WHEREAS, Rochester Public Schools requested approval for Conditional Use Permit No. CD2020-022CUP for a substantial land alteration for a cut or fill more than 10 feet in height. The site is 40 acres and is located on the north side of 65th Street NW, north of Ridgeway Road NW. WHEREAS, Findings A-Q in the staff report are adopted. WHEREAS, on July 22nd, 2020, the City of Rochester Planning and Zoning Commission reviewed the application according to the requirements of R.C.O §§ 61.146 and 62.1105 and recommended approval with staff’s recommended findings and conditions. th WHEREAS, on August 17 2020, the City of Rochester Common Council held a public hearing to consider this application and adopted findings of fact and recommended approval subject to the conditions listed below, based on the Substantial Land Alteration Exhibit. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester that, based on the above stated findings of fact, the applicant has shown by a preponderance of the evidence submitted at the public hearing that it has satisfied the above criteria subject to the imposition of the conditions of approval stated below. BE IT FURTHER RESOLVED, that the Common Council of the City of Rochester approve Conditional Use Permit No. CD2020-022CUP requested by Rochester Public Schools subject to the below stated conditions of approval: 1. An approved Grading and Drainage Report is required prior to implementation of the SLA.
