Minutes of
a regular meeting of the Common
Council of the
City of
Rochester, Minnesota!-,
held in the Council Chambers, in
the City Hall,
in said City,
on August 2nd,1937.
President Liddle called the meeting to order at 2:00 o'clock P.M. ;the
following members being present: Liddle, Amundsen, Fryer, Green, Lemmon, Moody,
Richman. Absent: None.
Upon motion by Moody second ply Richman, the minutes of the meeting of
July 26th,19379 were approved.
Dr. Hamilton Montgomery was before the Council, representing the
Rochester Automobile Club, and spoke in favor of the adoption of an ordinance
requiring compulsory authmobile brake testing.
James T.Spillane was before the Council representing the Rochester
Chamber of Commerce and the Olmsted County Business Men' s Association, and

presented ordinances prohibiting the sale and distribution of fireworks in the
City of Rochester, and the so called Green River ordinance and urged that the said
ordinances be adopt ed- i
A group consisting of A:S.Anderson, Blanche E.Anderson, E.F.Davis,
,.O.Downer, Bernice Southwick, NOB -Wright, EC.Baumann, Claude Swearingen,

J.C.Kirby, Clarence Woolley, Mrs. P'.D.M.-ace, and Flail Lade, were present and spoke
and presented petitions in opposition to the adoption of the so-called Green River
ordinance.
Mr. Roy Smith was before the Council regarding an order by the Building
Inspector directing him to remove a certain building occupied by him on the used
car lot on First Avenue Southwest.
A.E.Benike was present and stated that similar notices had been sent
to Louis Wortman,14 4th. St.S.E.; Albert Moehnke,15 3rd St.S.E.; Joe Larson,419 So.
Broadway; and Clements Chevrolet Co. 16 Third Street Southwest. I

After considerable discussion on the matter , Alderman Fryer moved that the
order of the Building Inspector be rescinded and that the matter be referred to the
Public Grounds Committee, the City Attorney, and Fire Chief. The motion was

seconded by Moody, and all voted in favor thereof: !
Mr. Geo.J.Alley was before the Com?Lon Council and presented 'a petition

signed by a majority of the following described property: Lots 1 to 5,inclusive in

to the City of Rochester, Minnesota. which lies east of the road, the follow-
ing bid was opened at tr'_s time: Kris Nielson $500,00.

Alderman Fryer introduced a. resolution accepting; the bid of Kris

Nielson in the sum of $500.00 for the purchase of that part of the North

963.07 feet of Outlot 5 Northern Addition,wIli.ch lies east of the road,which

i' On motion by Fryer second by Green, to adopt the said resolution
as read, and upon roll call, Fryer Green and Lemmon vot ing "Ape and Amundsen,
Mood,' Richman, and Liddle voting "No."',' whereupon President Liddle declared

the said resolution not adopted.
Upon motion by Lemmon second -by -Richman, the City Clerk was
instructed and authorized to return the certified check to Kris Nielson
'i which accompanied his proposal.

instructed to advertise for bids for the sale of the North 96347 feet of

The report for the month of duly,1937, of the Building, Electrical

and Plumbing Inspector, showing building permits issued $67:009 electrical
permits issued $12.75, and plumbing permits 067059 was read, and President
Liddle referred the same to the Finance Committee.
The report of the City Engineer for the month of July, showing
disbursements for labor from the General Fund of 0779.511 from the Street &

Fund $189035, was read, and President Liddle ordered that the same be placed on file.
A petition signed by the Malt Beverage Dealers of Rochester protesting
the proposed ordinance granting on sale liquor dealers the privilgAe of selling

An application signed by T. H. Johanson asking for a plumber's license
together with a surety bond in the sum of $1,000.00, with the Aetna Casualty and
Surety Company as surety, were each separately read, and on motion by Moody second
by Richman, the license was granted, the bond approved, tiie surety thereon accepted,
and it was ordered that the bond be placed on file.

Alderman Fryer introduced a resolution appropriating 9594.76 from the
General Fund and ordering payment made to the City of Rochester, Water Department, for;
water furnished for flushers in accordance with billings of July 25th91937,which was

Upon motion by Fryer second by Green,that the said resolution be adopted
as read, and all voting in favor thereof, President Liddle declared the said resolu-
tion duly passed and adopted.
Alderman Richman introduced a resolution appropriating $300.00 from the

General Fund, Code 18,' and ordering payment made to the Park improvement Fund, for j
transfer of funds covering the costs of oiling the driveways in Silver Lake Park,
which was read.
Upon motion by Green second by Lemmon that the said resolution be
adopted as read, and all voting in favor thereof, President Liddle declared the said
j resolution duly passed and adopted.

Alderman Green introduced a resolution appropriating $4312.00 from the

General Fund and ordering payment made to the Street and Alley Fund,Code 39 for
a permanent transfer covering part of the cost of rock crushing W.P.A.project,which
was read.
Upon motion by Richman second by Amundsen,that the said resolution be
adopted as read, and all voting in favor thereof, President Liddle declared the said
resolution duly passed and adopted.
Alderman Amundsen introduced a resolution deeming it expedient and
necessary that Broadway Street North and South, from the south rail of the C.-;c N.W.
Ry. Company tracks, to the south line of Fourth Street Southwest and Southeast be
repaved, and that Broadway Street South between Fourth Street .-nd Sixth Street be
widened and that previous to making said improvements ,that the sewer and water
connections be made from the curb line to said water main and new trunk line sewer, and

Mdetiftan -Richman introduced a resolution deeming it expedient
and necessary that Sixt}) Avenue Southwest from Ninth Street Southwest to
Eleventh Street Southwest, be treated with bituminous treatment, and
that the cost and expense thereof be paid by special assessments levied

as provided by law, and ordering a hearing on the said improvement for
7:30 o' clock P.'v-T. , on August 16t 1.,1937%which was read.

