RESOLUTION
BE IT RESOLVED by the Common Council of the City of Rochester that the City to approve
the amendment of the current professional services agreement with SEH and Barr Engineering as
outlined in the attached supplemental letter agreement for additional engineering services totaling
$27,379.65. Funding will come from the previously approved City project J6608 that is funded by
the Storm Water Utility.
The Mayor and City Clerk are authorized and directed to execute this agreement on behalf
of the City.

Short Elliott Hendrickson Inc. (SEH)appreciates the opportunity to help the City address this important
project. Supplemental Letter Agreement No. SW-11dated May 10, 2016 and approval by the City Council
on May 2016 pertained to preliminary designfor Rocky Creek Phase 3 Stream Stabilization.Supplemental
Letter Agreement 11A approved on November 21, 2016 addresses final design and contract documents.
This Supplemental Letter Agreement 11B is based on additional services on the part of our subconsultant
Barr Engineering.
BACKGROUND
Rocky Creek Ravine stream stability issues were investigated in 2011 as part of a feasibility study
completed by Yaggy-Colby and Associates (now SEH). Bank erosion and channel degradation could
eventually impact two sanitary sewer crossings beneath the ravine and contribute to sediment loading in
the South Fork Zumbro River.
In May 2016, the SEH-Barr team was authorized to complete the preliminary design for creek
stabilization and develop a scope of services for final design and the development of contract documents.
In early August, Barr completed a Basis of Design report for Rocky Creek, Following an internal review,
the report was forwarded to City staff on August 9, 2016.

In November of 2016,the SEH-Barr team was authorized to complete final design and contract
documentsfor stabilizing Rocky Creek. Construction documents were anticipated to be complete by
February 17, 2017 and construction was to occur in 2017.
The following summarizes progress on the project:
February 9, 2017 –Preliminary design drawings were provided to the City.
February 21, 2017 –Plan Review Meeting
February 21, 2017 –Revised schedule providedwith 90% plans on April 3, 2017
March 31, 2017 –Barr at 80% of budget.
April 4, 2017 –Barr made direct request to City staff for two week extension
April 21, 2017 –Additional Survey requested.
May 9, 2017 –Preferred option identified; Barr indicates that they will need an amendment.
June 6, 2017 –City repeats interest in building project in 2017. 90% plans expected June 16.
June 16, 2017 –90% plans delivered.
June 22, 2017 –City indicates that construction should be delayed until 2018.
August 2, 2017 –Design review meeting
August 25, 2017 –90% plans submitted for review.
September 8, 2017Receive City Comments on 90% Plans
October 27, 2017Complete Construction Documents
BASIS OF COMPENSATION
Barr Engineering served as principal investigator/designerfor this project. To date, Barr hadbeen
authorized up to $50,730to prepare the feasibility study, design and plans and specifications. To date,
Barr has billed $50,710.14and hasspent $78,089.700 as of January 26, 2108.Barr has discussed the
increase in cost with youon January 3, 2018(email).The primary reasons for the cost overrun are that (1)
the design effort requiredmore effort than originally anticipated, and (2) the design schedule took longer
than planned due to additional design iterations necessaryto match the project scope to the construction
budget.
We are requesting that the contract amount be amended to cover the cost over-runs by Barr Engineering.
Compensation shall be on an hourly basis, based on the actual hours worked for SEH personnel assigned
to the project, plus reimbursable expenses. The cost estimate is based on the project scope and schedule
identified herein.
With the requested amendment of $27,379.65, the overall contract amount for this project will be
$91,879.65.

This Supplemental Letter Agreement shall be the basis of work by SEH on the project described in this
letter. If you are in agreement with the terms, please execute this Supplemental Letter Agreement with
proper signatures and return one original to our offices.
