RESOLUTION
WHEREAS, F & M Community Bank, owner, has shown to the satisfaction of the City of
Rochester Common Council that it has complied with all conditions of approval imposed
upon its Land Subdivision Permit (Final Plat) and all applicable laws and ordinances;
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Rochester, Minnesota, that after a hearing duly noticed and held on July 8, 2019, the
following plat of lands in Olmsted County, Minnesota are to be known and designated
as follows:
Lots 1, 2, 3, 4, 5, 6 and 9, MARKAY ADDITION, according to the plat thereof on
file and of record in the office of the County Recorder in and for Olmsted County,
Minnesota, described as follows: Commencing at Right of Way Boundary Corner
B30 as shown on the Minnesota Department of Transportation Right of Way Plat
No. 55-49 as the same is on file and of record in the office of said County
Recorder; thence northwesterly on an azimuth of 316 degrees 18 minutes 09
seconds along the boundary of said plat for 83.36 feet to Right of Way Boundary
Corner B31; thence on an azimuth of 90 degrees 15 minutes 56 seconds for
95.56 feet to the point of beginning of Tract A to be described; thence on an
azimuth of 308 degrees 50 minutes 05 seconds for 211.44 feet; thence on an
azimuth of 332 degrees 38 minutes 49 seconds for 64.08 feet; thence northerly
for 154.39 feet on a non-tangential curve, concave to the east, having a radius of
255.28 feet, a delta angle of 34 degrees 39 minutes 09 seconds, and a chord
azimuth of 342 degrees 52 minutes 50 seconds; thence on an azimuth of 00
degrees 27 minutes 25 seconds for 57.52 feet; thence on an azimuth of 90
degrees 21 minutes 02 seconds for 174.60 feet; thence southerly for 396.53 feet
on a non-tangential curve, concave to the west, having a radius of 5678.89 feet,
a delta angle of 04 degrees 00 minutes 02 seconds and a chord azimuth of 170
degrees 43 minutes 56 seconds to the point of beginning.
TO BE KNOWN AS F&M COMMUNITY BANK ADDITION, submitted by F & M
Community Bank, owner, is hereby approved and all dedications of land or interests in
land for public purposes as shown on said plat are hereby accepted, subject to the
following conditions:
1. Execution of a Pedestrian Facilities and right-of way (ROW) Maintenance
Easement shall be recorded prior to or concurrent with recording the Final Plat.
2. A Grading and Drainage Plan shall be approved prior to the issuance of building
permits.
3. The developer’s boulevard tree obligation shall be met prior to the issuance of
building permits.
4. Execution of a Pedestrian Facilities Agreement will be required prior to approval of
building permits.
