RESOLUTION
WHEREAS, on November 6, 2017, the City of Rochester Common Council approved
Incentive Development Preliminary Plan #R2017-029CUP for EKN Development Group subject to
ten conditions of approval; and,
WHEREAS, EKN subsequently requested revisions to #R2017-029CUP. Most changes
were minor, but one major change was to allow a digital billboard on the façade of the building.
WHEREAS, at the June 4, 2018 Rochester City Council Meeting, the Council concluded
that the minor changes should be approved. The Council did not agree to allow the electronic
billboard, but did direct staff to offer a sign credit to the owner of the billboard if it would move the
project forward.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester
that Incentive Development Preliminary Plan #R2017-029CUP by EKN Development Group shall
be amended as follows:
2. Submission of final development plans shall include the following information:
a. Ideal widths for sidewalk zones from Section B.01 in the DMC Design Guidelines shall
be shown on the building plans. If these widths cannot be achieved, an explanation shall be
provided.
b. A detailed list of building materials shall be provided.
c. A detailed list of ground surface materials shall be provided.
d. Street furniture and other pedestrian elements shall be identified.
e. The final development plans shall demonstrate compliance with vehicle and bicycle
parking requirements, or shall include a request for a modification to these standards.
f. The landscape area included in the landscape area calculation shall be shown on the
plans.
g. Compliance with boulevard tree requirements in the Zoning Ordinance or a
recommendation from the Rochester Park and Recreation Department for a plan for
alternative compliance.
h. Locations and screening of mechanical equipment shall be identified.
3. Prior to final development plan approval, Grading & Drainage Plan approval is required for this
project.
4. Prior to final development plan approval, the conditions of the traffic impact report shall be
revised to accommodate the alternative site plan layout and reviewed by the Public Works
Department.
5. An ADA compliant pedestrian access shall be provided from the public pedestrian facilities
along 1st Ave NW to the building entrance.
6. Prior to building permit approval, a City prepared agreement shall be executed to address in
part, the developer’s financial obligations for signal and street modifications that may be required
to Civic Center Drive NW, and 1st Ave NW.
7. Any encroachments into public easements or public ROW, other than turf / boulevard trees, will
require prior City Council approval of a legal document deemed appropriate by the Public Works
Director and City Attorney. The requirement for an appropriate legal document includes any
private facilities which will extend into the public right-of-way or public easements, above, at, or
below grade.
8. Execution of a City-Owner Contract will be required for any new public improvements required
for this proposed redevelopment, as well as, for any reconstruction of existing public infrastructure.
9. The existing water service must be abandoned at the main by cutting out the tapping sleeve.
Provide a new 8" gate valve on the water service near the 6" water main.
10. Charges/fees applicable to the development of this property include the following and unless
otherwise stated shall be paid prior to issuance of utility connection permit(s), or at the City’s
discretion, within 30 days after invoicing (rates are valid through 7/31/18 and subject to an ENR
adjustment thereafter):
Sewer Availability Charge (SAC)
Water Availability Charge (WAC)
Storm Water Management Area Charge - If applicable
Plant Investment Fee (PIF)
11.The applicant shall propose with their final plan application an end date for removal of the
electronic message board.
12. The applicant shall provide with the final submittal the technical design detail to limit the
impact of the electronic billboard to the surrounding neighborhood, alternatively the applicant can
consider the acceptance of sign credit for the electronic billboard for the removal of the electronic
billboard from this location. (as proposed on the building or at the current location).
The Mayor and City Clerk are authorized to execute any and all documents necessary to
implement this resolution.
