RESOLUTION
WHEREAS, pursuant to the City of Rochester’s Capital Improvement Plan, a report
has been prepared by the City Engineer with reference to proposed Improvement

Project No. J7326, Reconstruct 4 Street SW from 1 Avenue SW to 6 Avenue SW,
and this report was received by the council on February 21, 2018; and
WHEREAS, the report provides information regarding whether the proposed
improvement is necessary, cost-effective, and feasible; whether it should best be made
as proposed or in connection with some other improvement; the estimated cost of the
improvement as recommended; and a description of the methodology used to calculate
individual assessments for affected parcels.
NOW THEREFORE, BE IT RESOLVED by the Common Council of the City of
Rochester, Minnesota:
1. The council will consider the improvement of such street in accordance with the
report and the assessment of abutting property for a portion of the cost of the
improvement pursuant to Minnesota Statutes, Chapter 429 at an estimated total
cost of the improvement of $4,607,342 with estimated street reconstruction costs
to be assessed in the amount of $570,623 and estimated sidewalk costs to be
assessed in the amount of $313,568.

2. A public hearing shall be held on such proposed improvement on the 19 day of
March, 2018, in the Council/Board Chambers of City Hall at 7 p.m., and the Clerk
shall give mailed and published notice of such hearing and improvement as
required by law.

3. A public hearing shall be held on the proposed assessments on the 16 day of
April, 2018, in the Council/Board Chambers of City Hall at 7 p.m. All persons
owning property affected by such improvement will be given an opportunity to be
heard with reference to such assessment.
4. The City Clerk is hereby directed to cause a notice of the hearing on the
proposed assessment to be published once in the official newspaper at least two
weeks prior to the hearing, and she shall state in the notice the total cost of the
improvement. She shall also cause mailed notice to be given to the owner of
each parcel described in the assessment roll not less than two weeks prior to the
hearing.
5. The owner of any property so assessed may, at any time prior to certification of
the assessment to the county auditor, pay the whole of the assessment on such
property, with interest accrued to the date of payment, to the City Clerk, except
that no interest shall be charged if the entire assessment is paid within 30 days
from the adoption of the assessment. An owner may at any time thereafter, pay to
the City Clerk the entire amount of the assessment remaining unpaid, with
interest accrued to December 31 of the year in which such payment is made.
Such payment must be made before November 15 or interest will be charged
through December 31 of the succeeding year.
6. The Council accepts the feasibility report prepared by the City Engineer and
adopts the Geometric Layout.
