HomeMy WebLinkAboutResolution No. 120-18 Project J7326 Ordering Improvement and assessment roll 20180402 RESOLUTION WHEREAS, pursuant to the 2018 – 2022 DMC Capital Improvement Plan, a report has been prepared by the City Engineer with reference to proposed Improvement Project No. J7326, Reconstruct 4th Street SW from 1st Avenue SW to 6th Avenue SW, and this report was received by the council on February 21, 2018; and WHEREAS, the report provides information regarding whether the proposed improvement is necessary, cost-effective, and feasible; whether it should best be made as proposed or in connection with some other improvement; the estimated cost of the improvement as recommended; and a description of the methodology used to calculate individual assessments for affected parcels; and WHEREAS, a resolution of the Common Council adopted February 21, 2018, fixed a date for a council hearing on Improvement J4691; and WHEREAS, ten days’ mailed notice and two weeks’ published notice of the hearing th was given, and the hearing was held thereon on the 19 day of March, 2018, and was continued to the 2nd day of April, 2018, at which all persons desiring to be heard were given an opportunity to be heard thereon; and WHEREAS, estimated costs have been calculated for Improvement Project No. 7326, by the City Engineer and the estimated total cost for such improvement is $4,607,342.00; NOW THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester, Minnesota: 1. Such improvement is necessary, cost-effective, and feasible as detailed in the Feasibility Report. 2. Such improvement is hereby ordered as proposed in the council resolution adopted st the 21 day of February, 2018. 3. Such improvement has no relationship to the comprehensive municipal plan. 4. City Engineering staff are hereby designated as the engineers for this improvement. The engineer shall prepare plans and specifications for the making of such improvement. 5. The City Council declares its official intent to reimburse itself for the costs of the improvement from the proceeds of tax exempt bonds. 6. The portion of the cost of such improvement to be assessed against benefited property owners is declared to be $904,269.00. 7. Assessments shall be payable in equal annual installments extending over a period of 10 years, the first of the installments to be payable on or before the first Monday in January, 2019, and shall bear interest at the rate of 4.5 percent per annum from the date of the adoption of the assessment resolution. 8. The city clerk, with the assistance of the city engineer, shall forthwith calculate the proper amount to be specially assessed for such improvement against every assessable lot, piece or parcel of land within the district affected, without regard to cash valuation, as provided by law, and she shall file a copy of such proposed assessment in her office for public inspection. 9. A public hearing shall be held on such proposed assessment, as previously scheduled on April 16, 2018.
