Minutes of a regular meeting of the Common Council of the City of
Rochester, Minnesota, held in the 19ouncil Chambers, in the City Hell, in said City,
on June 6th,1938.

President Liddle called the meeting to order at 2:00 o'clock P.M., the
following members being -present: Liddle, Amundsen, Fryer, Green, Lemmon, Moody,
Richman. Absent: None.
Upon motion by Richman sdcond by Moody, the minutds'of the meeting
of May 23rd were approved.
President Liddle stated this as being the time set for a hearing on
the following local public ' improvements:
PAVING: The alley in Block 16 Head & McMahon's iddition;
Third Avenue Southwest from Second Street to Third Street Southwest;
Fourth Avenue Southwest from Second Street S.W. to First Street Northwest;
Fourth Place Southwest from First Street to Second Street Southwest;
Seventh Avenue Southwest from Sixth Street to Eleventh Street Southwest;
Sixth Avenue Southwest from Second Street Southwest to Center Street West;
q.-nd asked if any one present wished to be heard concerning either of the said
proposed improvements. No one present wished to be heard concerning• either of said
improvements.
President Liddle stated this as being the time set for receiving and
opening bids for the furnishing of an automobile for the Police Department. The
following bids were received and opened at this time:

President Liddle referred the above bids to the Police
Committee of the Common Council and the Chief of Police for recommendation.
i President Liddle stated .this as being the time set for
receiving and opening bids for the pVkrchase of the Wither st ine property,
and the F.E.Wil-l-iams Estate property. The following bids were received
and opened at this time.

considering the above proposals, Alderman
Richman moved
i that all bids be
rejected and that the City Clerk be authorized to return
the checks which
accompanied their proposals. The motion was seconded by
Alderman Moody and all members voted in favor thereof.
• President Liddle stated this as being the time set for
receiving and opening bids for the paving of the alley in Block 16,

Edward G. Cappel was before the Council with a device to protect, plants

and shrubery and President Liddle referred. the matter to the Police Committee and

the Chief of Police.
the .report of the Clerk of the Municipal Court for the week ending
May 30th, showing criminal fines and costs collected $168.359 civil fees received
$13.45 and conciliation court fees received $1.35, was read, and having been

previously approved by the City Attorney, President Liddle ordered that the same
I
be placed on file. I
The report of the. City Weighmaster for the month of May • showing 99 private
loads weighed and receipts in the amount of $9.90, was read, and President Liddle
i
referred the same to the Finance Committee.
The report of the City Engineer for the month of May showing disbursements'
for labor from the General Fund $485.61, from the Street and Alley•Fund $2167.899 and

from the Sewer Fund $254.82, was read, and President Liddle ordered that the same be
Placed on file.

A communication from Geo. F. Strifert, Sanitary Inspector , listing
I
21 places where notices had been served to different parties to clean up and remedy
unsanitary conditions was read, and President Liddle ordered that the same be
Placed on file.
The report of the Building Electrical and Plumbing Inspector, for the
month of May showing building permits issued $112.00, electrical permits issued
425.00, and plumbing permits issued $55.50, was read, and President Liddle referred
the same to the Finance Committee.
A communication from W.A.Moore, Mayor, announcing the appointment of
Wm. A.Sessing as• a Special Policeman for duty in all parks, to hold office until
the second Monday in Apri1,1939, and to serve without pay, was read, and President
Liddle ordered that the same be placed on file.
Committee reports signed by the Street and Alley Committee, and the City
Engineer, reccxmmending that sidewalks be constructed on the east side of Seventh
Avenue Southeast between Twelfth Street Southeast and Thirteenth Street Southeast and;
in front of Lots 14 to 15, and 16 in Block 16, Northern Addition, were read, and
President Liddle ordered that thb same be placed on file.

A committee report signed by the Sewer Committee and the City
Engineer recommending that a sanitary sewer be constructed in First Street

Northwest from Thirteenth Avenue Northwest to Sixteenth. Avenue Northwest,
was read, and President Liddle ordered that the same be placed on file.

