HomeMy WebLinkAboutResolution No. 300-18 PraiseTabernacleChurch.CUPR2018-022 RESOLUTION WHEREAS, Praise Tabernacle Church Energy requested approval for Conditional Use Permit #R2018-022CUP, which is a request to allow an additional to the building within the strd setback area. The site is located on 21 Street SW, 100 feet west of 3 Ave SW. WHEREAS, The Land Development Manual (LDM) allows a non-conforming structure to be enlarged or altered if the City Council finds that the adverse effects on the occupants and neighboring properties will not be greater than if the original non-conforming use/structure continued. The findings to be considered are in LDM 65.330. The City Council adopts the Findings of planning staff as shown in the Staff Report. WHEREAS, on August 20, 2018, the City Council reviewed the application and recommended approval with the following conditions: 1. The Site Plan must be updated with the following information: a. A Zoning Standards Table identifying: i. The R-1 zoning district as the existing zoning district, ii. Area Accessory Development as the existing use of the site, iii. A “D” Bufferyard standard along the west property line, including the required number and type of plantings proposed, iv. An “A” Exterior Lighting standard along the west property line, v. The existing and proposed Floor Area of the structure, vi. The number of seats in the existing sanctuary, and vii. The number of parking spaces identified on the plan. b. A “D” Bufferyard along the west property line, which includes a 10-foot bufferyard width and the specific species and location of each required tree and shrub. c. All landscape and paved areas. d. The area behind the structure shall be labeled “landscape area” and the Site Plan shall identify bollards or landscaping at the southwest corner of the parking lot to prevent the use of the non-approved driveway. 2. A Photometric Plan must be submitted for the new light identified on the proposed addition. The Photometric Plan must meet the requirements of LDM 63.210, prior to the issuance of building permits. 3. If required, a Grading and Stormwater Management Plan must be approved prior to issuance of building permits. 4. The Building Elevation Plans that were submitted with the application appear to be incorrect. The Building Elevation Plans should be amended as follows: a. The “East Elevation” should be labeled the “West Elevation” b. The “North Elevation” should be labeled the “South Elevation” c. The “The South Elevation” should be labeled the “North Elevation” 1 5. In lieu of making improvements concurrent with construction of this project, the Owner shall execute a City prepared Individual Site Development Agreement to address in part, existing private encroachments within the public ROW, future construction of pedestrian facilities, and future improvements to 21st St SW. Execution of the Agreement by the Owner shall be required prior to building permit approval. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester that, based upon the above-stated findings of fact, the Applicant has shown by a preponderance of the evidence submitted at the public hearing that it has satisfied the above criteria subject to the imposition of the above-stated ten conditions of approval. BE IT FURTHER RESOLVED that the City approve Conditional Use Permit #R2018- 022CUP requested by Praise Tabernacle Church, subject to the above-stated condition of approval.
