HomeMy WebLinkAboutResolution No. 397-18 - AboretumSpecialDistrict.FinalSitePlan.R2018-006SD.TailwindRochester,LLC RESOLUTION WHEREAS, Tailwind Rochester, LLC requested approval for an Final Site Plan within the Arboretum Special District #R2018-006SD, which is for a 40,525 square foot medical office development. The site is 3.38 acres in size and is located on the north side of Members Parkway NW at the northern terminus of Nottingham Drive NW. WHEREAS, the project is being proposed through the Final Site Plan process specified within the Arboretum Special District; and, WHEREAS, The proposal is consistent with the associated Project Development Plan for Think Plaza, applicable requirements of the Arboretum Special District, and applicable zoning requirements. WHEREAS, The Council adopts staff findings as described in the staff report dated November 14, 2018, and finds the proposal meets the regulations in R.C.O. § 60.327 Special Districts. WHEREAS, on November 14, 2018, the City of Rochester Planning and Zoning Commission held a public hearing to consider this application and adopted the findings of fact and recommended approval subject to conditions one through seven proposed by the Planning Department. WHEREAS, The Council finds the proposal meets findings in R.C.O. § 61.146 Standards for Conditional Uses and R.C.O. § 62.708, Subd. 3 Criteria for Type III Developments. WHEREAS, on December 3, 2018, the City of Rochester Common Council held a public hearing to consider this application, and adopted the findings of fact and recommended approval subject to conditions one through seven proposed by the Planning Department and recommended by the Planning and Zoning Commission. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester that, based upon the above-stated findings of fact, the Applicant has shown by a preponderance of the evidence submitted at the public hearing that it has satisfied the above criteria subject to the imposition of the below-stated seven conditions of approval. BE IT FURTHER RESOLVED that the City approve the Final Site Plan #R2018-006SD requested by Tailwind Rochester, LLC, subject to the conditions of approval shown below. CONDITIONS 1. Prior to building permit approval, a revised final site plan must be submitted to the Planning Department with the following revisions/information: a) Plans showing compliance with the Pedestrian and Site Design standards of LDM 63.273 b) Lighting/photometric plan showing compliance with lighting standard C. Light fixture details 1 may be necessary to show compliance. c) The proposed floor area of the building. d) A revised landscaping plan showing compliance with boulevard tree requirements of 64.160 of the Zoning Ordinance. e) The intended screening method for exterior storage/trash areas. 2. Signage shown on the site plan shall comply with the standards of the B-4 zoning district. 3. Prior to approval of building permits, access easements necessary for vehicular access to the site from Members Parkway and adjacent driveways shall be recorded and submitted to the Planning Department. 4. Dedication of a 6 ft wide Pedestrian Facilities easement is required abutting the existing 10 ft wide Utility Easement along the property frontage on Members Parkway NW. 5. Grading & Drainage Plan approval is required for this application, as well as, payment of any applicable Storm Water Management Plan Area Charge (SWMPAC), concurrent with said plan approval. 6. Execution of a City-Owner Contract, and dedication of all applicable easements will be required for any public infrastructure that is to be constructed as part of this project. 7. Prior to building permit approval, an official E911 Address will be required for this property/ building. Any existing E911 Addressing associated with the building and property will need to be validated. An address request application form will need to be filled out and an up-to-date site plan will be required. Address fees maybe applicable.
