RESOLUTION
WHEREAS, Dan Penz, owner, has shown to the satisfaction of the City of Rochester Common
Council that it has complied with all conditions of approval imposed upon its Land Subdivision
Permit (Final Plat) and all applicable laws and ordinances;
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester,
Minnesota, that after a hearing duly noticed and held on August 20, 2018, the following plat of
lands in Olmsted County, Minnesota are to be known and designated as follows:
Lot 4, Block 1, BARCLAY SQUARE FIRST REPLAT, according to the plat thereof, on
file and of record, in the office of the County Recorder, Olmsted County, Minnesota.
TO BE KNOWN AS BARCLAY SQUARE SECOND REPLAT, submitted by Dan Penz, owner,
is hereby approved and all dedications of land or interests in land for public purposes as
shown on said plat are hereby accepted subject to the following three conditions:
1. Prior to recording the Final Plat, a cross access agreement must be submitted to the
Planning Department demonstrating perpetual cross access rights for vehicle traffic.
2. Prior to recording the Final Plat, the applicant must demonstrate compliance with the
building code, to the satisfaction of the Rochester Building Safety Department. If a
unity agreement is the chosen mechanism to meet building code standards, it must
be executed and recorded for each lot prior to, or concurrent with, recording the
Final Plat.
3. Prior to recording the Final Plat, the boulevard tree obligation shall be met.
