HomeMy WebLinkAboutOrdinance No. 4242 - TextAmendLDM.VariancesandDevelopApplication ORDINANCE NO. ____ AN ORDINANCE CREATING AND ENACTING SUBDIVISION 5 OF SECTION 60.417, AND AMENDING AND REENACTING SECTION 60.151 OF THE ROCHESTER CODE OF ORDINANCES, RELATING TO RESTRICTING A VARIANCE TO THE PROPOSED USE IN THE VARIANCE APPLICATION. THE COMMON COUNCIL OF THE CITY OF ROCHESTER DO ORDAIN: Section 1. Subdivision 5 of Section 60.417 of the Rochester Code of Ordinances is hereby created and enacted to read as follows: Subd. 5. Any variance granted by the Board of Appeals or Commission is only valid for the proposed use outlined in the variance application. Section 2. Section 60.151 of the Rochester Code of Ordinances is hereby amended and reenacted to read as follows: 60.151 Permits, certificates, and variances are valid only for the development specified therein. Conditions attached to an approved development permit are given the same force as if they appeared in the text of the Zoning Ordinance. A development permit is permanent in nature unless the approving body or this Ordinance limits its effective period. An approved permit or certificate is assignable, but an assignment does not discharge any assignee from any obligation owed any local governmental unit in connection with the development unless the applicable unit of government consents to the discharge. Section 3.
