RESOLUTION
WHEREAS, Patrick Egan applied for a Type III, Phase III Conditional Use Permit (#R2017-
032CUP) to allow the construction of an indoor gun range use in the B-4 zoning district. The
property is located on the west side of Commercial Drive S.W., approximately 2000 feet south
th
of 48 Street S.W.; and,
WHEREAS, R.C.O. §§61.146 (Standards for Conditional Use Permits), and 62.1203
(Performance Criteria for Indoor Gun Range) provide the relevant criteria for the review of this
application; and,
WHEREAS, on November 29, 2017, the Rochester Planning and Zoning Commission held
a public hearing on said conditional use permit, reviewed the application according to the
requirements of R.C.O. §§61.146 and 62.1203, and recommended approval based upon Planning
Department staff’s proposed findings of fact and recommendation, subject to the following
conditions:
1. Prior to approval of building permits, the development plans shall be revised
to include the following:
A. The addition of boulevard trees along the Commercial Drive frontage
with a spacing of one tree per 35 feet of frontage.
B. The re-designation of 17 “future parking spaces” into parking spaces
to be constructed with development.
C. The removal of the existing gat valve box top on the abandoned water
service.
2. Prior to building permit approval, Grading and Drainage Plan approval is
required for this application. Execution of a maintenance agreement shall be
required for any private on-site facilities.
3. There is a proposed monument sign structure located north of the north
driveway, which appears to be within a public drainage and utility easement.
Prior to approval of a sign permit, detailed plans for this structure are needed
to determine if it may be permitted within the easement through a revocable
permit. Execution of a City-prepared revocable permit agreement is required
prior to placement of any private improvements (excluding turf and parking lot
features) within the public right-of-way or public easements within the
property.

4. A city-owner contract has been prepared and partially executed for the
proposed relocation of public storm sewer along the easterly and northerly
lines of the property. Prior to building permit approval, the contract will need
to be modified and re-executed to reflect the current construction schedule
versus the prior anticipated schedule.
5. Prior to building permit approval, the site grading and utility plan (sheet
C400) shall be revised to match the approved city-owner contract
construction plans.
6. Prior to building permit approval, the applicable Plant Investment Fee (PIF)
shall be collected.
7. If a portion of the building will be used for food service, a permit or license will
be required from the Olmsted County Public Health Department.
WHEREAS, the Common Council held public hearings on the conditional use request on
December 18, 2017, and permitted all interested persons to be heard; and,
WHEREAS, following the public hearing, the Common Council determined that the
applicant satisfied the conditions of R.C.O. §§61.146 and 62.1203 by a preponderance of the
evidence submitted at the public hearing if the applicant satisfied the above seven conditions.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester
that the Conditional Use Permit #R2017-032 requested by Patrick Egan is granted.
BE IT FURTHER RESOLVED that the approval of Conditional Use Permit #R2017-
032CUP is subject to the seven conditions as stated above.
