HomeMy WebLinkAboutResolution No. 116-19 - R2019-003CUP Final Plan RESOLUTION WHEREAS, North Rock Real Estate requested approval for Conditional Use Permit Incentive Development Final Plan #R2019-003CUP, for a six-story transient accommodation use (hotel) with two levels of underground parking. The site is 0.42 aces in size and is located on the northwest corner of the intersection of 6th Avenue SW and 2nd Street SW; and WHEREAS, the project is being proposed through the Incentive Development Conditional Use Permit process because the proposed development exceeds the maximum permitted Floor Area in the base zoning district; and WHEREAS, the proposal is consistent with Comprehensive Plan 2040; and WHEREAS, The Council adopts staff findings as described in the staff report dated May 22, 2019, and finds the proposal meets the regulations in R.C.O. § 62.630 (subd. 3) Conditional Use Permit Incentive Development Final Plan; and WHEREAS, on May 22, 2019 the City of Rochester Planning Commission held a public hearing to consider this application and adopted the findings of fact and recommended approval subject to conditions 1-9 proposed by the Planning Department and amended by the Planning Commission; and WHEREAS, The Council finds the proposal meets two incentives in R.C.O. § 62.656 Central Development Core and three incentive in R.C.O. § 62.658 All Development; and WHEREAS, The Council finds justification for the eight modifications requested under R.C.O § 62.712, Modifications; and WHEREAS, on June 17, 2019, the City of Rochester Common Council held a public hearing to consider this application and adopted the findings of fact and recommended approval subject to conditions 1-9 proposed by the Planning Department and amended by the Planning and Zoning Commission. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester that, based upon the above-stated findings of fact, the Applicant has shown by a preponderance of the evidence submitted at the public hearing that it has satisfied the above criteria subject to the imposition of the below-stated nine conditions of approval. BE IT FURTHER RESOLVED that the City approve Conditional Use Permit Incentive Development Final Plan #R2019-003CUP requested by North Rock Real Estate, subject to the conditions of approval shown below. 1 CONDITIONS 1. A REVISED Final Development Plan identifying the following information shall be provided prior to issuance of building permits: a. Compliance with lighting standard D, as measured from the edge of the sidewalk ndth along 2 Street SW and 6 Avenue SW, and compliance with light standard B along the west property line and along the far edge of the public alley (north side). b. Identify the “colored concrete” color proposed for the pedestrian crossing on the north side of the site. c. Indicate access to the rooftop rock garden. d. Remove the note that states “existing utility pole to be relocated under separate RPU project” from the site plan. e. Removal of upper façade signs on west and north building facades. 2. Prior to approval of building permits, the boulevard tree obligation shall be met. 3. A revocable permit will be required for any encroachments, including signs, into the public ROW. 4. Prior to approval of building permits, the existing utility easement located along the northeast of the proposed building shall be vacated and recorded. 5. Prior to approval of building permits, a Grading & Drainage Plan approval is required for this project. 6. Prior to approval of building permits, execution of an Individual Site Development Agreement is required to address Owner’s and City’s obligations regarding items such as improvements to 6th Ave SW, Streetscaping, allowed encroachments into public easements / ROW, seasonal maintenance of the alley (snow removal), general improvements to the alley, development related charges, public use of pedestrian orientated spaces outside of the public ROW (through execution of a Pedestrian Walkway Declaration, and / or a Pedestrian Facilities and ROW Maintenance Easement). 7. Execution of a City-Owner Contract will be required for all public improvements constructed for this proposed redevelopment, as well as, for reconstruction of any existing public infrastructure within the public ROW or easements. 8. Prior to building permit approval, an E911 Address shall be assigned to the property by Olmsted County GIS/Mapping. 9. There are current assessments for City Project associated with J7265 for reconstruction of 2nd St SW.
