HomeMy WebLinkAboutResolution No. 243-20 - Mayowood City Center Housing CD2020-023CUP RESOLUTION Approving a Conditional Use Permit Restricted Development Final Plan No. CD2020-023CUP, a three-story multi-family housing use located at the intersection of Mayowood Road SW and Restoration Road SW. WHEREAS, the project is being proposed through the Restricted Development Conditional Use Permit process because the proposed development is not a permitted residential use in the base zoning district; and, WHEREAS, the proposal is consistent with Comprehensive Plan 2040. WHEREAS, the Council adopts staff findings as described in the staff report dated June 1, 2020, and finds the proposal meets the regulations in R.C.O. § 62.708 (subd. 2) Conditional Use Permit Restricted Development Preliminary Plan. WHEREAS, on July 22nd, 2020, the City of Rochester Planning Commission held a public hearing to consider this application, and adopted the findings of fact and recommended approval subject to conditions one through six proposed by the Planning Department. WHEREAS, on August 17th, 2020, the City of Rochester Common Council held a public hearing to consider this application and adopted the findings of fact and recommended approval subject to conditions one through six. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester that, based upon the above-stated findings of fact, the Applicant has shown by a preponderance of the evidence submitted at the public hearing that it has satisfied the above criteria subject to the imposition of the below-stated six conditions of approval. BE IT FURTHER RESOLVED that the City approve Conditional Use Permit Restricted Development Final Plan No. CD2020-023CUP requested by Olmsted County Housing & Redevelopment Authority, subject to the conditions of approval shown below. CONDITIONS 1. Prior to issuance of building permits, a revised Final Development Plan for Phase I shall incorporate the following revisions: a. Label the 50-foot Olmsted County Right of Way Easement. b. Identify the location of the proposed moment sign. 2. Prior to approval of a Phase I building permit: a. An access permit is required through Olmsted County for the change-in-use of the existing access. b. A grading and storm water management plan associated with this project shall be approved. c. A Final Plat consistent with the conditional use permit boundaries shall be recorded. 3. Prior to recording the Final Plat: a. A 50-foot wide ROW easement must be dedicated. b. Cross-access and cross-parking agreement between the two proposed lots must be confirmed. c. Ownership and maintenance of proposed Outlot A needs to be addressed to the City’s satisfaction. 4. Execution of a City-Owner contract, and dedication of any applicable public easements is required prior to the construction of public infrastructure within individual lots for this development. 5. A water main construction plan and profile must be prepared and approved by RPU, MDH and City PW (by separate submittal) prior to any water main construction. 6. The property is subject to a Sewer Availability Charge, Water Availability Charge, and a Plant Investment Fee.
