R2002-019CUP CORRECTIVE RESOLUTION WHEREAS, Planning staff found Resolution 430-02 adopted by the Council on July 2, 2002 contained an incorrect legal description. The legal description shows the site as being in Halls First Addition, when the site is in Halls Second Addition. WHEREAS, this Resolution shall correct the legal description in the below paragraph with the deletions being shown with a strikethrough and additions being shown by underline. The rest of the original Resolution shall remain the same. WHEREAS, Bowman Tool applied for an Incentive Development Preliminary Plan (#02-19) to allow the addition to the existing Bowman Tool building that would exceed the permitted floor area ratio. The property is located at 1310 Valleyhigh Drive N.W., in the City of Rochester. It is legally described as Lots 1 and 2, Block 1, Halls First Second Addition; and, WHEREAS, the Applicant is proposing to construct an enclosed storage area within the M- 1 (Mixed Commercial-Industrial) zoning district. Within this zoning district, a floor area ratio of .5 is permitted. The Applicant is requesting approval for a floor area ratio of up to .76; and, WHEREAS, R.C.O. § 62.630 sets forth the criteria for incentive developments; and, WHEREAS, based upon Section 62.630, the Planning and Zoning Commission recommended the following findings of fact: Preliminary Development Plan Criteria: a) Suitability of the Area: The proposed site is suitable as the location for an Incentive Development. The proposed use should be compatible with the existing land uses in the area. b) Site Design Criteria: 1) Capacity of Public Facilities: Utilities exist adjacent to this project. Some utilities may need to be relocated (i.e., water and electric) to accommodate this development. The applicant will need to coordinate these modifications or improvements with the appropriate agencies. The developer is responsible for any costs associated with relocation of utilities. 2) Geologic Hazards: Not applicable. 3) Natural Features: Not applicable. 4) Traffic Generation Impact: Not applicable. 5) Height Impacts: Not applicable. 6) Setbacks: The proposed addition complies with all required setbacks. 7) Internal Site Design: Not applicable. 8) Screening and Buffering: The project consists of enclosing an outdoor storage area. The new structure will help secure and protect products and provide a more aesthetically pleasing appearance from the neighboring property to the north. 9) Ordinance Requirements: There is an agreement between Bowman Tool and Machining, Inc., and Colonial Lanes Bowling (located to the north). This agreement states that Bowman Tool can use some of Colonial Lanes parking lot during the daytime hours around 5:30 p.m. and in turn Colonial Lanes can use Bowman Tool’s parking in the evening to accommodate Colonial Lanes patrons. WHEREAS, the Commission, following its public hearing, recommended approval subject to the following conditions: 1. Any existing Rochester Public Utilities-owned electric facilities that need to be relocated as a result of this development shall be relocated at the expense of the developer. A new electric utility easement may need to be granted. 2. If the relocation of public sanitary sewer, storm sewer or watermain is required, the execution of a City/Owner Contract must be executed for this project. 3. A storm water management fee is applicable to any new additional areas of impervious surface if on-site detention is not provided. 4. The owner is required to execute a contribution agreement for the future reconstruction of Valley High Drive N.W. 5. Any needed sidewalk panel or curbing repair or replacement work, along Valleyhigh Drive N.W., shall be done concurrent with this project at the owner’s expense. 6. Separate grading plan approval is required for this project if grading involves more than 50 cubic yards of material. WHEREAS, the Common Council held a public hearing on the Incentive Development Preliminary Plan #02-19 Permit request on July 1, 2002, and permitted all interested persons to be heard. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester that it adopt the Planning and Zoning Commission's findings of fact and that the Incentive Development Conditional Use Permit requested by Bowman Tool is granted subject to the above six conditions.
