4 Minutes of a regular meeting of the Common Council of the City of Rochester, Minnesota held in the Council Chambers in the City Hall in said City at 2:00 o'clock P. M, on May 6, 1935 Meeting was called, to order by President Lidd.le: Roll Call. Present: Lid).le, Amundsen, T-r�,er, rrp.nn, Lemmon, Moody and Richman. Absent: None. The following petition was read ,and upon motion by Lemmon second by I-Toody, it was referred to the Street and Alley Committee anal the City Engineer. "To the Common Council of the City of Rochester: The undersigned, being the owners of all of the property on t',,.o line of the street hereinafter described and proposed to be vacated, respectfully request you to vacate all that part of Fifth Street Southeast (formerly Line Street) lying westerly of a line drawn from a pair+ in'..Lue south line thereof sixty seven feet east of 'Glee east lin*f Broadway Street South to a point in the north line thereof eighty feet east of the east line of Broadway Street Southj The reasons for the vacation of said street are that it has never been opened or used .for public travel; that the expense of opening and improving the sm- a would not be Justified by its use; that it extends only to the river bank; that the public interests will be well served by the remaining streets and it is not needed for access to any property abutting then eon4 A plat of said street and the property affected thereby is it hereto attached4 Schuster Realty Company Dated May 1, 1935. This is tha. part of Fourth Street bordering our Service Station property which is described as the East One Third (1/3) of Lot One (1) in Block Eleven (11) and the East One-half (1/2) of the West Two - Thirds (2/3) of Lot One (1) in Block Eleven (11) in the original plat of the Town, now City of Rochester, Minnesota. Armstrong, as City Engineer of said City I am pleased to make the following statement: Mr. Armstrong was appointed City Engineer at the beginning of the official year 1934. No other Engineer having qualified for the position, Mr. Armstrong is now ljolding that position as a hold -over officer until his successor is appointed and qualifiedi At the commencement of the official year 1934 the salary as City Engineer was set by the Common Council, and no further action re-• garding compensation has been taken& Our Charter provides that all appointive officers of the City shall hold their respective office for the term of one year and until their respective successors shall be appointed and qualified& The Charter further provides in Section 295 "suck salaries And componsation shall be fixed annually at the commencement of the official year: No offioer*s salary shall be increased or diminished during his term of office&" It is theafore my opinion, that Mr. Armstrong in not only en- titled to his regular compensation but that you as City Clerk are authorized to draw and countersign orders onthe City Treasurer for Mr. Armstrong's regular compensation as City Engineer in accordance with Section 109 of our City Charter. yours** � Ver respectfullyi � * i IR V ING• L . When Dealer makes sale of any electric range, he is -to notify Mr.Warnes and the Dealer or his electrician to go on job with Mr. Yarnes and both agree on agreement of wiring for range. This agreement between Utility Board and Dealer to terminate July 31, 19359 All applications for sales -contracts to Ve agcepted and approved by Secretary of Utility Board before electric range installation is made, or range is delivered to dealer# All campaign ranges are the property of Utility Board until paid for. Dealer making sale of electric range to do wiring; as stipulated in this agreement, providing application for sales -contract is approved by Secretary of Utility Board*; Under plan outlined, Utility Board will finance range sales which are bding featured in 'campaign and monthly installments to be billed and collected by Utility Board without recourse to dealer: Dealer to be paid for wiring of range installations once a month by submitting bills to Utility Board. This agreement terminates all previous allowances on wiring for rangesi Dealers who are licensed electricians to display ranges featured in campaign in this stores and display windows, without cost to Utility Boarde Said campaign ranges to be consigned to, Dealer, but are the property of said Utility Board and shall not be removed from his premises without first securing permission from the Electric Light Department: Utility Board will do their share of advertising to put this campaign across and Dealer is expected to tie in with his ad. Dealer to receive a !($20'400) commission for selling campaign ranges, unless otherwise specifiedi City Employes of the Light &, Water Departments may purchase an electric range under this plan.
