HomeMy WebLinkAboutResolution No. 052-20 - Resolution Approving CD2019-014CUP-Final Plan RESOLUTION WHEREAS, Hersch Hoaglan, owner, requested approval a four story multi-family building containing 76 dwelling units on 4.25 acres, located on the west side of East Circle Road NE, south of Wheelock Drive NE. WHEREAS, the project is being proposed through the Incentive Restricted Development process because the proposed development is not a permitted use outright within the R-1X zoning district. WHEREAS, The Council adopts staff findings as described in the staff report dated January 8, 2020, and finds the proposal meets the regulations in R.C.O. § 62.708(subd. 3) Conditional Use Permit Restricted Development Final Plan. WHEREAS, on January 8, 2020, the City of Rochester Planning Commission held a public hearing to consider this application, and adopted the findings of fact and recommended approval subject to conditions 1-9 proposed by the Planning Department and as amended by the Planning Commission. WHEREAS, on February 3, 2020, the City of Rochester Common Council held a public hearing to consider this application and adopted the findings of fact and recommended approval subject to conditions one 1-9 proposed by the Planning Department. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester that, based upon the above-stated findings of fact, the Applicant has shown by a preponderance of the evidence submitted at the public hearing that it has satisfied the above criteria subject to the imposition of the below-stated four conditions of approval. BE IT FURTHER RESOLVED that the City approve Conditional Use Permit Incentive Development Final Plan #CD2019-014 CUP requested by Hersch Hoaglan, subject to the conditions of approval shown below. CONDITIONS 1. Submission of a revised final development plan shall include the following information and revisions: a. A detailed list of building and ground materials, including colors. b. An additional passive and/or active outdoor recreation element shall be provided for the development. c. Updated recreational space information providing the final total square footage and percentage of recreational space. d. Development shall comply with sign category “A” standards; remove proposed 5’ x 9’ ground monument sign from project data. e. Ground monument sign shall be relocated outside of the public utility easement. f. The “Resource Protection Area” shall be clearly identified on the site and noted the area is not for development and existing vegetation is to remain. 1 2. Prior to the issuance of building permits, a final plat establishing the boundaries of this lot shall be recorded. 3. Parkland dedication will be shall be required prior to recording of final plat to the satisfaction of the Parks Department. 4. The boulevard tree requirement shall be met prior to issuance of building permits. 5. Prior to issuance of building permit, the applicant shall obtain a reciprocal access easement from the City of Rochester Parks Department to allow access and tie-in of the pedestrian pathway to the public bike path. 6. Prior to final development plan approval, the Grading and Stormwater Management Plan associated with development proposed as CD2019-014CUP shall be approved 7. Execution of a City-Owner Contract, and dedication of any applicable public easements (not shown on the plat) is required prior to construction of any public infrastructure within individual lots of this development. 8. There is an existing development agreement for this site. Development of the site is subject to the terms of that agreement. 9. Plant Investment Fee (PIF) - TBD and collected through the Building Permit process.