Alderman Amundsen introduced a resolution deeming it expedient

and necessary that the alley in Block 1710riginal Plat, from the property
line of Third Avenue Southwest and running east 140 feet, be paved with
reinforced concrete, and that the cost and expense thereof be paid by
special assessments levied as provided by law, and ordering a hearing on
the said improvement for 7:30 0clock p.m., on August 16t h,1937, which
was read.
Upon motion by Lemmon second by Green that the said resolution

Alderman Fryer introduced a resolution ordering a hearing on
the widening of First Street Southwest from Broadway Street South to
Sixth Avenue Southwest , for 7:30 o' clock P.M. , on August 16t h,1937,whih h was

Upon motion by Green second by Richman,that the said resolution be
adopted as read, and all voting in favor thereof., President Liddle declared the
said resolution duly passed and adopted.
Alderman Fryer introduced a resolution ordering hearing on the widening`
of First Street Northwest from Broadway Street North to Fourth Avenue Northwest,
for 7:30 o'clock P.M. , on August 16th,1937,which was read.
Upon motion by Richman second by Amundsen,that the said resolution be
adopted as read, and all voting in favor thereof, President Liddle declared the
said resolution duly passed and adopted.
Alderman Moody introduced a resolution deeming it expedient and
necessary that a new curb and gutter be constructed on First Street Southwest,
from Broadway Street South to Sixth Avenue Southwest, adopting the City Engineer's
plans, profiles, specifications and estimate of cost for the said improvement,and
-ordering advertisement for bids to be received and opened at 7:30 o'clock P.M. ,
on August 16t h,1937, which was read.
Upon motion by Amundsen second by Green,that the said resolution be
adopted as read, and all voting in favor thereof, President Liddle declared the
said resolution duly passed and adopted.
Alderman Green introduced a resolution deeming it expedient and

said resolution duly passed and adopted.
Alderman Limiumnnintroduced a resolution deeming it expedient and
necessary that a new curb and butter be constructed on Third Avenue Southwest from
Second Street Southwest to Third Street Southwest, adopting the City Engineer's
plans,, profiles, specifications and estimate of cost for the said improvement, and

ordering advertisement for bids for the construction of said curb and gutter, said
bids to be received and opened at 7:30 o'clock P.M. , on August 16th,19379which was
read.

Upon motion by Richman second by Amundsen, that the said resolution
be adopted as read, and all voting in favor thereof, President Liddle
declared the said resolution duly passed and adopted.
Alderman Fryer introduced anr.erdintAos annexing all of Lots 1 to
25 inclusive in Block 1, and 6,11 of Lots Nos. 192,398,9 jl2J3,16,17,20,

21,24,25,28,29,32,33,36,37,40,41,449'45948,and 49 in Block 2, and the
adjacent streets and alleys in Westlawn Addition, to the City of Rochester,
Minnesota, and to be known as West Lawn Addition,which was given its first
i
reading.
Alderman Green introduced an ordinance amending an ordinance
entitled, "An ordinance regulating the sale of intoxicating liquor within
i
the City of Rochester, providing for such sales by duly licensed persons,
establishing regulations for the operation of places where such intoxicat-
ing liquor is sold, providing regulations for the granting of such
licenses, setting license fees, providing penalties for the violation
k
thereof, and repealing all inconsistent ordinances. This is an emergency
ordinance rendered necessaryfor the preservation of public peace, health

_and safety. ", which was given its first reading.
Alderman Amundsen introduced an ordinance regulating peddlers,
solicitors, canvassers, hawkers, itinerant merchants and transient vendors
of merchandise- which was gkvdn its first reading.
Alderman Richman -introduced an ordinance prohibiting the sale or

discharge of fireworks or fire crackers within the corporate limits of
i
the City of Rochester, Minnesota, which was given its first reading.
Alderman Fryer introduced a6n ordinance establishing an automobile
testing station requiring motor vehicles to be tested, fixing a fee for
f
making tests and providing a penalty for the violation thereof, which
{
was given its first reading.
The following claims were read, and on motion by Richman second
by Green, and all voting in favor thereof, the same were allowed and the
Mayor and City Clerk were authorized and directed to draw warrants upon the
City Treasurer and make payments adcordingly:

Upon motion by Moody second by Fryer, the City Clerk was instructed to
notify the Secretary of the Public Utility Board to place street lights on Third
Avenue Southeast at the intersection of Thirteenth Street and Fourteenth Street, ands
at the intersection of Twelfth Street Southeast and Ninth Avenue Southeast.
Upon motion by Lemon second by Fryer, the City. Clerk was instructed to:
notify the City Week Inspector to cut all grass and weeds upon vacant lots within the
City of Rochester, Minnesota.
Upon motion by Richman second by Fryer the Council adjourned; to
