RESOLUTION
WHEREAS, Regency Multi-Family requested approval for Conditional Use Permit
#R2018-028CUP, which is a for a substantial land alteration for a cut or fill in excess of ten feet in
height. The site is located at the northeast corner of the intersection of Alpha Parkway NW and
50th Avenue NW.
WHEREAS, Findings A-Q in the staff report are adopted.
WHEREAS, on August 8, 2018, the City of Rochester Planning and Zoning Commission
reviewed the application according to the requirements of R.C.O. § 61.146 and R.C.O. § 62.1105
and recommended approval with staff’s recommended findings and conditions.
WHEREAS, on August 17, 2018, the applicant submitted a revised substantial land
alteration exhibit to the Rochester Olmsted Planning Department. This exhibit was reviewed
against the proposed conditions from the Planning and Zoning Commission and were found to
address the intent of conditions 1 and 4.
WHEREAS, on September 5, 2018, the City of Rochester Common Council held a public
hearing to consider this application, and adopted the findings of fact and recommended approval
subject to conditions as listed below by Planning staff based on a revised substantial land
alteration exhibit submitted by the applicant on August 17, 2018.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester
that, based upon the above-stated findings of fact, the Applicant has shown by a preponderance
of the evidence submitted at the public hearing that it has satisfied the above criteria subject to
the imposition of the below-stated two conditions of approval.
BE IT FURTHER RESOLVED that the City approve Conditional Use Permit #R2018-
028CUP requested by Regency Multi-Family, subject to the conditions of approval shown below:
1. Prior to site development plan approval, Grading & Drainage Plan approval is required.
2. A Landscape Plan will be required at the development review phase and shall include the
reclamation plan tree plantings along the perimeter of the site.
