HomeMy WebLinkAboutResolution No. 189-19 - Approving Final Plat CD2019-004PLAT Prairie Crossing Second RESOLUTION WHEREAS, Home Federal Savings Bank, owner, has shown to the satisfaction of the City of Rochester Common Council that it has complied with all conditions of approval imposed upon its Land Subdivision Permit (Final Plat) and all applicable laws and ordinances; NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester, Minnesota, that after a hearing duly noticed and held on September 4, 2019, the following plat of lands in Olmsted County, Minnesota are to be known and designated as follows: LEGAL DESCRIPTION Final Plat that part of Outlot I, PRAIRIE CROSSING, according to the recorded plat thereof, lying easterly of a line described as commencing at the southwest corner of said Outlot I; thence North 89 degrees 04 minutes 16 seconds East, assumed bearing, along the south line of said Outlot I a distance of 540.20 feet to the point of beginning of said line; thence North 00 degrees 55 minutes 44 seconds West 310.18 feet; thence northwesterly 344.31 feet along a tangential curve concave to the southwest having a radius of 380.00 feet and a central angle of 51 degrees 54 minutes 55 seconds; thence North 52 degrees 50 minutes 39 seconds West, tangent to said curve, 217.45 feet; thence northwesterly 385.69 feet along a tangential curve concave to the northeast having a radius of 854.93 feet to the northwesterly line of said Outlot I and there terminating. Together with that part of Outlot H, PRAIRIE CROSSING, according to the recorded plat thereof, lying southerly of a line described as commencing at an angle point of said Outlot H, said angle point being the northwest corner of Outlot E, of said PRAIRIE CROSSING; thence South 90 degrees 00 minutes 00 seconds West, assumed bearing, along the south right of way line of Gaillardia Drive N.W. as platted in said PRAIRIE CROSSING, 95.00 feet to the west right of way line of Larkspur Parkway N.W. as platted in said PRAIRIE CROSSING ; thence South 00 degrees 00 minutes 00 seconds West along the southerly extension of said west right of way line 3.00 feet to the southerly line of a 56 foot wide public road easement, as shown on said PRAIRIE CROSSING and recorded as document number A-1075290; thence South 90 degrees 00 minutes 00 seconds West along said southerly line 237.43 feet; thence westerly 54.87 feet along said southerly line on a tangential curve concave to the south, having a radius of 272.00 feet and a central angle of 11 degrees 33 minutes 33 seconds; thence South 78 degrees 26 minutes 27 seconds West, tangent to said curve, along said southerly line and its westerly extension, 416.95 feet to the easterly line of said Outlot I and said line there terminating. TO BE KNOWN AS PRAIRIE CROSSING SECOND, submitted by Home Federal Savings Bank, owner, is hereby approved and all dedications of land or interests in land for public purposes as shown on said plat are hereby accepted, subject to the following conditions: 1. A Revised Final Plat shall be submitted that identifies all required utility easements, to the satisfaction of Rochester Public Utilities. 2. The north line of the Final Plat boundary should be revised to extend to the centerline of the right-of-way Gaillardia Drive NW easement, or alternatively; the owner shall memorialize whether a future developer of proposed “Outlot A” or a future developer of “Outlot H” remnant north of the platted area be financially responsible for future construction of the public road and utilities. If no terms are established prior to recordation of this plat, the City will consider the first party to develop to be obligated for the costs of public improvement through a City-Owner Contract. 3. Platting of the public ROW for the future frontage road, and for the unplatted segment of Gaillardia Drive NW will be required concurrent with further development within the subject property. 4. Charges / Obligations applicable to the development of this Property shall be paid consistent with the terms of the Development Agreements and future City-Owner Contract for the Property.
