HomeMy WebLinkAboutResolution No. 356-18 - MayoWarehouse.IncenDevelopPrelimAmendment.R2018-033CUP RESOLUTION WHEREAS, Mayo Clinic requested approval for an amendment Conditional Use Permit #R2018-033CUP, to expand the existing archives warehouse. The site is 1.13 acres and is located on the north side of Civic Center Drive NW, and is on the northwest corner of the North Frontage Road and 8 1/2 Avenue NW. WHEREAS, the project is being proposed through the Incentive Development Conditional Use Permit process because the proposed floor-area-ratio (FAR) is beyond what is permitted by the underlying M-1 Zoning District; and, WHEREAS, The proposal is consistent with Comprehensive Plan 2040. WHEREAS, The Council adopts staff findings as described in the staff report dated September 26, 2018, and finds the proposal meets the regulations in R.C.O. § 62.630 (subd. 2) Conditional Use Permit Incentive Development Preliminary Plan. WHEREAS, The Council adopts staff findings 4, 5, 6, and 7 and finds the proposal meets four incentives in R.C.O. § 62.658 All Development. WHEREAS, on September 26, 2018, the City of Rochester Planning and Zoning Commission reviewed the application according to the requirements of R.C.O. § 61.146 and R.C.O. § 62.630 and recommended Approval with staff’s conditions. WHEREAS, on October 15, 2018, the City of Rochester Common Council held a public hearing to consider this application, and adopted the findings of fact and recommended approval subject to conditions one through seven proposed by the Planning Department and recommended by the Planning and Zoning Commission. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester that, based upon the above-stated findings of fact, the Applicant has shown by a preponderance of the evidence submitted at the public hearing that it has satisfied the above criteria subject to the imposition of the seven conditions of approval shown below. BE IT FURTHER RESOLVED that the City approves Conditional Use Permit #R2018- 033CUP requested by Mayo Clinic, subject to the conditions of approval shown below. CONDITIONS 1. Prior to building permit approval, site and landscaping plans, approved by Rochester Public Works and RPU, showing the interim right-of-way design for 8 ½ Avenue NW shall be submitted to Planning Staff. Both plans shall demonstrate compliance with the Rochester Zoning Ordinance and Land Development Manual. The interim landscaping plan shall demonstrate compliance with boulevard tree requirements. 1 2. Prior to building permit approval, a revised site plan showing the addition of one or more pedestrian focal points with special paving as specified by Section 63.273 of the LDM shall be submitted to the Planning Department. 3. Prior to building permit approval, access through proposed parking area must be guaranteed through one of the following options: 1) recording of a final plat to combine the northern two parcels within the development or 2) recording of a shared access easement permitting access between the two parcels. 4. Grading & Drainage Plan approval is required, as well as, payment of any applicable Storm Water Management Plan Area Charge (SWMPAC) for any net increase in impervious surface. 5. Prior to building permit approval, dedication of additional public right-of-way and conveyance of necessary easements from the Owner and from the abutting parcel to the east, as required by the City Engineer, shall be completed. 6. Execution of a City-Owner Contract is required prior to construction of the proposed public improvements associated with this project. 7. There is a Sewer Availability Charge (SAC) and a Water Availability Charge (WAC) applicable to the portion of the Property currently identified as PIN#26515 & PIN#55828 (totaling 0.51 acres). These obligations will be included in the City-Owner Contract and collected through invoicing after Contract approval.
