RESOLUTION
WHEREAS, Arcon Land III, LLC, owner, has shown to the satisfaction of the City of Rochester
Common Council that it has complied with all conditions of approval imposed upon its Land
Subdivision Permit (Final Plat) and all applicable laws and ordinances;
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester,
Minnesota, that after a hearing duly noticed and held on June 4, 2018, the following plat of
lands in Olmsted County, Minnesota are to be known and designated as follows:
That part of the Northwest Quarter of Section 8, Township 107 North, Range 14 West,
Olmsted County, Minnesota, described as follows:
Commencing at the southwest corner of the Northwest Quarter of said Section 8;
thence North 00 degrees 57 minutes 22 seconds East, assumed bearing, along the
west line of said Northwest Quarter, 1490.00 feet to the south line of SUMMIT POINTE
FIFTH, according to the recorded plat thereof; thence South 89 degrees 02 minutes 38
seconds East, along said south line, 569.05 feet to the southeast corner of Lot 6, Block
3, in said SUMMIT POINTE FIFTH for the point of beginning (the next 3 courses are
along the easterly line of said SUMMIT POINTE FIFTH); thence North 34 degrees 14
minutes 11 seconds East, 143.26 feet; thence North 55 degrees 45 minutes 49
seconds West, 6.44 feet; thence North 34 degrees 14 minutes 11 seconds East,
278.54 feet to the southerly line of SUMMIT POINTE FOURTH, according to the
recorded plat thereof (the next 2 courses are along said southerly line); thence South
57 degrees 02 minutes 38 seconds East, 211.02 feet; thence South 68 degrees 02
minutes 38 seconds East, 548.01 feet to the westerly line of said SUMMIT POINTE
FOURTH; thence South 01 degree 58 minutes 17 seconds East, along said westerly
line, and along the westerly line of SUMMIT POINTE THIRD, according to the recorded
plat thereof, 696.75 feet to the northeast corner of Lot 9, Block 1, in said SUMMIT
POINTE THIRD; thence South 87 degrees 57 minutes 22 seconds West, along the
north line of said SUMMIT POINTE THIRD, 285.91 feet; thence North 43 degrees 56
minutes 06 seconds East, 179.09 feet; thence North 29 degrees 50 minutes 14
seconds East, 170.65 feet; thence North 76 degrees 44 minutes 39 seconds West,
224.00 feet; thence North 13 degrees 15 minutes 21 seconds East, 55.00 feet; thence
North 76 degrees 44 minutes 39 seconds West, 586.59 feet; thence North 00 degrees
57 minutes 22 seconds East, 23.99 feet; thence North 89 degrees 02 minutes 38
seconds West, 90.95 feet; thence North 00 degrees 57 minutes 22 seconds East,
132.00 feet to the point of beginning.
Containing, 10.26 acres, more or less.
TO BE KNOWN AS SUMMIT POINTE SIXTH, submitted by Arcon Development on behalf of
Arcon Land III, LLC, owner, is hereby approved and all dedications of land or interests in land
for public purposes as shown on said plat are hereby accepted, subject to the following five
conditions:
1. Prior to recording the Final Plat the applicant must either record an executed Boulevard
Tree Green Facilities Agreement, or make a payment to the City Park and Recreation
Department for the development’s boulevard tree obligation.
2. Parkland Dedication needs must be met prior to recording the Final Plat.
3. A temporary, paved turn around will be required at the end of Summit Pine Road NW when
the road is constructed.
4. Execution of a City-Owner Contract, and dedication of any applicable public easements, is
required prior to construction of any public infrastructure.
5. Charges/fees applicable to the development of this Property are/will be addressed in City-
Owner Contract, and Development Agreement.
