RESOLUTION
WHEREAS, Storm Properties, LLC, owner, requested approval for Conditional Use Permit
Incentive Development Final Plan #CD2019-011CUP, which is for a six-story transient
accommodation use (hotel) with surface and underground parking. The site is .67 acres in size
thnd
and located on the northwest corner of the intersection of 5 Ave NW and 2 Street NW.
WHEREAS, the project is being proposed through the Incentive Development Conditional
Use Permit process because the proposed development exceeds the maximum permitted Floor
Area in the base zoning district; and,
WHEREAS, the proposal is consistent with Comprehensive Plan 2040.
WHEREAS, the Council adopts staff findings as described in the staff report dated December 11,
2019, and finds the proposal meets the regulations in R.C.O. § 62.630 (subd. 3) Conditional Use
Permit Incentive Development Final Plan.
WHEREAS, on December 11, 2019 the City of Rochester Planning Commission held a public
hearing to consider this application, and adopted the findings of fact and recommended approval
subject to conditions 1-8 proposed by the Planning Department and amended by the Planning
Commission.
WHEREAS, the Council finds the proposal meets two incentives in R.C.O. § 62.656 Central
Development Core and four incentive in R.C.O. § 62.658 All Development.
WHEREAS, on January 6, 2020, the City of Rochester Common Council held a public hearing to
consider this application and adopted the findings of fact and recommended approval subject to
conditions one 1-8 proposed by the Planning Department and recommended by the Planning and
Zoning Commission.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester that,
based upon the above-stated findings of fact, the Applicant has shown by a preponderance of the
evidence submitted at the public hearing that it has satisfied the above criteria subject to the
imposition of the below-stated four conditions of approval.
BE IT FURTHER RESOLVED that the City approve Conditional Use Permit Incentive Development
Final Plan #CD2019-011CUP requested by Storm Properties, LLC, subject to the conditions of
approval shown below.

CONDITIONS
1. An updated Landscape Plan is required which identifies the relocation of the boulevard tree
shown next to the proposed transformer location which conflicts with RPU's transformer
installation access.
2. Approval of a Grading and Storm Water Management Plan is required prior to final CUP
approval.
3. Approval of a Traffic control plan is required prior to prior to final CUP approval.
4. Prior to final CUP approval execution of an Individual Site Development Agreement to
address owner and City obligations regarding items such as improvements to 5th Ave N and
the public alley lying west of this project, streetscaping, pedestrian level lighting, allowed
encroachments into public easements / ROW, the size of projecting signage, seasonal
maintenance of the alley (snow removal),development related charges (SAC, WAC, Storm
Water Management Charges if applicable), public use of pedestrian orientated spaces
outside of the public ROW.
5. Prior to final CUP approval, execution of a City prepared Revocable Permit Agreement is
required for all private encroachments within the public ROW or easements, including but
not limited to projecting signage which meets the requirements of location and size as
approved the by the City Council as part of this CUP approval process.
6. Execution of a City-Owner Contract will be required for all public improvements constructed
for this proposed redevelopment, as well as, for reconstruction of any existing public
infrastructure within the public ROW or easements.
7. The applicant shall meets its boulevard tree obligation prior to the issuance of building
permits.
8. A Demolition permit shall be required for each lot, and an inspection by Olmsted County
Well Staff is required for each lot
