HomeMy WebLinkAboutResolution No. 060-19 - R20190-003CUP Incentive Development Prelim Plan North Rock Real Estate RESOLUTION WHEREAS, North Rock Real Estate requested approval for Conditional Use Permit Incentive Development Preliminary Plan #R2019-003CUP, which is for a six-story transient accommodation use (hotel) with two levels of underground parking. The site is 0.42 aces in size and is located on the northwest corner of the intersection of 6th Avenue SW and 2nd Street SW. WHEREAS, the project is being proposed through the Incentive Development Conditional Use Permit process because the proposed development exceeds the maximum permitted Floor Area in the base zoning district; and, WHEREAS, The proposal is consistent with Comprehensive Plan 2040. WHEREAS, The Council adopts staff findings as described in the staff report dated October 10, 2018, and finds the proposal meets the regulations in R.C.O. § 62.630 (subd. 2) Conditional Use Permit Incentive Development Preliminary Plan. WHEREAS, on March 13, 2019 the City of Rochester Planning Commission held a public hearing to consider this application, and adopted the findings of fact and recommended approval subject to conditions one through eight proposed by the Planning Department and amended by the Planning Commission. WHEREAS, The Council finds the proposal meets two incentives in R.C.O. § 62.656 Central Development Core and four incentive in R.C.O. § 62.658 All Development. WHEREAS, on April 1, 2018, the City of Rochester Common Council held a public hearing to consider this application and adopted the findings of fact and recommended approval subject to conditions one through eight proposed by the Planning Department and recommended by the Planning and Zoning Commission. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester that, based upon the above-stated findings of fact, the Applicant has shown by a preponderance of the evidence submitted at the public hearing that it has satisfied the above criteria subject to the imposition of the below-stated eight conditions of approval. BE IT FURTHER RESOLVED that the City approve Conditional Use Permit Incentive Development Preliminary Plan #R2019-003CUP requested by North Rock Real Estate, subject to the conditions of approval shown below. CONDITIONS 1. The following information shall be shown on the final development plans with submission of the Final Incentive Development application: a. Compliance with lighting standard D. b. Revision of the exterior door swings to remain within property lines. 1 c. Removal of upper façade signs on west and north building façades d. Addition of landscape features on the one-story roof at the northwest side of the building. e. The provision of pedestrian focal points within the development as required in LDM 63.273. f. Adjustment of transformer and junction cabinet layout to match the comments provided by RPU-Electric for this application. g. Reduction in the width of the drop-off driveway to accommodate the walkway to be widened to allow for greater separation for pedestrians from the vehicular traffic. h. The plans shall provide a detailed list of ground surface materials planned to identify the proposed accessible walkway connection to 6th Avenue SW and the accessible crossing of the driveway for a second drop-off area along the alley. i. Show a 10-foot or wider sidewalk width along 2nd Street SW, providing protection areas under building overhang along 2nd Street SW. j. Provide an updated list of building materials; replace the EIFS material with a higher- quality exterior material that is not listed as a prohibited material in the DMC Design Guidelines. k. Indicate the number of bicycle spaces intended for Bike Parking room located in the northeast corner of the underground parking level one. l. Show compliance with 1st Floor transparent glass façade requirements. 2. Prior to approval of the Incentive Development Final Plan, a Traffic Control plan for development construction shall be developed by the developer and approved by the City Traffic Engineer. 3. Prior to building permit approval, execution of an Individual Site Development Agreement is required to address Owner’s and City’s obligations regarding items such as improvements to 6th Ave SW, Streetscaping, allowed encroachments into public easements / ROW, seasonal maintenance of the alley (snow removal), general improvements to the alley, development related charges, public use of pedestrian orientated spaces outside of the public ROW, etc. 4. Prior to approval of building permits, a Grading & Drainage Plan approval is required for this project. 5. Prior to submittal of the Final Plan submittal the applicant shall receive approval of the Traffic Study from the City of Rochester Public Works Department. 6. Execution of a City-Owner Contract will be required for all public improvements constructed for this proposed redevelopment, as well as, for reconstruction of any existing public infrastructure within the public ROW or easements. 7. Prior to building permit approval, execution of a separate Revocable Permit Agreement will be required for any private improvements and encroachments within the public right-of-way and other public easements, unless, said encroachments are not otherwise addressed within some other City prepared Agreement. 2 8. Prior to building permit approval, an E911 Address shall be assigned to the property by Olmsted County GIS/Mapping.
