RESOLUTION
WHEREAS, Storm Properties, LLC, owner, requested approval for Conditional Use Permit Incentive
Development Preliminary Plan #CD2019-005CUP, which is for a six-story transient accommodation use
(hotel) with surface and underground parking. The site is .67 acres in size and located on the northwest
thnd
corner of the intersection of 5 Ave NW and 2 Street NW.
WHEREAS, the project is being proposed through the Incentive Development Conditional
Use Permit process because the proposed development exceeds the maximum permitted Floor Area in
the base zoning district; and,
WHEREAS, the proposal is consistent with Comprehensive Plan 2040.
WHEREAS, The Council adopts staff findings as described in the staff report dated September 25,
2019, and finds the proposal meets the regulations in R.C.O. § 62.630 (subd. 2) Conditional Use Permit
Incentive Development Preliminary Plan.
WHEREAS, on September 25, 2019 the City of Rochester Planning Commission held a public
hearing to consider this application, and adopted the findings of fact and recommended approval subject to
conditions 1-4 proposed by the Planning Department and amended by the Planning Commission.
WHEREAS, the Council finds the proposal meets two incentives in R.C.O. § 62.656 Central
Development Core and four incentive in R.C.O. § 62.658 All Development.
WHEREAS, on October 21, 2019, the City of Rochester Common Council held a public hearing to
consider this application and adopted the findings of fact and recommended approval subject to conditions
one 1-4 proposed by the Planning Department and recommended by the Planning and Zoning
Commission.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester that,
based upon the above-stated findings of fact, the Applicant has shown by a preponderance of the evidence
submitted at the public hearing that it has satisfied the above criteria subject to the imposition of the below-
stated four conditions of approval.
BE IT FURTHER RESOLVED that the City approve Conditional Use Permit Incentive Development
Preliminary Plan #CD2019-005CUP requested by Storm Properties, LLC, subject to the conditions of
approval shown below.
CONDITIONS
1. The Final Development Plans shall include:
a. Compliance with the 8% landscape area.
b. Compliance that the first floor glass transmittance is no less than 0.5 to meet the DMC
guidelines.
c. Compliance with the DMC guidelines that all awning heights provide a minimum vertical
clearance of 8’6”
d. A sign package identifying area, height, and lighting for all proposed signage (if Final
Development Plan exceeds Sign Standard C).
e. A revised Photometric Plan that identifies compliance with Exterior Lighting Standard D.

f. An amended design of the proposed intersection bump out to meet City design standards,
as identified in the memo from Rochester Public Works Department dated 9-15-19.
g. Relocation of the proposed transformer pad as required in the comment by Rochester
Public Utilities (RPU).
h. New water main alignment location as required in the RUP memo dated 9-3-19.
2. All comments provided in the review memo by Rochester Public Works dated 9-15-19 including:
a. Approval of a Grading and Drainage Plan prior to issuance of building permits.
b. Approval of a Traffic control plan prior to final CUP approval.
c. Execution of an Individual Site Development Agreement prior to final CUP approval to

address owner and City obligations regarding items such as improvements to 5 Ave
NW and the public alley lying west of this project, streetscaping, pedestrian level lighting,
allowed encroachments into public easements / ROW, the size of projecting signage,
seasonal maintenance of the alley (snow removal), development related charges (SAC,
WAC, Storm Water Management Charges if applicable), public use of pedestrian
orientated spaces outside of the public ROW
d. Execution of a City prepared Revocable Permit Agreement is required for all private
encroachments within the public ROW or easements, including but not limited to
projecting signage which meets the requirements of location and size as approved the
by the City Council as part of this CUP approval process.
e. Execution of a City-Owner Contract will be required for all public improvements
constructed for this proposed redevelopment, as well as, for reconstruction of any
existing public infrastructure within the public ROW or easements.
3. All comments provided in the review memo by Rochester Public Utilities (RPU) dated 9-3-19
including:
a. Abandonment/disconnection of existing water lines per RPU requirements.
b. New domestic house water meter located as required per RPU comments in the memo
dated 9-3-19
4. Provision of Boulevard trees or fee in lieu of plantings as required by Rochester City Park &
Recreation Department in the memo dated 9-9-19.
