HomeMy WebLinkAboutResolution No. 219-19 - Resolution Approving CUP Final Restricted Dev Plan R2019-009CUP requested by Cottage Grove LLC RESOLUTION WHEREAS, Cottage Grove, LLC, requested approval for Conditional Use Permit #R2019-009CUP, which is for a 15-unit multi-family development with an interior courtyard and surface parking lot for five vehicles. The site is currently three separate residential lots. The City’s Land Use Map designated this site as low density residential. The site is zoned R-1 (Mixed-Single Family) on the Rochester Zoning Map. WHEREAS, the project is being proposed through the Restricted Development Conditional Use Permit process because the proposed use is not permitted in the base zoning district; and WHEREAS, the proposal is consistent with Comprehensive Plan 2040. WHEREAS, on September 25, 2019, the City of Rochester Planning and Zoning Commission reviewed the application according to the requirements of R.C.O. § 62.708 (subd. 3) and did not make a recommendation to the City Council. WHEREAS, on October 21, 2019, the City of Rochester Common Council held a public hearing to consider this application and adopted alternative findings of fact and recommended approval with conditions. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester that, based upon the above-stated findings of fact, the Applicant has shown by a preponderance of the evidence submitted at the public hearing that it has satisfied the above criteria subject to the imposition of the seven conditions of approval. BE IT FURTHER RESOLVED that the City approve Conditional Use Permit Final Restricted Development Plan #R2019-009CUP requested by Cottage Grove, LLC, subject to the conditions of approval shown below: CONDITIONS 1. A Revised Final Development Plan shall identify: a. The location of a transformer pad, to the satisfaction of Rochester Public Utilities, Electric. 2. A Final Plat consolidating the existing three lots into one lot is required prior to issuance of building permits. 3. The boulevard tree requirement shall be met prior to issuance of building permits. 4. Prior to final development plan approval, Grading & Drainage Plan approval is required, as well as, payment of any applicable Storm Water Management Area Charge for any increase in impervious surface. 5. The condition of the existing pedestrian facilities and curb & gutter along 14th Ave SW, will be reviewed by Public Works staff, and any needed panel replacement and repair work will be required at the Owner’s expense concurrent with development. 1 6. Charges/fees applicable to the development of this property (as identified in the Public Works Review Comment, dated 5.12.2019) shall be paid prior to issuance of utility connection permit(s), or at the City’s discretion, within 30 days after invoicing. 7. This development shall be excluded from the residential permit parking program.
