HomeMy WebLinkAboutResolution No. 178-19 - Approving R2019-001SD amending the Arboretum Special District RESOLUTION WHEREAS, Lot 3, Block 1, 41st Street Business Park is zoned Special District, Arboretum; and WHEREAS, Matt Jewison, the applicant requested an amendment to the Arboretum Special District, to allow for office, personal service and retail uses on Lot 3, st Block 1, 41 Street Business Park; and WHEREAS, The 41st Street Plaza Project Development Plan establishes the permitted uses and zoning standards specific to each lot within the 41st Street Business Park; and WHEREAS, The proposed special district amendment is consistent with the Arboretum Special District and the Rochester Comprehensive Plan 2040 (P2S); and th WHEREAS, on July 24, 2019 the Rochester Planning and Zoning Commission held a public hearing to consider this application and adopted the findings of fact and recommended approval, subject to one condition proposed by Community Development staff; and WHEREAS, The Council adopts staff findings as described in the staff report dated th July 17, 2019, and finds the proposal meets the regulations in R.C.O. 60.327 (SD, Special Districts), 61.146, (Standards for Conditional Uses) and 62.078 Subd. 2 (Findings for the approval of a Preliminary Type III Development Plan); and th WHEREAS, on August 19 2019, the City of Rochester Common Council held a public hearing to consider this application and adopted the findings of fact and recommended approval subject to the condition proposed by the Community Development and recommended by the Planning and Zoning Commission. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester that, based upon the above-stated findings of fact, the Applicant has shown by a preponderance of the evidence submitted at the public hearing that it has satisfied the above criteria subject to the imposition of the below-stated condition of approval. st BE IT FURTHER RESOLVED that the City approve the amended 41 Street Development Plan (#R2019-001SD) requested by Matt Jewison, subject to the conditions of approval shown below. CONDITIONS st 1. A revised 41 Street Plaza Project Development Plan shall be submitted prior to submittal of the Final Development Plan, that includes: 1 a. Exterior Storage Standards “A” and “T” in the zoning table for Lot 3, Block 1 st 41 Street Business Park, and b. The requirement for amenities (e.g. a bike rack) to accommodate non-vehicular & alternative modes of travel. c. Identification that the site will use the B-4 hours of operation.