A communication from B.C.Galpin, protesting the construction

of a sanitary sewer in Ninth Place Southeast, was read, and President Liddle

ordered that the same be placed on file.

Mr. R.F.Nichols was before the Council and entered a protest

!' against the construction of a sanitary sewer in Ninth Place Southeast.

The applications signed by the Rochester Amusement Company for
moving picture show licenses for the Chateau Theatre, Lawler Theatre, and
Empress Theatre, and the Time 23eatre, were each separately read, and on
motion by Moody second by Amundsen, licenses were granted.
An application signed by Harold Golod for off sale non -intoxicat-

ing malt liquor license at No.8 Second Avenue Southeast, was read, and on
motion by Fryer second by Richman, license was granted.
An application signed by Martin Paulson for a license to

and upon motion by Richman second by Amundsen, license was granted.

An application signed by Ben Sternberg for a license to operate a
pin ball machine at 6-8 North Broadway, was.read, and on motion by Fryer second by
Amundsen, license was granted.
Applications signed by Virginia Flanders and Marie Stortz, for soft
drink dealers licenses were each separately read, and on motion by Green second by
Amundsen, licenses war# granted. i
An application signed by Claude E.Diekens for a plumbers license together
with a bond in the sum of $11,000.00 with the Fidelity & Casualty Company of New York i
as surety thereon, were each separately read, and on motion by Moody second by Rkehman
the license was granted, the bond approved the sureties thereon accepted , and it was;
ordered that the same be placed on file.
An application signed by Edw. E.Kruger for a permit to conduct two public
dances in the A.O.U.W.Hall, on June 4th and June llth, was read.
The surety bond of H.T.Earle, in the sum of $1100.00 with the Western
i' Casualty & Surety Company as surety covering his contract for curb and gutter in
South Broadway, was read, and on motion by Lemmon second by Moody, the bond was
approved the sureties thereoh 'accepted, and it was ordered that the same be placed

States Fidelity & Gusaantee Company as surety covering his appointaetLt as Sanitary

A communication from T.E.Barber, presenting certain figures
regarding values and taxes on .his personal property, were read, and on motion
by Moody second by Fryer the matter was referred to the City Assessor with
instructions to submit a report to the Common Council.

read,,and on motion by Lemmon second by Green lights were ordered installed

Geo. W. Granger was before the Council regarding moving of two light
poles at the corner of First Avenue Southwest and Fourth Street Southwest and on
motion by Fryer second by Amundsen, the matter was referred to the Public Utility
Board.
Alderman ,Fryer introduced a resolution accepting the bid of the
Cbements Chevrolet Company In the sum of $423.40 for the furnishing of an auto-

mobile for use of the Police Department of said City, which was read.
Upon motion by Amundsen second by Rtphman that the said resolution be
adopted as read, and all voting in favor thereof, President Liddle declared the said j

resolution duly passed and adopted.
Upon motion by Fryer second by Green, the City Clerk was authorized to
return the checks which accompanied the unsuccessful bids.
Alderman Richman introduced a resolution accepting the bid of L.M.Feller i
in the sum of .41897.39 for the paving of the alley in Block 18, Head & McMahona i
Addition, which was read.
Upon motion by L emmon second by Fryer, that the said resolution be
adopted as read, and all,voting in favor thereof, President Liddle declared the said
resolution duly passed and adopted. i

• Upon motion by Green second by Moody, the Ctty Clerk was authorized to j
return the certified checks of the unsuccessful bidders.
The City Entineer submitted plans, specifications and estimate of cost
for the construction of curb and gutter on and widening of the pavement on Third
Avenue Northwest, said estimate of cost for the curb and gutter being $1080.50, and

for the widening of the pavement $654.00, which were read, and President Liddle j
i
ordered that the same be placed on file.

