HomeMy WebLinkAboutResolution No. 297-18 - Final Plat R2018-008 Educational Center Subdivision RESOLUTION WHEREAS, Jacmar, LLC, owner, has shown to the satisfaction of the City of Rochester Common Council that it has complied with all conditions of approval imposed upon its Land Subdivision Permit (Final Plat) and all applicable laws and ordinances; NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester, Minnesota, that after a hearing duly noticed and held on August 20, 2018, the following plat of lands in Olmsted County, Minnesota are to be known and designated as follows: That part of the Northeast Quarter of Section 28, Township 107 North, Range 14 West, Olmsted County, Minnesota, described as follows: Beginning at the southwest corner of the Northeast Quarter of said Section 28; thence North 00 degrees 54 minutes 07 seconds East, assumed bearing, along the west line of said Northeast Quarter, 539.64 feet to the southeast corner of Lot 3, Block 2, HENDRICKS’ SUBDIVISION, according to the recorded plat thereof; thence North 79 degrees 28 minutes 58 seconds East, 279.05 feet; thence North 00 degrees 54 minutes 07 seconds East, parallel with the west line of said Northeast Quarter, 497.87 feet to the southerly line of TILL’S FIRST SUBDIVISION, according to the recorded plat thereof; thence North 71 degrees 39 minutes 50 seconds East, along said southerly line, 303.03 feet to the westerly right of way line of the former Dakota, Minnesota and Eastern Railroad; thence South 37 degrees 50 minutes 00 seconds East, along said westerly right of way line, 1508.44 feet to the south line of said Northeast Quarter; thence North 89 degrees 42 minutes 21 seconds West, along said south line, 1503.58 feet to the point of beginning. Containing 23.88 acres, more or less. TO BE KNOWN AS THE EDUCATIONAL CENTER SUBDIVISION, submitted by Jacmar, LLC, owner, is hereby approved and all dedications of land or interests in land for public purposes as shown on said plat are hereby accepted, subject to the following six conditions: 1. Prior to recording the Final Plat, the applicant shall submit a revised Preliminary Plat which identifies a 30-foot private access easement from 22nd Street NW to Jeremiah Lane NW. 2. The private access easement identified on the Final Plat shall be recorded prior to / concurrent with recording the Final Plat. 3. The pedestrian facilities easement identified on the Final Plat shall be recorded prior to / concurrent with recording the Final Plat. 4. Prior to recording the Final Plat, the boulevard tree obligation shall be met. 5. Execution of a City-Owner Contract, and dedication of any applicable public easements, is required prior to construction of any public infrastructure. 6. Charges/fees applicable to the development of this Property are/will be addressed in CityOwner Contract, and Development Agreement.
