HomeMy WebLinkAboutResolution No. 072-18 - RevocablePermit.FirstBroadwayRochester, LLC RESOLUTION BE IT RESOLVED by the Common Council of the City of Rochester that the City grant a revocable permit to First Broadway Rochester, LLC, owner of property described as Lot 1, Block 1, Urban on First Subdivision, Olmsted County, Minnesota to allow the placement of the following improvements to be located within the right of way of First Avenue S.W., and South Broadway adjacent to its property, within the public alley adjacent to its property, and within a public right of way easement located on the property: A. The following to be located in 1st Avenue SW right of way adjacent to the Property: · Landscaping · Balconies - maximum projection is 1’-0”, minimum clearance is 16’-10” · Lighting - maximum projection is 10” · Sign - maximum projection is 1’-4”, minimum clearance is 14’ 9”, max letter height to be no taller than 2’. B. The following to be located in South Broadway Avenue right of way adjacent to the Property: · Landscaping · Balconies - maximum projection is 6”, minimum clearance is 24’-0” · Sign - maximum projection is 1’-0”, minimum clearance is 10’-4”, max letter height to be no taller than 2’ · Bike rack - must be secured to the ground C. The following to be located in the Easement Area located on the Property: · 54” diameter underground retention system 1 · Rate Control Structure D. The following to be located over a portion of the public alley adjacent to the north side of the Property: · Private walkway BE IT FURTHER RESOLVED that the granting of the revocable permit is subject to the following conditions: 1. Permittee will install and maintain the improvements at its own expense. Permittee will also be responsible for the cost to remove and replace the improvements, as well as any damages to public facilities; 2. Permittee must maintain the City-owned property; 3. Permittee must pay $124.37 to the City for document preparation and recording; 4. Permittee must hold the City harmless, by insurance coverage or by agreement, and must defend and indemnify the City for any and all damages resulting from his use of the City’s property; 5. Permittee must execute any document required by the City Attorney's Office prior to delivery of the permit; 6. Permittee must remove any encroachment from the City’s property at its own cost should the City make such a request. Should the City remove any encroachment, Permittee shall reimburse the City for any costs the City incurs; 7. Permittee will not to seek any relocation costs or other damages from the City for any reason should Permittee be required to remove any encroachment from the City’s property; and 8. This permit may not be assigned without the City’s approval.