Alderman Green introduced a resolution adopting the plans, specifications
and estimate of cost for the widening of Third Avenue Northwest from Center Street
West to Second Street Northwest, ordering that the same be placed on file, and
ordering a hearing on the said improvement for 2:00 o'clock P.M., on July 5th,1938,
and ordering advertisement for bids to be received and opened at 2:00 o'clock P.M.,

on July 5th,1938, which was read.
Upon motion by Fryer second by Richman,that the said resolution be
adopted as read, and all voting in favor thereof, President Liddle declared the said
resolution duly passed and adopted.

Alderman Fryer introduced a resolution adopting the plans,
specifications and estimate of cost for the construction of curb and gutter
on Third Avenue Northwest, and ordering advertisement for bids to be -
received and opened at 2:00 o'clock P.M.. on July 5th,1938, which was read.
Upon motion by Lemmon second by Fryer,that the said resolution
be adopted as read, and all voting in favor thereof, President Liddle
declared the said resolution duly

Alderman Amundsen introduced a resolution authorizing and
directing the City Engineer to placer bituminous paving on Fourth Avenue
Southwest from Secorid Street Southwest to First Street Northwest and
on Seventh Avenu6 Southwest fr an Sixth Street Southwest to Eleventh Street
'Southwest, which was read.
Upon motion by Fryer second by Amundsen,th9t the said resolution
be adopted as read, and all voting in favor thereof, President Liddle
declared the said resolution.duly passed and -adopted.

Alderman Richman introduced a resolution appropriating $253.05
from the General Fund and ordering payment made to the Rochester Posti-Bullet&
for official publications and printing during May,1938,which was read.

Upon motion by Amundsen,second by Moody,that the said resolution
be adopted as read, and all voting. in favor thereof, President Liddle
declared the said resolution duly passed and adopted.

Alderman Moody introduced a resolution appropriating $336432
from the Permanent Improvement Revolving Fund and ordering payment made to

Harry T. Earle for final estimate on contract for construction of curb

and gutter on Broadway Street South from Fourth Street to Sixth Streets
which was read.

Upon motion by Fryer second by Richman,that the said resolution
'I be adopted as read, and all voting in favor thereof, President Liddle

declared the said resolution duly passed and adopted.

Alderman Moody introduced a resolution appropriating $1255.72
from the Park Improvement Fund and ordering payment made to the Mayo Trust
Fund for payrolls for labor during the half month ending May 31st ,1938,

Upon motion by Richman second by Amundsen,that the siLid resolution be
adopted as read, and all voting in favor thereof, President Liddle declared the said

Alderman Lemmon introduced a resolution appropriating $1022.15 from
the General Fund and $786.10 fromthe Street and Alley Fund and ordering payment made

to the Street and alley Fund for use of equipment during May,1938,which was read.
Upon motion by Lemmon second by Fryer, that the said resolution be

;;adopted as read, and all voting in favor thereof, President Liddle declared the said
resolution duly passed and adopted.
Alderman Amundsen introduced a resolution granting public dance permit
to Ed. E. Kruger for the YI.O.U.W.Hall June 4th and June llth, and fixing the fee at
$6.00, which was read.
Upon motion by Moody second by Richman that the said resolution be

adopted as read, and all voting in favor thereof, President Liddle declared the
!jsaid resolution duly passed and adopted.
Alderman Moody introduced a resolution deeming it expedient and necessary:

that a trunk line sanitary sewer be constructed in First Street Northwest from
!;Thirteenth Avenue to Sixteenth Avenue, a portion of the cost and expense of which shall
i .
I
be paid for by special assessments levied as provided by law, and ordering a bearing
;on the said improvement for 7:30 otclock P.M., on June 13th,1938, which was read.
Upon motion by Moody second by Richman,that the said resolution be
li adopted as read, and all voting in favor thereof, President Liddle declared the said
:resolution duly passed and adopted.
Upon motion by Moody second by Richman, the Common Council adjourned.
