HomeMy WebLinkAboutResolution No. 314-18 - VillageCapitalCorporation.CUP.R2018-027 RESOLUTION WHEREAS, Village Capital Corporation requested approval for Conditional Use Permit #R2018-027CUP, for a substantial land alteration for a cut or fill more than 10 feet in height. The site is 20 acres and is located at the southeast corner of the intersection of Alpha Parkway NW and 46th Avenue NW. WHEREAS, Findings A-Q in the staff report are adopted. WHEREAS, on August 8, 2018, the City of Rochester Planning and Zoning Commission reviewed the application according to the requirements of R.C.O §§ 61.146 and 62.1105 and recommended approval with staff’s recommended findings and conditions. WHEREAS, on August 17, 2018, the applicant submitted a revised Substantial Land Alteration Exhibit to the Rochester-Olmsted Planning Department. This exhibit was reviewed against the proposed conditions from the Planning and Zoning Commission and was found to address the intent of condition #3. WHEREAS, on September 5, 2018, the City of Rochester Common Council held a public hearing to consider this application and adopted findings of fact and recommended approval subject to the conditions listed below, based on a revised Substantial Land Alteration exhibit submitted by the applicant on August 17, 2018. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester that, based on the above stated findings of fact, the applicant has shown by a preponderance of the evidence submitted at the public hearing that it has satisfied the above criteria subject to the imposition of the conditions of approval stated below. BE IT FURTHER RESOLVED, that the Common Council of the City of Rochester approve Conditional Use Permit #R2018-027CUP requested by Village Capital Corporation, subject to the below stated conditions of approval: 1) An approved Grading and Drainage Report is required prior to implementation of the SLA. 2) A Landscape Plan will be required at the development review phase and shall include the reclamation plan tree plantings along the perimeter of the site.
