for five eights share in the Williams Estate Business building property, being $8466 for sprinkling, $68456 for paving, .$21:21 Revolving Fund interest, and $17.35 penalties, interest and costs. The Mayor and City Clerk are hereby authorized and directed to draw a warrant for said sum upon the City Treasurer in accordance herewith, end cause said payme4t to be made." Upon motion by Amundsen second by Moody that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed'and adopted. Alderman Green introduced a resolution appropriating $329.28 from the Fire Protection fund and ordering payment made to the Manhattan Rubber Manufacturing Division of Raybestos-Manhattan, Inc., for 400 feet of 2 � inch Economy, double jacket, fire hose, which was read. Upon motion by Miller second by Fryer that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted: Alderman Green introckeed a resolution appropriating $11420,60 from the Park Improvement Fund and ordering payment made to the Mayo Trust Fund for payrolls for labor during the period of the weeks ending February 8t h,1935 , and February 15th919359 which was read; Upon motion by Green second by Amundsen, that the said resolution be adopted as read, and all voting in f zwor thereof, President Liddle declared the said resolution duly passed and adopted: 677 Alderman. Green introduced a resolution appropriating $282453 from the Park Improvement Fund and ordering payment made to Philip Cassidy for corn fodder, oats and corn, furnished to the Park Department during January 1935, for the improvement of Silver Lake, which was read. Upon motion by Fryer second by Green that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted Alderman. Fryer introduced an ordinance providing for the licensing, conducting and regulating of auction sales within the City of Rachester, Minnesot9, which was given its first readixg4 ,spon motion by Moody second by Fryer Soft Drink dealer license No:650 heretofore granted and issued to Wi P� Krasel authorizing the sale of soft drinks at the so-called Green Lantern, was revoked: 0 Upon motion by Fryer second by Amundsen the Chief of Police and City Att_ brney were instructed to check the'pin-ball machines operating within the City of Rochester, to ascertain which of them may be operating illegally. upon motion by Miller second by Fryer, Alvin E.
